It is prescribed, when death approaches any of you, that he leaves any good
inheritance to parents and next of kin, in good term; this is a due from the God
fearing. (Q 2:180)

PREAMBLE
I bear witness that there is no god but Allah, the Merciful, the Almighty –Creator of the
heavens and the earth and all therein–God of Abraham, Moses, Jesus, Muhammad,
and all the Prophets, mercy and peace be upon them all. He is One God without partner.
I bear witness that Prophet Muhammad is His servant and His Messenger and the last
of all the Prophets, mercy and peace be upon him. I bear witness that Allah is the Truth,
that His promise is truth, that the Meeting with Him is truth. I bear witness that the
Paradise is truth, and that Hell is truth. I bear witness that the coming of the Day of
Judgment is truth, there is no doubt about it, and that Allah, who is exalted above all
deficiencies and imperfections, will surely resurrect the dead of all generations, first and
last and those in between.
This is my counsel to my relatives and friends, my Muslim brothers and sisters, and all
those who remain after me, that they should strive to be true Muslims, that they submit
to their Creator-may He be exalted- and worship Him as He alone is to be worshiped,
fear Him as He alone is to be feared, love Him and His Prophet Mohammad (SAW). Let
them obey Him and hold fast to His Shari'ah (law). Let them die only in a state of
complete submission to His Will. I remind them that no man/woman dies before his/her
time. The exact duration of each life span is precisely determined before birth, by the
All-powerful Creator, may He be exalted. Death is tragic only for those who lived their
life in self-deception without submitting to the Creator and preparing for the final return
to Him. So, do not pre-occupy yourself with my death, but instead, make the proper
preparations for your own.
Finally, I ask all my relatives, friends, and all others, whether choose to believe as I
believed or not- to honor my Constitutional rights to these beliefs. I ask them to honor
this document which I have made, and not to try to obstruct it or change it in any way.
Rather, let them see that I am buried as I have asked to be buried and LET MY
PROPERTIES BE SHARED IN ISLAMIC RITE.

MY ORDERS
1. I ordain that NO autopsy or embalming be done on my body unless required by
law, that without unjustified delay my body be washed, wrapped with cloth free of
any ornaments and other articles, prayed for, then buried, which all should be
done by Muslims in complete accordance with Islamic belief.
2. I ordain that absolutely NO non-Islamic religious service or observance be
conducted upon my death, or on my body.
3. I ordain that NO pictures, crescents and stars, decorations, crosses, flags, any
symbols, Islamic or otherwise, or music be involved at any stage of the process
of conducting my burial or ever be placed at the site of my grave.
4. I ordain that my body shall not be transported over any unreasonable distance
from locality of my death unless when long distance transportation is required to
reach the nearest Muslim cemetery, or any other cemetery selected by my Muslim
family.
5. I ordain that my grave be dug deep into the ground in complete accordance with
the specifications of Islamic practice, and in compliance with all local laws, that it

faces the direction of Qiblah (the direction towards which Muslims face during
prayers).
6. I ordain that my body shall be buried without a casket or any other encasement
that separates the wrapped body from the surrounding soil.
7. I ordain that my grave be leveled with ground or slightly mounded with NO
construction or permanent structure of any kind over it. The marking if necessary,
should be a simple rock or a marker, merely to indicate the presence of the grave.
8. I ordain that my body after death should be buried in MUSLIM CEMETRY not
other place than that.
9. I ordain that any of my children, wife(ves), or grandchildren who turned apostate
to Islam shall not benefit from my properties.
10. I ordain the distribution of the residue and remainder of my estate shall be
made strictly in accordance with ISLAMIC LAWS OF INHERITANCE
11. Should I die as a result of murder, I direct that the adjured murderer,
principal or accessory in the murder, shall be disqualified to receive any part of
my estate.
12. I ordain and devise that any fetus, conceived before death, whose
relationship to me qualifies it to be my heir according to Islam shall be verified and
considered as an heir if truly certified. I further direct and devise that, whenever
there exists a fetus who may become an heir according to this section, the whole
distribution of the residue and remainder of my estate after the execution of
charitable contributions and testamentary transfer, shall be delayed until after
the birth of the fetus.
13. The share of each child of mine shall be paid or transferred to such child, if
he or she is over the age of 21 at the time of my death, for his or her own use
absolutely. If however, any one of children of mine, whether male or female, is
under the age of 21 at the time of my death, my Executors shall hold and keep
the invested share of the such child(ren) of mine and use the income from such

for maintenance, education and benefit of such child(ren) of mine until he or she
reaches the age of 21, at which time my Executors shall pay or transfer the
amount remaining of the share of such child(ren), if any, to such child for his or
her own use absolutely.
14. Any family members, friends and religious organizations that remembers
me should offer prayers for me personally, give charity or carry out Sadaqah
Jariya for my sake at no fixed time.
15. I instruct that not more than one-third (1/3 or 33.3%) of the total value of
my estate should be distributed to non-heirs as follows:
1. Distant Relatives (15%)
a) Maternal uncle (Mother’s brother)
b) Maternal aunt (Mother’s sister)
c) Paternal aunt (Father’s sister)
d) Cousins.
i. Son of maternal uncle.
ii. Daughter of maternal uncle.
iii. Son of maternal aunt.
iv. Daughter of maternal aunt.
2. Islamic Charity
a) Donation of affordable copies of the Holy Qur’an to all Mosque around
my residence and beyond.
b) Donation of two bags of rice to homes of destitute at Eid periods.
c) Donation of affordable amount of money to a Ramadan lecture to
different Sunnah Organizations.
Note: All these shall be done in accordance with Islamic law

3. Endowment (Waqf)
I instruct that an endowment be established in my name at a Mosque or build
an Islamic centre in my name for the propagation of Islam and Sunnah
programmes.

without any need for a court order, that no bond or surety for any bond be required for
him in the performance of this duties. I hereby further nominate and appoint the named
above, in the same order, to be the guardian of the persons and estates of such of my
children who shall be minor at and after my death, during their minority.
DEBTS AND EXPENSES
I direct that my executors apply first, the assets of my estate to the payment of all my
legal debts, including such expenses incurred by my last illness and burial as well as
the expense of administration of my estate. I direct the said executors to pay any
“obligations to Allah” (Huquq Allah) which are binding on me under the belief of Islam
including any unpaid zakah, kaffarah
Subject to the above, to use their discretion in the realization of my estate with the power
to my Executors to sell, or convert into cash at any time they see fit, decide upon, and
my Executors shall not be held responsible for any loss that may happen to my estate
by reason of their so doing;
to pay my debts (as listed in appendix II), funeral and other testamentary expenses,
all sequence duties and all expenses necessarily incidental thereto, to be paid and
satisfied by my Executors immediately after my death; to collect all my debts and
outstanding property (as listed in appendix III) and to return the property for my heirs;
that all my clothes, jewelries (other than those kept for investment purposes), ornaments
which have from time to time been made and given to my parents, my wife and to my
children which are in their possession or are kept in the family safe or in the safe deposit

vault are their absolute property respectively and do not form part of my estate, and the
Executors have no right over such properties;
the Executors should pay costs of administration of my estate (including the expenses
of any additional proceedings that may be necessary in attaining the right fulfilment of
