➪ Air prevention and control of pollution Act of 1981,
popularly known as the air act was enacted by the Parliament
of India to prevent and alleviate the negative impacts of air
pollution.
➪ In India air pollution has become a major problem in recent
year giving rise different age groups.
➪ To minimize the level of such pollution in the environment.
So the air prevention and control of pollution act was created.
Introduction
Definition
Section 2(a) "air pollutant" means any
solid, liquid or gaseous substance
including noise present in the
atmosphere in such concentration as
may be or tend to be injurious to
human beings or other living creatures
or plants or property or environment;
Section 2(b) "air pollution"
means the presence in the
atmosphere of any air
pollutant;
🔹The idea for a global conference to discuss and stop pollution
and the deterioration of natural resources was first put forth to
the United Nations by Sweden.
🔹Therefore, the United Nations Conference on the Human
Environment was held in Stockholm in June 1972 due to the
General Assembly passing Resolution 2398. It was decided at
this conference that the nations would take action to protect
the natural resources, including air.
Air Prevention and Control of Pollution Act 1981 :
🔹As a result, the Indian government passed specific laws
under Article 253 of the Indian Constitution to preserve
natural resources. The Air (Prevention and Control of
Pollution) Act of 1981 was passed for air conservation.
🔹The Preamble of the Act states that the purpose of the
Act is to prevent, control, and reduce air pollution and that
it is the responsibility of the Boards established by the Act
to carry out these purposes.
Air Prevention and Control of Pollution Act 1981 :
Objectives of the Air Prevention and Control of Pollution Act 1981:
🔸To provide for the prevention, control, and reduction of air
pollution.
🔸To provide for the establishment of central and State Boards to
implement the Act.
🔸To confer on the Boards the powers to implement the provisions of
the Act and assign to the Boards functions relating to pollution.

State pollution
control board
The main function of the Central Board shall be to
improve the quality of air and to prevent, control, or abate
air pollution in the country. It may;
➣ Advise the Central Government on any matter concerning
the improvement of the quality of air;
➣ Plan and cause to be executed a nation-wide program for
the prevention, control or abatement of air pollution;
Co-ordinate the activity of State and resolve disputes among
them;
Powers and Functions of Central Board-
➣ Provide technical assistance and guidance to the state
boards, carry out and sponsor investigations and research
relating to problems of air pollution.
➣ Organize through mass media a comprehensive
programme regarding the prevention, control, or abatement
of air pollution.
➣ The Central Board may establish or recognize a laboratory
to enable the Central Board to perform its functions under
this section efficiently.
Powers and Functions of Central Board-
➣ To plan a comprehensive programme for the prevention,
control or abatement of air pollution;
➣ To inspect air pollution control areas at such intervals as
it may think necessary, assess the quality of air therein and
take steps for the prevention of air pollution in such areas;
Functions of State Boards shall be-

➣ To inspect, at all reasonable times, any control
equipment, industrial plant or manufacturing process,
and to give by order such directions to such person as
it may consider necessary to take steps for prevention
of air pollution.
➣ To advise the State Government on any
matter concerning the prevention of air
pollution;
Legal provision regarding prevention
and control of pollution:
🔹Declared of certain areas as pollution control areas
🔹Prohibition on fuel causing air pollution
🔹Prescription and approved of appliance for use in premises
in pollution control areas
🔹Fixation of emission standards in case of motor vehicle

🔹Prohibition on burning of any material in air
pollution control area
🔹Prohibition on industrial plants from
discharging air pollutants in excess of the
prescribed limits
Conclusion :
The air pollution is a significant problem that impacts
our health and the environment. It's crucial that we
take decisive action to reduce pollution levels through
measures like using cleaner energy sources, improving
vehicle emissions standards, and promoting public
transportation. By working together to address this
issue, we can ensure a cleaner, healthier future for
generations to come.
