  1. 1. Gender Equality Through Strategic Litigation A project of the American Bar Association Rule of Law Initiative in Tajikistan Made possible through the funding of the U.S. Department of State Bureau of Democracy, Human Rights, and Labor

Short-Term Objectives <ul><li>To increase awareness and access to justice among the rural population in the three selected areas on the laws that protect women and provide for equal treatment; </li></ul><ul><li>To develop a strong cadre of locally based lawyers with the capacity and willingness to represent women in legal cases effectively; and </li></ul><ul><li>To increase the capacity of existing local NGOs to offer legal services to women in rural areas that are currently underserved in provision of legal assistance. </li></ul>
  3. 3. Long-Term Objectives <ul><li>To improve the implementation and enforcement of existing gender equality and protection laws, especially in rural areas; and </li></ul><ul><li>To ensure continued operation of legal services for women in rural regions beyond the life of the project. </li></ul>

Programmatic Elements of the Project <ul><li>Roving Legal Aid Clinics </li></ul><ul><ul><li>180 Consultations at a Minimum </li></ul></ul><ul><li>Legal Representation of Women </li></ul><ul><li>Strategic Litigation Cases Pursued </li></ul><ul><ul><li>At Least Six (6) Such Cases Litigated </li></ul></ul><ul><li>Training of Local Attorneys </li></ul><ul><li>Presentation of Theatrical Production Highlighting Gender Issues </li></ul>

Roving Legal Aid Clinics <ul><li>First two clinics have been conducted with 35 interviewees and over 45 discrete legal issues </li></ul><ul><li>Next clinic, in Faizabad, scheduled next week </li></ul><ul><li>Anticipate a minimum of 180 consultations </li></ul><ul><li>Major issues so far: alimony, divorce, land rights </li></ul>

Legal Representation of Women <ul><li>Legal issues raised by people interviewed at clinics will be analyzed, and factual issues researched </li></ul><ul><li>In appropriate cases, project attorneys will offer pro bono representation to needy rural women </li></ul><ul><li>These will be in addition to the strategic litigation cases </li></ul>
