  1. 1. John Jones Addendum C Summons #: 123456789-0 The original judge made mistakes of law and fact when reaching her guilty verdict. The verdict should be reversed. I raised the following defenses at my original hearing: "Dear Honorable Judge, I hereby certify as follows: I plead not guilty to this parking violation because: 1. My NJ inspection sticker was attached to my car’s windshield on the date/time this ticket was issued 2. My NJ inspection sticker was still valid on the date/time this ticket was issued 3. The TEA did not enter the date of expiration and inspection sticker number on this parking ticket I moved to NYC (123 West 78 Street) from NJ in January 2016 and registered my car in NY on March 11, 2016. My NJ inspection sticker expired in July 2019 and was attached to the windshield of my Smart car on the date/time this parking ticket was issued. I did not violate Rule 4-08(j)(6) because NY DMV regulations permit one year or until an inspection sticker expired (whichever date comes first) to remove an out-of-state inspection sticker and have a car inspected in NY. I complied with this regulation Due to these circumstances, please dismiss this parking ticket. Thank you. -I hereby certify that my testimony is the truth to the best of my knowledge.I fully understand that if my testimony is willfully false, I am subject to punishment. -I hereby certify that the photographs, documents, and images contained in the exhibits are true and accurate reproductions of the originals as they existed on the date/time this parking ticket was issued -I hereby certify that my NJ inspection sticker was attached to my windshield on the date/time this ticket was issued" Respectfully submitted, John Jones 1
  2. 2. John Jones Addendum C Summons #: 123456789-0 The original judge found me guilty because: "There is no documentation indicating when that NY inspection was performed. This is not a persuasive defense. It appears from this evidence that the inspection sticker was missing after the windshield repair, as indicated on the summons and the car was re- inspected after the summons was issued. Sustained" Argument The original judge exhibited a bias in favor of the respondent by her failure to engage in a thoughtful, fair-minded weighing of all the certified evidence and defenses I raised. Further, the original judge did not apply the applicable law to the facts. I was charged with failure to display a current New York State inspection sticker on my car (See, Exhibit 1, the parking ticket containing the TEA's reference to "Inspection sticker missing NYS" on the parking ticket). However, according to NY DMV regulations my NJ inspection sticker was valid for one year after my car was registered in NY State or until the inspection sticker expired (whichever date comes first). I complied with this regulation because I registered my car in NY State on March 11, 2016 (See, Exhibit 3, my NY State registration). 2

(See, Young v City of New York Dept. of Fin. Parking Violations Adjudications 2007 NY Slip Op 51460(U) [16 Misc 3d 1117(A)] Decided on June 13, 2007 Supreme Court, New York County Goodman) The original judge: • Based her opinion on a mistake that I was required to have a current NY State inspection sticker on my winshield on the date/time this parking ticket was issued. • Mistakingly found my evidence unpersuasive because I did not document when my NY State inspection was performed, which was not relevant to my guilt or innocence since my current NJ inspection sticker was affixed and valid In the interest of justice, please right this wrong and dismiss the parking ticket.
