In addition, process serving audits and compliance are being mandated by clients in the financial sector. The NYC DCA Electronic Device Rule As of November 12, 2011, process servers must carry and operate an electronic device that records Global Positioning System (GPS) location while serving process. ! • Process servers must use a mobile device to log serves, making an electronic record of the date, time, and location where process is served using GPS. ! • The device must transmit a completed record automatically to an independent third party contractor software provider. ! • The third party contractor must store the electronic records for seven years without allowing access for the process server to alter the original records. The contractor must also make the electronic records available to DCA upon request.

ServeManager Compliance • The mobile version of ServeManager can be used on any smartphone, including iPhones and Android devices. ! • The mobile version of ServeManager uses GPS technology to log coordinates of attempts. ! • When logging an attempt, ServeManager automatically uses GPS technology to log the date, time, and location of the service attempt. Rule: The device must make an electronic record of the date, time, and location of where process is served or attempted to be served using GPS technology.

ServeManager Compliance • ServeManager is an independent, third party software provider unaffiliated with any process serving firm, client, or government agency. ! • Any time a service attempt is logged, a completed record of the service attempt is automatically transmitted and recorded in ServeManager. Rule: The device must transmit a completed record automatically to an independent third party contractor.

ServeManager Compliance • ServeManager stores electronic records beyond the minimum 7 year requirement. ! • Process servers cannot alter the original records as logged in ServeManager. ! • ServeManager has provided, and will continue to provide electronic records to the DCA when requested. Rule: The contractor must store electronic records for seven years without allowing access for the process server to alter the original records. The contractor must also make the electronic records available to DCA upon request.
