ACCEPTANCE: You accept the Agreement and Terms when you do any of the following: (a) place an order with us on paper, orally, or electronically; (b) tell us orally or electronically that you accept; (c) attempt to use our Services (including, without limitation, attempting to place a call on the Network or off the Network when roaming, including “911” or similar calls); (d) pay for the Services; (e) open any package or start any program that says you are accepting the Agreement when doing so; and (f) use your service after making any change or addition after you have been informed that continued use of the new or modified service will mean you have given us your acceptance. 2. AGE REQUIREMENT: You must be at least eighteen (18) years of age to subscribe to this Service. 3. SHIPPING: There is an $11.99 minimum shipping and handling charge per order. Shipping rates vary for Hawaii and Puerto Rico. 4. SERVICE: Tempo Wireless charges for all services at the time in which they are ordered. Packages have an Access Period of thirty (30) days with a 10-day grace period in which to renew or purchase a new 30 Day Access Package. At the end of the 10-Day grace period, if you have not renewed your Package, your Wireless telephone number will be disconnected, your number will be lost, and you will lose any unused minutes remaining. Should you run out of minutes during your 30 Day Access Period, you may purchase a new 30 Day Access Package. 5. COVERAGE AND NETWORK: Tempo Wireless’s Prepaid Service coverage will be at least 50% of any ZIP code before that Zip Code will be shown as serviceable area. Service is available in Hawaii and Puerto Rico on on Lightyear’s Prepaid Service network. Alaska is not available. In order to place a call, you must be on Tempo Wireless’s Prepaid Service Network. There is no reimbursement for a dropped call. Roaming is available only on select plans. 6. SERVICE LIMITATIONS: On non-Unlimitd plans, all minutes are considered in-plan minutes on Tempo Wireless’s Prepaid WIreless Service. Phone numbers cannot be transferred to another party. 7. INTERNATIONAL: All calls using 011 are blocked, except for calls utilizing Tempo Wireless’s International VoIP calling card. All calls outside the domestic United States, Hawaii, Puerto Rico, Canadam the Caribbean, and other areas on the North American Dial Package (1+ area code+number), are also blocked. 8. OTHER CHARGES: There is a $19.99 Activation Fee on service where customer still has a phone, but has allowed their number to be disconnected. Customer must order a new 30 Day Voice Access Package within fourteen (14) days of purchase by calling us toll free at 888-589-7957 from any phone. At that time, you will be given instructions on how and where to ship your phone. If your voice package has not been activated, Tempo Wireless will refund the full amount initially paid for that Service. There will be no refund in your Voice Package has been activated. There is n refund of the shipping charges. Lightyear will refund the full amount you paid for the phone less a $30.00 restocking fee. Equipment returned that is damaged or does not include all components (device, battery, charger, manual and software) will not receive a refund. Equipment received through and insurance claim cannot be returned or exchanged under this policy. Separately purchased accessories are not returnable. 10. SERVICE ADDRESS INFORMATION: You must notify Tempo Wireless of any change whatsoever with reference to your service address. 11. PAYMENT INFORMATION: Tempo Wireless offers recurring automated payment of your account by using your credit/debit cad (“Card”). The company will charge your Card periodically based on your products and services as billed by the Company. All services considered as advanced payment or prepaid will be charged to your card immediately upon renewal or at the time the service or product is added to your account. Payments due on the same day the agreement is received may not be processed automatically and may re- quire that you contact the Payment Center directly to ensure continuation or your services. You may discontinue this program at anytime, or change the Card to be used. You must contact the Tempo Wireless Payment Center by calling (888) 589-7957 to advise us that you wish to change or cancel this automated payment plan. In the event that a charge to your Card is not approved, your services may be in- terrupted or not renewed dependent on the terms of your service agreement. In addition, if any charge to your Card is not approved your account will be removed from the automatic payment program. The automated payment program will terminate upon the expiration date of the credit/debit Card listed below. It is your responsibility to ensure that a renewal form be completed and signed whenever you are issued a replacement Card or you wish to change the Card in use in ordere to continue this service. Please contact the Payment Center at (888) 589-7957 to advise Tempo Wireless that you have a new Card and arrange to update your information. 12. DEBT COLLECTION: You will be liable to Tempo Wireless for any fee Lightyear incurs in its attempt to collect this debt including, but not limited to attorney’s fees, court costs, etc. 13: TRADEMARK AND COPYRIGHT USE: Use of any Tempo Wireless trademarks or copyrights is strictly prohibited. 14. DISPUTES: Disputes must be sent to Tempo Wireless in writing within fifteen (15) days of purchase. 15. WARRANTY & CONDITIONS OF SERVICE: These Terms and Conditions are governed by the laws of the Commonwealth of Kentucky and are subject to change at Lightyear’s discretion.
