Introduction
• Former police sergeant Jon Schorsch is the holder of a juris doctor
from the Seattle University School of Law. Focused on employment
and labor relations law, Jon Schorsch has technical proficiency in
the Fair Labor Standards Act (FLSA).
In January 2018, the U.S. Department of Labor (USDOL) announced
increases in the civil penalties it is authorized to impose on
employers for violations of FLSA.The penalties announced are two
percent higher than those of 2017.The increase is in line with the
Civil Penalties InflationAdjustment Act Improvements Act of 2015.

• Under the new rules, USDOL can impose monetary penalties up to
$1,964 for willful or repeated violations of minimum wage laws and
overtime requirements.These penalties are imposed per person,
which means USDOL can multiply the penalties by the number of
employees paid unlawfully.
Another penalty increased by the Department of Labor is for
violations of FLSA child labor restrictions.These violations are
punishable by civil penalties of up to $12,529. If the violation led to
a minor’s injury or death, USDOL can impose civil penalties as high
as $56,947, or $113,894 for repeated or willful violations.

USDOL Revises FLSA Civil Penalties Upward

  • 2. Introduction • Former police sergeant Jon Schorsch is the holder of a juris doctor from the Seattle University School of Law. Focused on employment and labor relations law, Jon Schorsch has technical proficiency in the Fair Labor Standards Act (FLSA). In January 2018, the U.S. Department of Labor (USDOL) announced increases in the civil penalties it is authorized to impose on employers for violations of FLSA.The penalties announced are two percent higher than those of 2017.The increase is in line with the Civil Penalties InflationAdjustment Act Improvements Act of 2015.
  • 3. U.S. Department of Labor • Under the new rules, USDOL can impose monetary penalties up to $1,964 for willful or repeated violations of minimum wage laws and overtime requirements.These penalties are imposed per person, which means USDOL can multiply the penalties by the number of employees paid unlawfully. Another penalty increased by the Department of Labor is for violations of FLSA child labor restrictions.These violations are punishable by civil penalties of up to $12,529. If the violation led to a minor’s injury or death, USDOL can impose civil penalties as high as $56,947, or $113,894 for repeated or willful violations.
