2. What are sexual offences?
• The law in India(as of now) permits only
heterosexual natural sexual intercourse(i.e. penile-vaginal
intercourse) between man & wife.
• A sexual offence is therefore defined as any form of
sexual intercourse which departs from this norm &
is consequently contrary to law.
OR
3. • Sexual intercourse or sex related acts performed in
a way which are against the provision of law of the
land.
• With the landmark decision of the Delhi High
Court(2nd July 2009) permitting also consensual
homosexual acts in private between adults(over the
age of 18 years).
6. RAPE
• The word “rape” is derived from a Latin term
“Rapio”-which means “to seize”.
• Slightest penetration of the penis within the
vulva, such as the minimal passage of glans
between the labia with or without emission of
semen or rupture of hymen constitutes rape.
• “The ravishment of a woman without her
consent by force , fear or fraud”.
7. • Section 375 I.P.C.-Rape
• As passed by Lok Sabha on 19th March, 2013
A man is said to commit “rape” if he-
• (a) penetrates his penis, to any extent, into the
vagina, mouth, urethra or anus of a woman or
makes her to do so with him or any other person; or
• (b) inserts, to any extent, any object or a part of the
body, not being the penis, into the vagina, the
urethra or anus of a woman or makes her to do so
with him or any other person; or
8. • (c) manipulates any part of the body of a woman so
as to cause penetration into the vagina, urethra,
anus or any part of body of such woman or makes
her to do so with him or any other person; or
• (d) applies his mouth to the vagina, anus, urethra of
a woman or makes her to do so with him or any
other person,
9. under the circumstances falling under any of the
following seven descriptions:—
i. Against her will.
ii. Without her consent.
iii. With her consent, when her consent has been
obtained by putting her or any person in whom
she is interested, in fear of death or of hurt.
10. iv. With her consent, when the man knows that he is
not her husband and that she has given consent
because she believes that he is another man to
whom she is lawfully married,
v. With her consent, when at the time of giving such
consent, by reason of unsoundness of mind or
intoxication or the administration of any
stupefying substance, she is unable to understand
the nature and consequences of that to which she
gives consent,
11. vi. With or without her consent, when she is
under 18 years of age,
vii. When she is unable to communicate consent
12. • Explanation 1.—For the purposes of this section,
"vagina" shall also include labia majora.
• Explanation 2.—Consent means an unequivocal
voluntary agreement when the woman by words,
gestures or any form of verbal or non-verbal
communication, communicates willingness to
participate in the specific sexual act.
13. • Exception 1:A medical procedure or intervention
shall not constitute rape.
• Exception 2:Sexual intercourse or sexual acts by a
man with his own wife, the wife not being under 15
years of age, is not a rape.
14. Manipur State amendment
• To rape, law has reduced the ages of valid
consent to sexual intercourse by unmarried &
married females to 14 & 13 years respectively.
15. I.P.C. Sec.376-Punishment for Rape
• Whoever, commits rape, shall be punished
with rigorous imprisonment of either
description for a term which shall not be less
than seven years, but which may extend to
imprisonment for life, and shall also be liable
to fine.
16. • Statutory Rape:
It is sexual intercourse with a girl below 16 years of
age even with her consent.
• Date Rape:
It is unlawful sexual intercourse with a woman,
who is given a drink containing a sedative drug like
GHB, robypnol, cocaine, etc. in a party without her
knowledge.
17. • Marital Rape:
It is forceful sexual intercourse with wife who is
living separately from him under a decree of
separation or any custom or usage without her
consent, and is punishable with 2 years of
imprisonment
• Gang Rape or group rape:
It occurs when a group of people participate in the
rape of a single victim.
18. Unnatural Sexual Offences
• Voluntary sexual intercourse against the order of
nature with any man, or woman, or animal.
• I.P.C. Section 377
• Punishable with imprisonment for life or upto 10
years and also with fine.
19. Sodomy
• The anal intercourse between 2 males, or
between a male and female.
Buccal Coitus
• The male organ is introduced into the mouth,
usually of a young child/woman.
26. Sadism
• Sexual gratification is obtained or increased from
acts of physical cruelty or causing of pain upon
one’s partner.
27. Lust Murder
• In extreme cases of sadism, murder serves as
a stimulus for the sexual act and becomes
equivalent to coitus, the act being
accompanied by erection, ejaculation, and
orgasm.
28. Necrophagia
• Extreme degree of sadism in which person
after mutilating the body sucks or licks the
wound, bites the skin, drinks the blood, and
eats the flesh of his victim to derive sexual
pleasure.
30. Masochism
• Opposite of Sadism.
• Here sexual gratification is obtained or increased by
suffering pain.
• Sadism + Masochism = Bondage
31. Fetichism
• Fetish- abnormal stimulus or objects of sexual
desire
• Person experiences sexual excitement leading
to orgasm, from part of the body of a woman
or some article belonging to her.
• Exclusively seen in males.
32. Trasvestism /Eonism
• Usually found in males who obtain sexual
pleasure by wearing female dress.
36. Troilism
• A perverted husband gets sexual satisfaction
by inducing his wife in sexual intercourse with
another man and by watching the same.
37. UNDINISM
• Sexual pleasure is obtained by witnessing the act of
urination by the same or opposite sex.
Bobbit Syndrome
Perversion in which the female partner amputates
the penis of her male partner with a sharp-cutting
weapon.
