If the material or product is not immediately replaceable, the relevant labor unit will be replaced by another capable of fulfilling the same role, but equipped with different products relevant to its own trade that comparatively achieve the equivalent purpose of the former. A construction union today, whose basket of specialized materials includes environmentally harmful products, faces the same risk of obsoleteness. It follows that the ratification of an environmental regulation outlawing a certain product, or litigation outcome rendering the handling of a construction material as detrimental to human health, can extinguish an entire construction union. A knowing receipt claim arise when that stranger directly or indirectly receives for his own benefit trust property transferred in breach of trust, in certain circumstances where he is enriched, without justification, at the expense of the beneficiaries, at any rate to the extent that he did not give value for what he received. If not, how did the Plaintiffs fail to prove breach? According to Merriam Webster, a breach is defined as a failure to act in a promised or required way. As mentioned, these nurses knew their responsibilities of working with sick individuals upon beginning work at a facility and likely before going to college to complete a degree in nursing. It is a requirement of the nurses to care for patients due to it being their job description and the reasoning for why they were hired at PHS. I am unaware of how many staff members of PHS are nurses, however, if three are refusing an assignment, it is likely that the hospital procedures for caring for patients was jeopardized. After all, if the hospital was short–staffed, it was likely that each patient wasn't getting the adequate care that they needed. 3. Were any injuries suffered? If so, who? Then you must identify what type of organization you will be. In order to qualify for this bidding your organization must be a non–profit. Your group must file its articles of incorporations which is a legal document that is filed with the Secretary of State or Attorney General's office. This document includes your museum's name, broad purposes, and location. Next you must obtain a federal tax identification number, file for 501c3 (tax exempt status) with the IRS, and finally file for local and state tax exempt. In the District of Columbia, the guidelines for a non– profit are that it determines a mission, create a concept paper, and determine your organization type (which is 501c3). The general requirement to create a trust is that if the trust is properly constituted, it bind the settlor and be enforceable by the beneficiaries. On the other hand, if the trust is not completely constituted, it will be ineffective as the general rule requires. Equity will not be able to help because of two of its maxims "equity will not assist a volunteer" and "equity will not perfect the imperfect gift" . The court will be prevented from coming to the aid of a volunteer beneficiary regardless of how undesirable the outcome might appear. i. An express trust is created if only the settlor can show that he intended to subject the property to a trust obligation. It is necessary for the settlor to show that he intend to create a trust instead of some other type of legal relationship, e.g. gift, a power or bailment. • 48. Explanation of Secret Trusts: Where they Arise and How... Secret trusts arise where a testator explains to X that they want property to be held on trust for Y and then leaves the property to X in their Will. It is also possible that a secret trust arises where in reliance on a promise to implement the trust by X, no Will is made (Strickland v Aldridge 1804 9 Ves 516 REF1). The onus of proving a secret trust is on the person claiming that it exists, on the balance of probabilities – the 'ordinary civil standard of proof' (Re Snowden 1979 3 All ER 172 REF2). There are three elements necessary for a secret trust (Ottaway v Norman (1971) 3 All ER 1325 REF3). Intention The Testator must intend that the property be used in accordance with a direction. This must be intended as a binding obligation on ... Show more content on Helpwriting.net ... Pearce and Stevens argue that the trust is 'incompletely constituted' until the death of the testator. The agreement and acceptance to hold the property on trust take place inter vivos but the trust comes into effect when on death, the Will transfers legal title to the trustee (Pearce & Stevens, Reading 14, REF15). Whilst this is a strong argument, the formalities requiring half secret trusts to be communicated and accepted prior to the execution of the Will so as not to ignore the Wills Act, seems inconsistent with the view that secret trusts operate outside the provisions of the Wills Act entirely. Are secret trusts necessary to prevent fraud? The allowance of secret trusts avoiding the requirements of the Wills Act is said to be made to prevent fraud. A trustee agrees to hold property on trust and a gift is made to him on that basis (Re Boyes, REF5). To plead absence of the Wills Act formalities as a defence and thus claim the gift is outright, would be to use statute as an instrument of fraud, and would be against the equitable maxim. Maudsley disagrees, pointing out that with a half secret trust, fraud is rarely an issue as the trust is apparent from the Will and there is no possibility that the legatee can keep the Property (although the intended beneficiary may not get it where terms are not clear) – (Maudsley, pg. 116 REF 16). Case Study Essay | | The main purpose or mission of the Greenhill Community Center was to provide human service programs for learning, growth, and enrichment throughout life within an intergenerational setting. The mission seems to fill the need in the demographical setting of the location. The center is located in one of the poorest cities on the East Coast. In the textbook it states a mission as being "the reason an organization exists, and it must be the starting point for its planning." (Worth, p.172) The mission of the center is very sound, but in the process of hiring a new director, I think the mission focus was lost. The board wanted the new Executive Director to advance the organization in the future by turning the Center into more of a business–like operation instead of a family run business atmosphere. Within this organizational structure, the Executive Director's role had more responsibilities than it should, while the board members role was very inept. Traditionally, the role of fundraising consists of the board providing their own gifts and actively engaging in the act. (Worth, p.71) The fundraising attempts before the new Director arrived were done on an as–needed basis and then it only accrued for 20% of the annual funding. The lack of funding could lead to salaries not being paid and the budget not being balanced. The two most pressing issues that Greenhill Community Center Face are communication and fundraising. The most important thing in organizational structure is communication. John Carver, created a governance model back in 1997, said there were four areas that policy development should be based on and maintained for a board to lead. One of the areas is Board–Staff relationships. Carter stated that to clearly address common concerns about board members evaluating the CEO is to communicate directly with the staff or volunteers within the organization. An article entitled Understanding Your School Board states that "school boards are entrusted by the public to translate the needs of students into policies, plans, and goals that will be supported by the community" (www.tasb.org). In other words, the board and its members are responsible for making and enforcing essential decisions for the school district. SHORT ANSWER Form M does not provide all of the required language needed to allow a trust to qualify for domestic trust treatment. It is missing two important portions of language needed to allow it to fulfill the qualification requirements contained in section 2056A and its accompanying regulations. Board of Trustees of Carson–Tahoe Hospital (1972) In many ways, the hospital system in America is set up mirroring our government. They are similar in the way that checks and balances have been set in place to ensure the best possible care is delivered to patients. With these checks and balances there are three main bodies; the governing board, medical staff, and executive management (Showalter, 2017). The duties and responsibilities of each body many times is to oversee and continually check the others. A prime example of this system can be seen through the case of Moore v. The Board of Trustees of Carson–Tahoe Hospital, which took place in Nevada and was heard before the Supreme Court of the state in 1972 (Moore v. Board of Trustees of Carson–Tahoe Hospital, 1972). Specifically, in this case, the duty of the governing board to "exercise reasonable care in selecting and retaining medical staff" is questioned in contrast with the right of the physician to have "due process... when disciplinary action is taken" (Showalter, 2017). In hopes of changing a decision by the governing board, and attempting to reverse the decision of a lower court, the appellant, Dr. Moore, brought the case against Carson– Tahoe Hospital (Moore v. Board of Trustees of Carson–Tahoe Hospital, 1972). In the summer of 1969 Dr. Moore, a board–certified obstetrics and gynecology doctor, administered a spinal anesthetic to a patient (Showalter, 2017). However, Dr. Moore did not follow the typical ... In order to understand the High Court's unwillingness, this essay will examine and discuss the established categories of fiduciary relationships, fiduciary relations outside of the established categories and the nature of fiduciary obligations in terms of prohibitive (negative) and prescriptive (positive) duties and existing common law duties. However, when one considers the primary role of a doctor, it seems much more suitable to describe their duty as relating to 'the exercise of reasonable care and skill in the provision of professional advice and treatment'. At first glance, it is easy to see how even this could be perceived to be fiduciary in nature, whereby patients often confide in and depend on their doctor who they believe will act in their best interests. Even so, there is a major difference between the doctor–patient relationship and the established fiduciary relationships. In established fiduciary relationships the fiduciary acts like 'a representative character in the exercise of his responsibility'. When considering the role of doctors generally, it cannot be said that the role of doctors is to act as the representatives of their patients. As such, the High Court in Breen v Williams determined that it would not impose fiduciary obligations between doctor and patient since traditionally there was no such established relationship in Australian law. B Fiduciary Relations Outside the Established Categories In spite of this, it should be noted that 'the categories of fiduciary relationship are not closed' and the courts' powers may be extended, so as to be able to find a fiduciary relationship outside the established categories. The finding of a fiduciary relationship in such circumstances will be based on the factual

Mistrust is so rampant in our society that it is big business and people are enamored by tales of broken trust. I have already mentioned the TV show "Cheaters".
