1) Educational, counselling, and industrial psychologists are challenging regulations that restrict them from treating patients with mental illnesses like depression, as major medical aids will only reimburse treatments provided by clinical psychologists.
2) A court case will be heard in November regarding regulations from 2011 that differentiated the scope of practice for various types of psychologists in a way that has severely impacted non-clinical psychologists' ability to be reimbursed for mental health services.
3) There is a shortage of psychologists in South Africa, especially in rural areas, and the strict regulations risk preventing thousands from accessing mental health assistance from any psychologist other than a clinical one.
- Bonitas Medical Aid and other insurers will no longer cover consultations with educational psychologists for adult patients, following guidelines from the Council for Medical Schemes.
- This threatens the livelihoods of psychologists as their practices rely on medical aid reimbursements.
- ReLPAG is taking the insurers to court but urgently needs financial contributions from members to fund the legal case, as it is their only remaining option. Members are asked to donate R1000 or the equivalent of one hour's therapy fees.

JASA and RELPAG, a voluntary association of 600 psychologists, are taking legal action against the HPCSA and Minister of Health over new regulations issued in 2011 that are negatively impacting psychologists. The regulations are being interpreted as excluding experienced counselling, educational, and industrial psychologists from practicing clinical psychology, causing them substantial loss of earnings. Some psychologists are also facing disciplinary action for continuing to treat existing patients. There is evidence that the regulations are restricting patient access to care, such as a single mother in Limpopo who relies on her psychologist but cannot afford to find a new one. JASA believes the regulations violate psychologists' rights to work and citizens' rights to healthcare. RELPAG exhausted negotiations with HPCSA and sees court
Ronelle van Heerden sent an email to Liana Bauchop informing her that the health insurance scheme will not fund services provided by Industrial and Educational Psychologists until a court case on the scope of their practice is finalized. The letter from the Council for Medical Schemes responds to a complaint from the Vice Chairperson of the Medical Aid Liaison Body regarding coverage of educational psychologists. The Council denies that its previous letter on the topic was legally incorrect or discriminatory, as it was based on the legislated scope of practice for psychologists. While scope of practice issues should be addressed by the Health Professions Council, medical schemes are only required to cover prescribed minimum benefits, not other benefits like learning and development services. For coverage, it would need to be shown that educational psychologist services fall within regulations or a scheme's benefits. The Council invites the submission of evidence on this point, including regarding any updated scope of practice.
CMS - JASA's letter - Allegations fraud and interference - 1 March 2016ReLPAG Psychology
The document is a letter from the Justice Alliance of South Africa regarding a court case to be heard in early 2016. The primary issue to be decided by the court is whether education and industrial psychologists are entitled to practice psychology in all areas within their competence based on their education and experience, despite current regulations. The letter states that refusing payment to these psychologists may interfere with the court case, and allegations of fraud against them would constitute defamation that could result in substantial damages. The letter requests that any fraud allegations be withdrawn.

Psychologists are being forced to close their practices because medical aid schemes are refusing to pay them. Several representative bodies are taking Health Minister Aaron Motsoaledi and other organizations to court hoping for a ruling that will result in the repeal of scope-of-practice regulations issued in 2011. The regulations are often interpreted to prevent psychologists from treating the full range of psychological conditions in line with their professional competency. The matter was postponed to August by the Cape Town High Court after the Health Department asked for a postponement last week.
