WHAT IS HIPAA?HIPAA is the Health Insurance Information Portability and AccountabilityAct, and was signed into law by President Clinton in 1996.HIPAA was enacted in order to provide protection for electronic patient healthinformation stored by covered entities.A covered entity can be:-A healthcareprovider: Physician, Podiatrist, Chiropractor, Psychologist, etc.- A health plan: Insurance companies, HMOs, Corporate HealthPlans, Medicare & Medicaid.- A Healthcare clearinghouse that handles electronic medical records

Privacy Rule vs. Security RuleThere are two chief regulations that stem from the HIPAA Act: the Privacy Ruleand the Security Rule.The Privacy Rule safeguards patient information while permitting “thedisclosure of personal health information [to the appropriate parties] needed forpatient care” (Center for Medicare and Medicaid Services „CMS‟).The Security Rule dictates “administrative, physical and technical safeguards”that must be put into place by „covered entities‟ to ensure theconfidentiality, integrity, and prompt availability of electronically stored patienthealth information (CMS).The Privacy and Security Rules apply to ALL COVERED ENTITIES.
