  6. 6. Conditions to use CashnaCashna Retail Supplier Accounts are subject to the separate Cashna Retail Operating Regulations and SupplierAgreement.Cashna - Seller Terms and Conditions1. Cashna ( provides services as a payment service provider, Sellers service provider and InternetPayment Service Provider ("CASHNA"). CASHNA services are provided to selected Sellers, selling products andservices on the Internet. Seller hereby appoints CASHNA as their provider of Sellers online payments and otherservices as provided under this Agreement. Seller may use CASHNA payment services to allow Customers topurchase Sellers products or services using their Cashna balance. Seller agrees to promptly deliver to its ownCustomers all products and services sold under this Agreement.2. Standard Commission. CASHNAs transaction commission is based on the Plan rate the Seller signed up for.3. Implementation of the service. Seller will develop and maintain Web site(s) (if applicable e-commerceservices), which will advertise and describe the products services that will be charged through CASHNA.If applicable, Seller will design these Web sites in a manner, which automatically refers customers to CASHNAsonline shopping cart(s) or CASHNAs Transaction Entry Screens using the instructions provided to Seller viaCASHNAs Seller User Interface or via e-mail. After receipt of each valid customer order, CASHNA will send Sellera Purchase Order via E-mail, and CASHNA will also post the order on the User Interface screen. Seller will deliverthe ordered product(s) and service(s) to the Customer, and if requested by CASHNA will promptly acknowledgethe shipment using e-mail or the User Interface, whichever is applicable. Seller agrees to deliver all merchandiseto Customers without any delay. Seller will not offer back ordered or out-of-stock products for sale unlessanother agreement signed by CASHNA and the Seller. If Seller is unable to ship any part of any Customer orderwithin 4 to 6 business days, Seller will cancel the order via e-mail or using the User Interface. There will be nopartial shipments made by Seller unless agreed in a separate written agreement.4. Payment from CASHNA to Seller. CASHNA agrees to pay Seller for all products and services charged byCASHNA as described in this agreement. CASHNA will charge Customers Cashna card upon the completion of theorder and pay amount minus commission and if applicable transaction fees to the Seller. CASHNA will mail ordeliver in any other predetermined way payment to the Seller on the due date. The payment due Seller is equalto the sum of all Customer Charges for products that have been delivered within the specified time period LESS:(i) All disputes, inquiries, and/or refunds processed on account of Sellers Customer Charges during the paymentperiod. (ii) The CASHNA commission fee and any applicable per transaction charges. Sellers Cancellation of theservice. The Seller may cancel this Agreement with 5 days notice given to CASHNA. CASHNA shall terminate thisAgreement and shall no longer charge for Sellers products or services to Customers after notice of cancellation isreceived. Any previous transactions will be paid as scheduled. The Seller is obligated to fulfill or cancel anyCustomer Orders submitted before the cancellation.5. General Terms and Conditions for the service. a. Cash Advances. CASHNA will not make cash advances toanybody. b. Losses by either party. Seller shall not hold CASHNA responsible for any claims, expenses, and lossesthat may have occurred for any reason in connection with the charge of sale of Sellers Product(s) to Customersby CASHNA. This will include the costs and expenses of Customer refunds and/or returns as well as any cost thatmay have occurred during the order fulfillment or after the fulfillment. c. Limits on transactions CASHNA keepsthe right to limit any sale of products or services and to refuse to process transactions to any Customers for anyreason. CASHNA also keeps right to set the limit of the amount that can be charged using CASHNA services.CASHNA keeps the right to put any other limitations on transactions. CASHNA is not responsible for any ofSellers losses, including claims for profit losses. d. Return and Refund Policy. Seller will accept returns, and willagree to refund the Customers who have initiated an inquiry or a complaint either with CASHN and will use itsbest efforts and skills to resolve inquiries and complaints from the Customers side in such a manner that wouldbe acceptable to both Sellers and Customers. CASHNA keeps the right to issue a refund without the consent orknowledge of Seller in any case that it seems appropriate. e. Customer Support. Seller will at anytime be able torespond quickly to all inquiries from the Customers side. In addition, CASHNA keeps the right to bill Sellerreasonable fees and recover its expenses on account of excessive customer inquiries, refunds, or charge backs.Prior to charging such CASHNA will try to make an agreement with the Seller. If CASHNA and Seller are unable toachieve mutually acceptable agreement, Seller will have the option of continuing this Agreement subject to theadditional fees and costs imposed by CASHNA or of terminating this Agreement. f. Other Conditions and Terms.The conditions and terms described on CASHNAs Services and other pages are incorporated into this agreementby referencing them. Seller agrees to do all business activities in accordance with the requirements and rulesdescribed on the Services and other pages. CASHNA keeps the right to refuse to do business with anyone for anyreason.6. Authorization of Regulation. Seller is responsible for all the products/services he/she is selling. Seller mustensure he/she is in compliance with all applicable national, federal, state, and local laws, rules, regulations,requirements and/or other standards established by any governmental authority having jurisdiction to controlsuch activities, including without limitation but only as applicable, the United States Federal Trade Commission, 6Regional Offices: Saudi Arabia, Kuwait, United Arab Emirates, Jordan
  7. 7. and any national, state and local consumer protection agencies, which are in effect prior to the Effective Date ofthis Agreement, or which become effective during the term of this Agreement.7. Taxes and related fees.All parties agree to report and pay its own taxes imposed on its income by any jurisdiction, such as state andfederal income taxes.8. Limitations of Liability. CASHNA assumes no liability for malfunctions of its equipment or software for anyreason, including, but not limited to, vandalism, theft, phone service outages, Internet disruptions, human error,extreme or severe weather conditions or any other causes in the nature of "Acts of God" or any other force.CASHNA shall not be responsible for consequential damages or any other damages under any circumstances. Inno case shall Seller be entitled to recover damages from CASHNA, which exceed the sum of the amounts of salescommissions and service fees retained by CASHNA under this Agreement during the six months prior to eventgiving rise to the claim for damages.9. Indemnification.Seller is completely responsible for the content of its Web site, related pages and for the advertising andpromotion of all of Sellers products. Seller represents to CASHNA that it is the owner or that it has right andauthority to use all information or other property which either forms a part of its Web site, which is provided bySeller to Customers, or which is used by Seller in its advertising and promotion and to sell and deliver products toCustomers. CASHNA assumes no liability of the Seller for anything but commission amount of money involved intransactions. 10. Term. The term of this Agreement shall continue until a notice of cancellation by either party isgiven, or until termination is happened under other provisions of this Agreement. CASHNA reserves the right toterminate this Agreement without cause upon notification to the Seller. CASHNA may further terminate thisAgreement immediately without notice at any time the Seller breaches any part of this Agreement, or if anyprogram or facility used by CASHNA to implement this Agreement is disrupted or terminated for any reason. 11.Default. In the event Seller defaults in any provision or fails to perform pursuant to this Agreement, CASHNAshall be entitled to damages, costs and attorneys fees from the Seller.12. Invalid or Non-enforceable Provisions. The invalidity or non-enforceability of any provision of this Agreement,as so determined by a court of competent jurisdiction, shall not affect the other provisions hereof, and in anysuch occasion this Agreement shall be construed in all respects as if such invalid or non-enforceable provisionwere omitted.13. Choice of Law/Venue.This Agreement shall be construed and enforced in accordance with the laws of Australia. The exclusive venue forany action, dispute or proceeding with respect to this Agreement shall be the courts of Australia, withoutreference to its conflict of law principles. Seller consents to the exclusive jurisdiction of such courts. Headings.The headings in this Agreement are for descriptive purposes only and shall not be used in interpreting,construing, performing or enforcing this Agreement.14. Amendments and Modifications.CASHNA may make amendments or modifications to this Agreement from time to time. Whenever practical,CASHNA will give Seller advance notice of the changes to this Agreement.15 Trademarks., Cashna, and all related logos, products and services described in this website areeither trademarks or registered trademarks of Cashna, or its licensors, may not be copied, imitated or used, inwhole or in part, without the prior written permission of Cashna. In addition, all page headers, custom graphics,button icons, and scripts are service marks, trademarks, and/or trade dress of Cashna and may not be copied,imitated, or used, in whole or in part, without the prior written permission of Cashna.Notwithstanding the above, HTML logos provided by Cashna through its Affiliate Program, Website Paymentsfeatures, may be used without prior written consent for the purpose of directing web traffic to the Service. TheseLogos may not be altered, modified, or changed in any way, or used in a manner that is disparaging to Cashna orthe Service. Logos may not be displayed in any manner that implies sponsorship or endorsement by Cashna.Cashna is a payment service, and no partnership, joint venture, employee-employer or franchiser-franchiseerelationship is intended or created by this Agreement.FEESBUYERCashna is a free card ،you do not have to pay any issue fees ،in most of the cases we do not charge you whenyou make a purchase ،the only time you will be charged is when you make a transfer between 2 Cashna cards.When making a Cashna payment ،we do not take it for granted that you have received the goods ،most of thetime ،we wait for your reply and approval for releasing the payment to the seller ،the system is easy but fair forthe Buyer and Seller ،we do investigate conflicts and follow up complains arising by both parties. 7Regional Offices: Saudi Arabia, Kuwait, United Arab Emirates, Jordan
  8. 8. SELLERIssuing a Cashna Seller card is totally free ،you are charged only when a transaction is successful. Cashna is aflexible payment system ،charges per transaction will be discussed and agreed upon between Cashna and theSeller ،Cashna also comes with a fair refund system ،Sellers can refund users at anytime they feel necessary ،each step is logged and documented to make it easy for everyone to trace any dispute. The charges pertransaction can be fixed ،percentage or both ،and will be set upon agreement.Privacy Statement1. All information collected on a site owned or operated by Cashna is kept strictly confidential. At no time is thisinformation ever given, sold or traded to any other group or individuals.2. Cashna will do everything possible to safeguard the information collected on its web sites and keep it frombeing accessed by unauthorized persons.3. Cashna may, from time to time, release general demographic information about its clients and/or visitors toadvertisers or potential investors. Such information will be statistical in nature about broad categories of visitorsand will never contain specific information about any individual user.4.
