  2. 2. 9 protected characteristics <ul><li>The equality Act 2010 establishes and defines 9 protected characteristics. These are as follows; </li></ul><ul><ul><li>Age </li></ul></ul><ul><ul><li>Race </li></ul></ul><ul><ul><li>Sex </li></ul></ul><ul><ul><li>Sexual orientation </li></ul></ul><ul><ul><li>Disability </li></ul></ul><ul><ul><li>Marriage and civil partnership </li></ul></ul><ul><ul><li>Gender reassignment </li></ul></ul><ul><ul><li>Religion or belief </li></ul></ul><ul><ul><li>Maternity and pregnancy </li></ul></ul>
  3. 3. Legislative format for protected characteristic definitions <ul><li>The legislation uses the following format for defining protected characteristics. This is in order to specifically relate the definitions to prohibited conduct as defined by the Act. </li></ul><ul><ul><li>defines the protected characteristic where necessary (some are self explanatory) </li></ul></ul><ul><ul><li>defines application of the protected characteristic to the individual </li></ul></ul><ul><ul><li>defines application of the protected characteristic to groups of people </li></ul></ul><ul><ul><li>defines circumstances under which it may be said people share a protected characteristic where necessary </li></ul></ul><ul><ul><li>specific exclusions where relevant </li></ul></ul>

Age <ul><li>Individual; a reference to a person of a particular age group </li></ul><ul><li>Group; a reference to persons of the same age group </li></ul><ul><li>Age group; a reference to persons of a particular age group is a reference to people defined by age, whether this be a particular age or range of ages </li></ul>
  5. 5. Race <ul><li>Race defined; race includes colour, nationality, ethnic or national origins. (Minister also has the power to include caste in this definition). </li></ul><ul><li>Racial group defined; a group of people defined by race. (see above) </li></ul><ul><li>Individual; a reference to a person of a particular racial group </li></ul><ul><li>Group; a reference to people of the same racial group </li></ul>

Religion or Belief <ul><li>Religion defined; any religion also includes a lack of religion </li></ul><ul><li>Belief defined; any religion or philosophical belief also includes a lack of religion or philosophical belief </li></ul><ul><li>Individual; a reference to a person of a particular religion or philosophical belief </li></ul><ul><li>Group; a reference to people with a particular religion and or philosophical belif </li></ul>
  7. 7. Sex <ul><li>Sex Defined; Self explanatory </li></ul><ul><li>Individual; a reference to a person of a particular gender </li></ul><ul><li>Group; a reference to people who share the same gender </li></ul>

Sexual orientation <ul><li>Sexual orientation defined; a person’s orientation to people of the same sex, opposite sex or either sex </li></ul><ul><li>Individual; a reference to a person of a particular sexual orientation. </li></ul><ul><li>Group; a reference to people of the same sexual orientation </li></ul>

Marriage and civil partnership <ul><li>Marriage and civil partnership defined; as defined by UK Legislation </li></ul><ul><li>Individual; a reference to a person who is in a marriage or a civil partnership </li></ul><ul><li>Group; a reference to people who are married or in a civil partnership </li></ul>

Maternity and pregnancy <ul><li>Maternity and pregnancy defined; the protected period in relation to a womans pregnancy is from when the pregnancy begins and ends this includes, statutory and additional maternity leave. or when the woman returns to work (if earlier) </li></ul><ul><li>Individual; a reference to a pregnant woman within the protected period. </li></ul><ul><li>Group; a reference to pregnant women within the protected period. </li></ul>

Gender reassignment <ul><li>Gender reassignment defined; if the person is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning the person’s sex by changing physiological or other attributes of sex. </li></ul><ul><li>Transexual defined; a reference to a transsexual person is reference to a person with the protected characteristic of gender reassignment. </li></ul><ul><li>Individual; a reference to a person who is transsexual </li></ul><ul><li>Group; a reference to people who are transsexual </li></ul>

Disability <ul><li>Disability defined; a physical or mental impairment, and the impairment has a substantial and long-term adverse effect on ones ability to carry out normal day-to-day activities. </li></ul><ul><li>Individual; a reference to a disabled person is a reference to a person who has a disability </li></ul><ul><li>Group ; a reference to disabled people is a reference to people who have the same disability </li></ul><ul><li>NB this includes people who have had a disability. People who have had a disability may be considered to have the disability for the purposes of the act. </li></ul>
