Administered by the Department of Homeland Security’s United States Citizenship and Immigration Services (USCIS), the EB-5 program allows foreign entrepreneurs to establish permanent residence in the United States if they make a significant financial investment in a US-based company and create or preserve 10 permanent, full-time US jobs. Regional EB-5 centers facilitate the entire EB-5 investment approval process.
  3. 3.  Most EB-5 investments follow one of two structures. The most basic follows a single-tier configuration in which a regional center or an affiliate of a regional center serves as the enterprise’s managing member. The two-tiered EB-5 investment structure offers investors protections and certainties that the single-tier structure cannot accommodate. The typical two-tiered structure involves foreign investors who invest in a new business entity, which, in turn, uses that capital to make a secured, collateralized loan to the operating company.
