This is a Policy Primer for online photo sharing service, Flickr. Examines some of the terms of services and privacy policies that we so easily overlook when signing up. A Net303 assignment for BA(Internet Communications) @ Curtin.

    You have presented a very clear and concise outline of the Flickr TOS. I like your use of the Flickr home page as a background for your presentation, as well as the various screenshots of the TOS. I particularly like how you begin your presentation with Flickr’s “About” page (Flickr 2013), as it omits essential privacy and copyright policy that would deter users from site.

    Throughout your presentation, I was able to draw several parallels between the TOS of YouTube, which I have outlined in my primer, and the TOS of Flickr. Specifically, user acknowledgment of the TOS as outlined in slide 4 (Moo Dean 2013), is not required by either service, simply the use of the service is taken as consent to the various conditions outlined.

    Also, as slide #8 notes (Moo Dean 2013), Flickr is owned by Yahoo, as YouTube is owned by Google (Wright 2013). This means that by using either service, you are feeding your personal information to larger companies that use it for advertising and product improvement. This is also the case with Instagram which is now owned by Facebook (Paine 2013). This causes great concern, as the user is lead to believe that their accounts and actions are private unless they license otherwise as you depict on slide #9 (Moo Dean 2013).

    I have noticed common themes of privacy violation, and copyright circumvention are prevalent throughout the Policy Primers, and Flickr appears to be no different. It is amazing that with user generated content, these services are able to circumvent copyright and use your works in any way they want - I bet this does not feature within their “About” section though!

    Thank you for presenting this information about Flickr, it has certainly made me second guess my activities within the site.

  2. 2. What is flickr • an online space that offers you up to 1 Terabyte of free space for your photographs. calculated to be 436,906 photos taken at 8 megapixels (camera resolution of iphone5S and iphone5C)
  3. 3. What is flickr Flickr wants to help you make your photos available to the people who matter to you AND Enable new ways of organising photos and videos ?? Is there a catch somewhere ??
  4. 4. Signing up • It is a simple process • There isn’t even a check box for you to tick if you agree with the terms and privacy policy. • It is assumed you agree when you sign up.
  5. 5. Terms of Services (TOS) • Flickr is a service offered by Yahoo! - Let’s take a look at some portions of the TOS as stipulated by Yahoo! • And you have to be prepared to live without the service if you do not agree with any of it.
  6. 6. Do you know….. • One is subject to the TOS as long as the services are utilized, whether or not an account with Yahoo is created. • The TOS may be updated at the discretion of Yahoo at any time and continued use of services is equated as acceptance of the new terms. • The user has the responsibility to understand the most current TOS at all times.

The user is obliged to… a) Provide true, accurate, current and complete information about himself. b) Be solely responsible for the content uploaded, posted, transmitted or otherwise made available via Yahoo! c) Agree to conduct himself in an appropriate manner as indicated through 18 guidelines, which were meant to help provide a safe and lawful environment for users. d) Comply with all local rules regarding online conduct and acceptable content (obeying the law of the land). If Yahoo! suspects any information is untrue or inaccurate, they reserve the right to suspend or terminate the account.

On the topic of Privacy, Yahoo!... 1. collects personal information when and combine that with information they obtain from business partners or other companies. 2. receives and records information from the computer and browser, including the IP address, Yahoo! cookie information, software and hardware attributes and the page requested for. They reserve the right to use the information for advertising purposes. “..when you register with Yahoo! and sign in to our services, you are not anonymous to us.” - Yahoo!
  9. 9. Copyright issues Users have to decide what license to give their photos upon upload.
  10. 10. Copyright issues If one believes his intellectual property has been infringed, Yahoo! proposes for the parties to resolve it amongst themselves. Should that fail, they have legal mechanisms which may result in the guilty accounts in being disabled or terminated.
  11. 11. With regards to photos submitted… You give Yahoo! worldwide, royaltyfree, transferable and non-exclusive license to use, distribute, reproduce, modify, publish, broadcast, adapt, publicly perform and publicly display such Content on the Service. which means They can use your photos for free for their own purposes in line with their terms. NOTE: This is slightly different from the TOS of Facebook, Instagram and Twitter woth regards to media posted on their sites.
