The document is a request and undertaking letter from a consignee to a shipping company to change the status of containers from CY-CY (container yard to container yard) to CY-CFS (container yard to container freight station) for destuffing at the consignee's risk and cost. Dear Sir,
We confirm that we are the consignees and the owner of the cargo and / or person
entitled to take delivery of the cargo brought to Pakistan through GreenPak Shipping (Pvt) Limited As agents of
Evergreen Line . We hereby give our irrevocable undertaking to you as under:-
1- We hereby request your good company that the said containers to be de-stuffed and their CONTENT handed
over into the custody ofthe destuffing shed at our risk and cost.
2- We undertake to pay any/all extra additional costs that may accrue for de-stuffing of this shipment due to any
leaking / wet / stained /soaked / abnormal / obnoxious content of the containers.
3- We hereby agree and undertake to pay incurred damage / cleaning charges as well as line detention in case
Delivery of goods taken as CFS.
4- We undertake that we or anybody on our behalf or underwriters will not refer any claim against you / Line /
Carrier for any shortage(s)damage(s) to the content of these containers.
5- We also hold ourselves responsible for any Customs Penalty imposed by the Pakistan Customs or any other
authority for the short / excess landed packages shown by the K.P.T in their outturn reports.
6- We the Consignee hereby agrees and undertakes that if any damage/s is caused to the container(s) at the time
of de-stuffing the Cargo from the Container in the Container Freight Station, we the Consignee shall pay the
repair/ replacement costs towards damage/s as estimated by the Company surveyors and immediately on
demand make payment of such charges towards repairs and/ or replacement without any protest whatsoever as
demand.
7- However, in order to secure the payment and in terms of guarantee towards the said payment, we the
Consignee shall hand over a security deposit pay order drawn in the name of GreenPak Shipping (Pvt) Limited
under an implicit understanding that upon the first communication demanding payment of the repair/
replacement charges,if the Consignee and/ or their Agents either fails/ refuses/ denies to pay the said repair/
replacement charges , the Consignee authorizes the GreenPak Shipping (Pvt) Limited to deposit the said Pay
order handed over to the GreenPak Shipping (Pvt) Limited and deducting the amount towards repairs/
replacement.
8- We understand that the terms of the contract from Cy/CY to CY/CFS are being changed on our request for our
convenience and we agree to pay said costs on demand and hold shipping line harmless from all costs and
consequences.
9- We request you to accept our request for change of status,and we will provide all documents OBL and all
dues within 3 days of vesselarrival. In case we fail to provide said document & dues all cost and
consequences will be on our account.
