5. O IGPLAN - INSTITUTO DE GESTÃO E PLANEJAMENTO DE ESTADO
é uma associação civil de direito privado, com sede no município
de Barreiras-BA, que tem como primeira finalidade em seu
Estatuto Social, Art. 3º:
“cooperação com órgãos e entidades ligados ao poder
público no planejamento, na aplicação de recursos, na
implantação de políticas públicas e na promoção de
atividades de pesquisa, educação, desenvolvimento
institucionais e de transparência
administrativa, compreendendo como desenvolvimento
institucional os programas, as ações, os projetos e as
atividades, inclusive de natureza infra-estrutural, que
levem à melhoria das condições do poder público para o
cumprimento da sua missão institucional e atividades

6. Diante das inúmeras dificuldades encontradas pela
grande maioria dos gestores municipais, principalmente dos
municípios de menor porte, quanto ao suporte de equipes
técnicas especializadas que lhes auxiliem na
elaboração, desenvolvimento e acompanhamento de
projetos técnicos, visando à melhoria da infra-estrutura
de seus municípios e da qualidade de vida de seus
munícipes, ainda se deparam frente à burocracia na solicitação
de recursos federais e/ou de instituições financeiras
internacionais, diante dos inúmeros projetos que são pleiteados
e seqüencialmente negados.

IGPLAN, apresenta neste material informações sobre o

11. A função do Diagnóstico Sócio-Econômico, é
que além de ser uma ferramenta indispensável às
prefeituras, representa um valioso subsídio para
orientar potenciais investidores, viabilizando novos
empreendimentos na cidade.
Tal conjunto sistematizado de informações funciona
como matéria-prima fundamental para a elaboração
de projetos em que as prefeituras necessitem submeter-se a
diversos órgãos financiadores.

12. De acordo com experiências do IGPLAN um
diagnóstico municipal ou regional deve estar sempre
atualizado, preferencialmente divulgado no site do
município; fonte online onde investidores e órgãos
financiadores fazem suas pesquisas. Comumente este
trabalho é realizado somente quando se desenvolve o Plano
Diretor do Município e depois não é mais atualizado.

17. Cenário atual e desafios
O Brasil vem apresentando ao longo dos últimos anos
uma conscientização e preocupação com a sustentabilidade
ambiental relevantes.
As questões de saneamento e saúde ocupam hoje um
patamar elevado na consciência da população brasileira e
consequentemente de seus representantes políticos, no
executivo e legislativo, se materializando nas recentes
legislações, com destaque para a Política Nacional de
Saneamento Básico (Lei n° 11.445/07) e a Política
Nacional de Resíduos Sólidos (PNRS) (Lei n°
12.305/10).

22. Legislação aplicável
A PNRS foi regulamentada pelo Decreto n° 7.404,
de 2 de agosto de 2010, que instituiu a Política Nacional
de Resíduos Sólidos e criou o Comitê Interministerial da
Política Nacional de Resíduos Sólidos e o Comitê Orientador
para a Implantação dos Sistemas de Logística Reversa; e pelo
Decreto n° 7. 405, de 23 de dezembro de 2010, que
instituiu o Programa Pró-Catador, denominou o Comitê
Interministerial para Inclusão Social e Econômica dos
Catadores de Materiais Reutilizáveis e Recicláveis e o Comitê
Interministerial da Inclusão Social de Catadores de Lixo criado
pelo Decreto de 11 de setembro de 2003, bem como
dispôs sobre sua organização e funcionamento.

23. Legislação aplicável
Por ser de competência dos Municípios a
gestão local dos resíduos sólidos, a PNRS determinou que os
Municípios devem estabelecer seus próprios planos de gestão
de resíduos sólidos, que é denominado PMGIRS - Plano
Municipal de Gestão Integrada de Resíduos
Sólidos, nos quais será contemplado o conteúdo mínimo
descrito na PNRS.
A PNRS também estabeleceu que os Planos
Municipais de Gestão Integrada de Resíduos Sólidos devem
ser compatíveis com a realidade local, e a sua elaboração deve
ser feita até 2 de agosto de 2012.

25. Atores envolvidos
O prefeito e sua estrutura (executiva) têm um
papel fundamental no processo de promover a mudança da
realidade atual, tendo capacidade de envolver todas as partes
interessadas no processo.
As secretarias devem desenvolver programas de
conscientização, valorização e envolvimento da sociedade
civil organizada em torno do tema a fim de consolidar a
vontade social em um movimento forte e coeso, criando o
cenário propício aos ajustes legislativos necessários.

Cabe à Câmara Municipal estar consciente da
responsabilidade ambiental do município e da necessidade
de promoção de um cenário com sustentabilidade financeira
de longo prazo para a gestão de resíduos sólidos, devendo
efetuar a adequação da legislação municipal para
cumprimento pelo município da Política Nacional de Resíduos
Sólidos.

O Ministério do Meio Ambiente, responsável
pela elaboração de políticas, estratégias, planos e programas
nacionais para o controle ambiental, de acordo com a PNRS, é
também responsável pela elaboração do Plano Nacional de
Resíduos Sólidos.
Compete a este o apoio aos municípios que
aplicarão a PNRS, bem como possibilitar políticas positivas
sobre ações dos munícipes.

28. Atores envolvidos
A União, por meio de seus órgãos
competentes, organizará e manterá de forma conjunta o
Sistema Nacional de Informações sobre a Gestão dos
Resíduos Sólidos (Sinir), articulado com o Sistema Nacional de
Informações em Saneamento Básico (Sinisa) e o Sistema
Nacional de Informação sobre Meio Ambiente (Sinima).
Os Municípios têm a obrigação de enviar
periodicamente suas informações.

29. Atores envolvidos
Conforme o objetivo desta apresentação, deve-se
assumir que a primeira premissa para realização desta
mudança de paradigma é a necessidade de atendimento
à PNRS.
Desse modo, a União e o Estado elaborarão planos
com horizonte de atuação para os próximos 20 anos. No
entanto, a não existência dessas diretrizes até o momento não
exime os municípios de elaborarem os Planos Municipais
de Gestão Integrada de Resíduos Sólidos até o prazo
máximo de 2 de agosto de 2012 com uma visão de
sustentabilidade operacional e financeira de longo prazo.

30. Diagnóstico operacional
A estrutura operacional é vista como elemento
essencial para a gestão de resíduos sólidos no município. Tal
estrutura é composta por diversos elementos que viabilizam
a execução dos serviços relacionados à gestão de resíduos
sólidos por meio de uma tecnologia específica ou um conjunto
de tecnologias.
É de suma importância compreender a atual
estrutura operacional dos serviços de limpeza urbana do
município para planejar uma solução operacional sustentável a
longo prazo e que seja adequada à PNRS.

34. Obrigações e penalidades
Serão priorizados no acesso aos recursos da União os
municípios que implantarem:
1. a coleta seletiva com a participação de cooperativas ou
outras formas de associação de catadores de materiais
reutilizáveis e recicláveis formadas por pessoas físicas de baixa
renda;
2. solução consorciada intermunicipal ou participação
voluntária de solução microrregional estabelecida pelo Estado.

35. Obrigações e penalidades
O Poder Executivo do Município é exercido
pelo Prefeito que, dentre outras, possui responsabilidades
sobre a gestão da prestação de serviços públicos de
saúde, educação, abastecimento de água, tratamento do esgoto
e coleta de resíduos sólidos domésticos.
Cumpre esclarecer, ainda, que as penalizações às
quais se submetem os gestores não se encontram
elencadas exclusivamente na Lei Orgânica, submetendo-se os
gestores, também, às penalidades impostas em leis
esparsas, que versem sobre eventuais atos ilícitos
cometidos pelo Prefeito Municipal.

36. Obrigações e penalidades
A negativa de cumprimento dos preceitos
estabelecidos pela PNRS pelo Chefe do Executivo Municipal
poderá ensejar o ajuizamento de demandas judiciais que visem
à reparação dos danos causados por seus atos, e,
também, imponham ao Prefeito Municipal a execução de
medidas que interrompam ou corrijam eventuais danos
causados em função de tal descumprimento.
Poderá, ainda, incorrer em crime de
responsabilidade previsto no Decreto- Lei n° 201/1967,
segundo o qual a negação de execução de lei federal, estadual e
municipal é considerada crime de responsabilidade do prefeito,
que está sujeito a julgamento do Poder Judiciário.

37. Obrigações e penalidades
De acordo com o referido Decreto-Lei, o prefeito que
negar cumprimento à lei federal, estadual ou municipal estará
sujeito à perda de cargo e à inabilitação, pelo prazo de
cinco anos, para o exercício de cargo ou função pública, eletivo
ou de nomeação, sem prejuízo da reparação civil do dano
causado ao patrimônio público ou particular.
Neste mesmo decreto, são consideradas infrações
político administrativas do prefeito municipal, sujeitas ao
julgamento pela Câmara dos Vereadores e sancionadas com a
cassação do mandato.

38. Forma de contratação
Com base no exposto dos trabalhos que devem ser
executados para a execução do Projeto PNRS, propomos
assessoria aos gestores municipais no levantamento e
processamento dos dados coletados no município, para a
elaboração:

39. Forma de contratação
Do PSEM – fonte de informações do perfil do município para
avaliação de potencial pelo ente financeiro;
Do PMGIRS – fonte de informações de diagnóstico local quanto a
situação dos resíduos sólidos do município, que servirá como base para
aporte de recursos financeiros para infra-estrutura física e profissional
necessárias para adequação à PNRS;
Do desenvolvimento, entrada e acompanhamento do Projeto de
Captação de Recursos para o município, nos moldes e padronagem
estabelecidas pelos entes financiadores;
Da contratação dos profissionais necessários para o
desempenho das atividades relacionadas no projeto, aquisição de
máquinas, equipamentos e obras civis que contemplem a implantação
da Usina de Reciclagem ou Estação de Triagem.

40. Forma de contratação
•Prazo de Execução e Conclusão:
Normalmente em 120 dias, dependerá muito da
colaboração dos servidores municipais para o fornecimento
de dados nos diferentes setores e do tamanho do município.

•Investimento das etapas do projeto:
Etapa 1: 1º Contrato; Captação de dados do município
para desenvolvimento PSEM e PMGIRS = R$2,50 por
habitante, para municípios com até 50 mil habitantes ou
R$1,50 por habitante para municípios acima de 50 mil
habitantes, com base no último censo do IBGE. Fonte de
Recursos Prefeitura Municipal, com base na Lei
8.666/93.

42. Forma de contratação
•Investimento das etapas do projeto:
Etapa 2: 2º Contrato; Desenvolvimento do Projeto de
Captação de Recursos conforme padronagem ABNT NBR,
entrada e acompanhamento nas entidades financeiras,
assessoria técnica para contratação de profissionais e
empresas para a implantação da Usina e ou Estação de
Triagem, treinamento dos colaboradores que irão trabalhar
na coleta e reciclagem dos resíduos sólidos. Fonte de
Recursos Instituição Financeira, valor incorporado ao
montante de recursos destinados ao município na fração de
5% (cinco por cento) do valor total liberado (ad-êxito).
