Civil Registration Documents (CRDs) – General Data • The mayor is the civil registrar where the commune does not have the means to organize a bureau for population identification. • The general rule is that the declaration of birth has to be made in 30 days from the birth and death has to be declared in 3 days from occurence. • No funeral can be authorized without the death certificate and no religious marriage ceremony can take place without a marriage certificate. • The Ministry of Internal Affairs has an on-going project with funds from EU (with a value of 34 milion Euros over 3 years ) for the petitioners to be able to ask online for CRD and also with the digitalization of all CRDs from the last 100 years. This provisions were included in the law of civil registration documents from the beginning in 1996. • _presa/com_pdf/pop12e17.pdf CRDs Registration is free All CRDs are issued free of charges All the vital statistics are available free of charge on the site of NIS The CRDs are compulsory for everyone even for apatrids, but with the exception that for the foreigners is not mandatory to apply for CRD When asking for CRD, the petitioner has to complete a vital statistic form that is delivered to the NIS

  5. 5. 54,5% births in urban area; 46,6% new-born have both parents with salaries; 51,3% boys; median age of mother 28,4 years The marriage rate in 2016 was 6 marriages at 1000 peoples; median age at marriage 32,7 years men and 29,4 years women; the rate for divorce dropped from 1,42 divorces at 1000 people in 2015, to 1,37 divorces at 1000 people in 2016; the secquence of marital life lasts in average 9,2 years for men and 8,8 years for women The general death rate was 11,6% in 2016, from 11,8% in 2015; the rate of death for mothers was 8,9 deaths at 100.000 living new-borns, decreasing from 13,4 in 2015; the rate of death of children was 7,3 for children under 1 year of life to 1000 living new-borns, from 7,5 in the previous year; 40% from this deaths had as cause the affections from the perinatal period; 25% from this deaths had as cause desseases of the breathing system. PIN - the Link between the Civil Registration Documents and the Social Protection System • PIN is being in use since 1975 • The PIN identifies a person and constitutes an instrument of verifing the civil status data of that person in any electronic system managed by a public authority (for eg. Health system, education system). • In order to verify the identity of the Romanian citizens, apatrids or foreigners, each person is asigned from birth a PIN which is written in the acts and civil status certificates, and also is provided in the other official acts that are issued on the name of that person, and in the National Registry for Persons Identification.
  7. 7. Data Protection for PIN and other Data in the Civil Registration Documents • This data can be used only with respect of the specific provisions of law in this field. In general, this data may be used with the agreement of the person;. Any other person has to use this kind of data only for the established purpose and by ensuring data protection as stipulated by law. • The civil status certificates are printed under the supervision of the Ministry of Internal Affairs (MIA) with safety elements, on special paper with letter R in watermark. The color on the certificates has to be uniformly distributed in all the material and also in all its depth. All the certificates must have the coat of arms of Romania in the middle and have to be printed in chains of 25 pages; every certificate has a unique identification number formed from 2 letters and 6 digits that is printed in the middle under the title of the certificate. All description are found in the methodology of application of the law 119/1996 on CRVS approved by the Governmental Decision no 64/2011 • This data may be available for other persons on demand for purpose of public interests actions or for fulfillment of legal obligations, by paying the legal taxes and by through a contract with MIA. The tax is 0,25 USD per person if the request is for data of only one person or the request refers to a reduced amount of information. For any other cases the tax is 30 USD. In 2016 were collected for the state budget 216.000 USD and in 2017 - 222.500 USD. • The public institutions of public order and national safety may use personal data without paying taxes by through an agreement with MAI (e.g. The secret services). • In any case, the contract and the agreement has to contain the destination of the data, the volume and the structure of the data and measures of protection and security of the data that are provided acording to the law

Social Protection Programs and the Main Incomes • For year 2014 there were identified 27 social protection Programs. • Each Program is stipulated in one or more normative acts Social protection • All the Programs are managed by the public central administration with the exception of the social protection and assistance that is provided by the NGOs General character of social protection Programs •Social contributions - 7,3% from GDP •Social contributions of the employers – 5,1% from GDP •Contributions of the central public administration – 7,4% from GDP The main incomes

Benefits of Social Protection that Can be Obtained by Using the Birth Certificate State allowance provided by article 49 of the Constitution •From birth till age 2, child allowance is monthly of 50USD/child (17,21% from the minimum guaranteed net salary); from 2 years till 18 years 21 USD/child (7,23% from the minimum guaranteed net salary ) For the first 9 months of 2017 for 3.648.390 children the total amount was 843 million USD – 0,03% from GDP. •The state allowance may be cashed in with the child rearing benefit and with the back-to-work bonus Child rearing benefit •After the legal periods of leave for pre and post birth until the age of 2 years of the child, a stipend for child care/raising may be obtained. The allowance is minimum 85% from the minimum brut guaranteed salary – 414 USD and maximum 85% from the average of all net incomes obtained in any 12 months in the 2 previous years before the birth, but no more than 2125 USD. This maximal limit was established only from 2017.09.01. From 2016.07.01 there was no limit at all. •For the first 9 months of 2017 for 157.843 persons the total amount was 639 million USD - 0,29 % from GDP Back-to-work bonus •If after the birth and before the child is 2 years old in the period of the leave for rising the child a mother starts to realize earnings that are objects to the fiscal rules, the mother is monthly entitled to an allowance of 166 USD -14,29% from the minimum guaranteed net salary till the child is 3 years old. •For the first 9 months of 2017 for 70.227 persons the total amount was 103 millions USD – 0,047% from GDP

The Legal Benefit of Free Powder Milk Formula for Babies between 0 and 12 months A special Law stipulates that the state has to provide powder milk formula for babies between 0 and 12 months entirely free of any charges. The Program is financed by the budget of Ministry of Health and the milk is distributed by the Local Councils This benefit is granted on monthly medical prescription issued by the family doctor for mothers that are not able to brest-feed cause to extremly illness (HIV or TBC), for babies that were adopted, in the case of mother´s death or for healthy child that has not a satisfied growing The milk is provided even if the parents do not have the quality of beeing insured in the public health system. The composition of the formula is established by doctors based on the EU and WHO standards. • In 2017 the Program had 30.901 beneficiary babies with a total cost of 1,1 mil USD

The Benefit for Youths to Build Their Own Home – a Social Program with the Local Administrations Every commune, town or municipality has to make an inventory of the land from its private property available for this Program and to publish the results Any youth that can prove with the birth certificate that is of age between 18 and 35 years and do not have a house in property may ask the local council to give him a piece of land between 150 squared meters and 1000 squared meters. Any other conditions may be imposed by the local administration The beneficiary has to start building in 1 year from the local council approval otherwise the council will revoke its decision. After the building is finished the local authority may sell the land directly to the owner of the house at the price fixed by an authorized evaluation expert • The provisions of the law that stipulated this Program may be used in order to obtain the land and together with the provisions from the ”First House” Program in order to obtain the funds for building a house. • In 2014, 44% of youths were still living with their parents

Benefits of Social Protection that Can be Earned/Obtained by Using the Certificate of Marriage Family allowance • It is a form of sustaining the families with monthly salary per person/family member under 0,4 from the Social Reference Index – SRI (50 USD) that also have to take care for children under 18 years old • If one child is of school age the allowance can be earned only if the family proves that the child is attending school classes without discontinuty. The ”First House” Program • The person (and his or her spouse) that does not own a home may apply for a credit guaranteed by the state with a maximum value of 57.000 Euros and with an advance of minimum 3.000 Euros for buying or building a home. • The risk of the guarantee is divided between the state and the bank that is involved in the Program at a rate of 50%. The margin of the bank is of 2%. In the period 2009-2017 were issued 236.138 guarantees (with total value of 5,14 bilion USD) from which were paid only 521 guarantees with a total value of 10,1 milion USD for all this period of time Social aid • The families are entitled to a minimum guaranteed income based on a social investigation made by the social protection services and also based on the documents of civil status that proves the family composition. The level of the income is the difference between the minimum guaranteed income and the monthly take home pay per each member of the family.

Benefits of Social Protection That Can Be Earned/Obtained by Using the Death Certificate Death allowance • In 2018 the quantum of death allowance is 1075 USD for the retired person or a person that is ensured in the public insurance system and 537 USD for a family member of a retired person or of a person that is insured (in 2017 the allowance was 783 USD for insured persons and 392 USD for uninsured persons, from 383 USD in 2006 and 191,45 USD). From 2017.01.01 to 2017.11.30 there were 171.490 demands for the allowance with a total value of 128,42 mil USD and an average value of 776 USD per person. • In 2016 there were 256.761 deaths with 1,9% less than in 2015 with a death rate of 11,6 at 1000. In 2016, 182.666 demands of allowance were admitted with a total value of 121 mil USD and an average of 659 USD per beneficiary The descendant pension • The children and the surviving spouse or wife are entitled to the descendant pension if the deceased were a retire or he fulfilled the conditions to earn pension. The quantum is calculated from the pension rights that the deceased person should have been entitled. In case that both parents are deceased the quantum is established by making the total of the pension rights of both parents. • The medium number of persons that are entitled to earn pension in the public insurance system (88,3% from the total number of the pensioners) in 2015 was 5.306.000 persons decreasing with 51.000. The total value in 2014 was 14,2 bilion USD – 8% from GDP. The average pension was 223 USD. In 2015 there were 594.000 descendant pensions with an average pension of 131 USD and a total value of 77,9 mil USD– 0,043% from GDP. The minimum pension was 130 USD.
  14. 14. A few elements of conclusion and… Vital statistics are generated from civil registration in real time on continuous bases. CRD can not be requested on line. However, we have a reasonable perspective that in 3 year time the system will allow the petitioners to ask online for civil registration documents The civil registration documents and PIN are used for purposes of social protection. Also the benefits that the legislator had established to be linked with the civil registration documents are continuously improving the rate of birth, marriage and death registration • Thank you!
