Lockout

  1. 1. A LOCKOUT MEANS – •Temporary closing of a place of employment •Suspension of work •Refusal by an employer to continue to employ any number of persons employed by him . •It means the closure of the place of business & not closure of business itself. •Lockout is usually used by the employer as a weapon in his hand .

Following lockouts are prohibition which is done – 1)Without giving notice in prescribed manner, within 6 weeks before locking out . 2) within 14 days of giving such notice . 3) 7 days after the conciliation of proceedings . 4) If employer gives notice of lockout then within 5 days of that date report to the appropriate government or authority of appropriate government the number of notice given on that day .
  3. 3. Penalty for illegal lock-outs An illegal lockout is punishable for a term extending to 1 month or with fine up to Rs 1000 or with both. Penalty instigation of illegal lock- out An illegal lockout is punishable with imprisonment for a term which may extend to 6 months or a fine up to Rs.1000 or with both.
