Safeguarding External &
Internal Whistleblowers
• Complaints may come in a number of ways – a letter,
an e-mail, in-person or phone call
• Provision for the anonymity of any individual who
willingly comes forward to report a suspicion of fraud is
a key element to ensure credibility of the process
• Where an allegation is received by phone or in person
it is important to fully record the factual details of the
suspected case of fraud
• Remember to also record details surrounding the
complaint – name of person, position in the
organisation, phone number, time and date of the
phone call or meeting
• If the allegation is recorded by hand the recording
officer should sign and date the document

• All allegations should be held in confidence and
passed promptly to the responsible official for Fraud for
assessment
• Allegations could be made against people you know or
work with
• If there are potential conflicts of interests others need
to investigate.

Brexit – Do we still need to
abide by the rules?
• Pre Brexit and post Brexit transition period the UK retains same
State aid obligations and responsibilities as a member state.
• Any trade deals struck are highly likely to include competition
law in some form.
• State aid is cornerstone of single market/free trade
• UK SI comes into force 29 March if no deal Brexit, transposing
existing EU State aid regime into UK law with CMA as UK
regulator
What is State Aid?
“Save as otherwise provided in this Treaty, any aid
granted by a Member State or through State
Resources, in any form whatsoever, which
distorts, or threatens to distort competition by
favouring certain undertakings or the
production of certain goods, shall insofar as it
affects trade between Member States, be
incompatible with the internal market”
State aid is formally defined in Article 107 of the
Treaty on the Functioning of the European Union:
State Aid Compliance Template
Is the beneficiary deemed an undertaking? If so, we
must apply the four State Aid Tests:
1. Is the aid from a Member State or through State
resources?
2. Does it confer a selective economic advantage on an
undertaking?
3. Does it have the potential to distort competition?
4. Is it likely to affect intra-community trade?
All need to be met for State aid to be present
What do we do when
State aid is present?
• In Scotland, Structural Funds grants which
include State aid are usually paid to the end
beneficiary in accordance with the General
Block Exemption Regulation, or de minimis.
• Full records of all GBER awards should be
reported to the State Aid Team on an annual
basis.
Getting it wrong…
• Potential investigation by the State Aid Regulator.
• Aid can be halted.
• Any illegal aid must be repaid, with interest, by the
recipient.
• Potential action by aggrieved competitors – possibility
of recovery order and damages by national courts.
• Reputational damage - Undermines Government
and Local Authority commitment to tighter State aid
control and best use of public resources.
Trying to Get it Right!
• State Aid Team has provided advice on all major
public interventions across Scotland.
• Successful involvement in cases with high
ministerial priority/sensitivity.
• Aim is to reduce/minimise risk exposure.
• Eager to work with policy areas and Local
Authorities at the earliest possible point in project
or policy development to ensure compliance.

Safeguarding External & Internal Whistleblowers • Complaints may come in a number of ways – a letter, an e-mail, in-person or phone call • Provision for the anonymity of any individual who willingly comes forward to report a suspicion of fraud is a key element to ensure credibility of the process • Where an allegation is received by phone or in person it is important to fully record the factual details of the suspected case of fraud
  • 35. • Remember to also record details surrounding the complaint – name of person, position in the organisation, phone number, time and date of the phone call or meeting • If the allegation is recorded by hand the recording officer should sign and date the document Safeguarding External & Internal Whistleblowers

Brexit – Do we still need to abide by the rules? • Pre Brexit and post Brexit transition period the UK retains same State aid obligations and responsibilities as a member state. • Any trade deals struck are highly likely to include competition law in some form. • State aid is cornerstone of single market/free trade • UK SI comes into force 29 March if no deal Brexit, transposing existing EU State aid regime into UK law with CMA as UK regulator
  • 58. What is State Aid? “Save as otherwise provided in this Treaty, any aid granted by a Member State or through State Resources, in any form whatsoever, which distorts, or threatens to distort competition by favouring certain undertakings or the production of certain goods, shall insofar as it affects trade between Member States, be incompatible with the internal market” State aid is formally defined in Article 107 of the Treaty on the Functioning of the European Union:
  • 59. State Aid Compliance Template Is the beneficiary deemed an undertaking? If so, we must apply the four State Aid Tests: 1. Is the aid from a Member State or through State resources? 2. Does it confer a selective economic advantage on an undertaking? 3. Does it have the potential to distort competition? 4. Is it likely to affect intra-community trade? All need to be met for State aid to be present
  • 60. What do we do when State aid is present? • In Scotland, Structural Funds grants which include State aid are usually paid to the end beneficiary in accordance with the General Block Exemption Regulation, or de minimis. • Full records of all GBER awards should be reported to the State Aid Team on an annual basis.
  • 61. Getting it wrong… • Potential investigation by the State Aid Regulator. • Aid can be halted. • Any illegal aid must be repaid, with interest, by the recipient. • Potential action by aggrieved competitors – possibility of recovery order and damages by national courts. • Reputational damage - Undermines Government and Local Authority commitment to tighter State aid control and best use of public resources.

Trying to Get it Right! • State Aid Team has provided advice on all major public interventions across Scotland. • Successful involvement in cases with high ministerial priority/sensitivity. • Aim is to reduce/minimise risk exposure. • Eager to work with policy areas and Local Authorities at the earliest possible point in project or policy development to ensure compliance.
