  2. 2. Who Can Get a Security Clearance To obtain a security clearance you must be sponsored by a government agency for a position which requires access to classified information. You must be a U.S. citizen to obtain a security clearance. Many individuals are under the false impression they get to ‘keep’ their clearance after they separate from military service or leave a cleared job. It’s important to note that at any time, a clearance is under the purview of the government. And what the government giveth, the government may take away. Policy dictates that a clearance is ‘current’ for a period of two years after leaving service. If you move out of a cleared job and into another within that period, your clearance can be easily reinstated – assuming your investigation hasn’t expired

CONDITIONS FOR A SECURITY CLEARANCE MAY INCLUDE BUT ARE NOT LIMITED TO: • ARREST AND/OR CONVICTION OF A FELONY; • FREQUENT INVOLVEMENT WITH AUTHORITIES EVEN AS A JUVENILE; • DWI/DUI; • HAVING BEEN A PATIENT IN AN INSTITUTION PRIMARILY DEVOTED TO THE TREATMENT OF MENTAL, EMOTIONAL, OR PSYCHOLOGICAL DISORDERS; • A HISTORY OF NOT MEETING FINANCIAL OBLIGATIONS. A PATTERN OF FINANCIAL IRRESPONSIBILITY (BANKRUPTCY, DEBT OR CREDIT PROBLEMS, DEFAULTING ON A STUDENT LOAN); • MEMBERSHIP IN ANY ORGANIZATION THAT ADVOCATES THE COMMISSION OF ACTS OF FORCE OR VIOLENCE TO DENY OTHER PERSONS THEIR RIGHTS UNDER THE CONSTITUTION OF THE UNITED STATES; • HAVING PETITIONED TO BE DECLARED A CONSCIENTIOUS OBJECTOR TO WAR; • MOVING VIOLATIONS WITH FINES OVER $200; • ILLEGAL DRUG USE (TO INCLUDE ANY USE OF COCAINE, HEROIN, LSD, AND PCP); AND THE ILLEGAL PURCHASE, POSSESSION, OR SALE OF ANY SUCH NARCOTICS. • INABILITY OR UNWILLINGNESS TO SATISFY DEBTS • UNEXPLAINED AFFLUENCE • FINANCIAL PROBLEMS THAT ARE LINKED TO GAMBLING, DRUG ABUSE, ALCOHOLISM, OR OTHER ISSUES OF A SECURITY CONCERN.
  4. 4. • DOCUMENT OR ORAL STATEMENT TO THE GOVERNMENT WHEN APPLYING FOR SECURITY PROCESSING OTHER KEY FACTORS TAKEN INTO ACCOUNT INCLUDE: • VULNERABILITY TO COERCION: ANY OMISSION, CONCEALMENT, OR FALSIFICATION OF MATERIAL INFORMATION INCREASES AN INDIVIDUAL'S VULNERABILITY TO COERCION, EXPLOITATION, OR PRESSURE. • PROBLEMS IN WORK PERFORMANCE: THE WORK ENVIRONMENT OFFERS MANY OPPORTUNITIES TO EXHIBIT BEHAVIORAL OR PSYCHOLOGICAL PROBLEMS ASSOCIATED WITH UNRELIABILITY, UNTRUSTWORTHINESS, OR POOR JUDGMENT. THESE • EMPLOYMENT HISTORY: DEPENDING UPON AN INDIVIDUAL'S AGE AND CIRCUMSTANCES, FREQUENT CHANGES OF EMPLOYMENT WITHOUT ADVANCEMENT RAISE THE POSSIBILITY OF UNSATISFACTORY WORK PERFORMANCE DUE TO • CONDITIONS OF MILITARY DISCHARGE: APPLICANTS OFTEN CLAIM "HONORABLE DISCHARGE" FROM MILITARY SERVICE WHEN, IN FACT, THEY WERE GIVEN A "GENERAL DISCHARGE UNDER HONORABLE CONDITIONS." THE LATTER MEANS THE INDIVIDUAL WAS DISCHARGED FOR CAUSE. THE CAUSE IS OFTEN INABILITY TO ADAPT TO MILITARY LIFE OR SOME OTHER FORM OF UNSUITABILITY, SUCH AS A DRUG, ALCOHOL, CRIMINAL, OR EMOTIONAL/MENTAL PROBLEM. THE PERSONNEL • MULTIPLE TRAFFIC OFFENSES: MULTIPLE TRAFFIC CITATIONS FOR RECKLESS OR HIGH-SPEED DRIVING, INCLUDING DRIVING WITH A SUSPENDED LICENSE, ARE EXAMPLES OF HIGH-RISK, ANTISOCIAL BEHAVIOR THAT MAY BE A SECURITY CONCERN. SOME SECURITY REGULATIONS ARE PICKY AND UNNECESSARY AND DO NOT MERIT HIS OR HER COMPLIANCE.
  5. 5. Obtaining Information On Your Clearance Expiration Date Your Facility Security Officer (FSO) may inquire about the status of your security clearance. All National Industrial Security Program (NISP) cleared contractors use JPAS (official personnel security clearance database management system for DoD and other government users). The Personnel Security Investigation (PSI) on which the clearance is based can be either “current” or “expired.” Generally, if the PSI is out-of-date (expired) or there has been a break-in-service of two years or more, a person must be nominated for a new clearance, and must complete a new application in the same manner as a person who never had a clearance. FOIA AND PRIVACY ACT REQUESTS If you’re not currently employed, you have additional options to determine your clearance expiration date. If you’re on friendly terms with your last employer or security officer, you can make an inquiry of them. Alternatively, you can request a copy of security clearance investigation status through a Freedom of Information Act (FOIA) request through your sponsoring agency. the majority of clearance holders, a privacy act request through the Defense Manpower Data Center provides the necessary information. Once you’ve obtained your security clearance status, be sure to update your ClearanceJobs profile with your expiration date other details. What if my security clearance expiration date has passed? Using common defense contractor terminology, a security clearance is not considered as “expired” until 24 months from a job that required access to classified information. Security clearance investigations can be “out of scope” if the date to a periodic reinvestigation has passed without the investigation being completed. Due to the current investigation backlog as as pushes to continuous monitoring of cleared personnel, many candidates with security clearance are still working even their latest investigation is “out of scope.” Candidates should note key dates in the Clearance Notes section of their candidate profile, to give employers clearer understanding of current statuses.

OPM USES THE INFORMATION IT HAS TO MAKE A JUDGMENT ON WHETHER TO APPROVE • THERE ARE NO UNIFORM GUIDELINES ACROSS THE GOVERNMENT FOR DIFFERENT LEVELS OF CLEARANCE. THIS MEANS THAT TOP-SECRET CLEARANCE AT ONE AGENCY MEANS SOMETHING COMPLETELY DIFFERENT AT ANOTHER. • WITHIN EACH AGENCY, THERE ARE NO STRICT GUIDELINES FOR DETERMINING SECURITY CLEARANCE. • USIS, A PRIVATE CONTRACTOR, CONDUCTS 65 PERCENT OF ALL U.S. GOVERNMENT BACKGROUND CHECKS. • USIS, WHICH CONDUCTED A BACKGROUND CHECK ON SNOWDEN, IS NOW UNDER INVESTIGATION BY OPM’S IG FOR FAILING TO CONDUCT PROPER BACKGROUND CHECKS. • OPM HAS ALREADY PAID USIS $200 MILLION THIS YEAR. • THE $1-BILLION-DOLLAR FUND THAT OPM USES TO PAY FOR BACKGROUND CHECKS HAS NEVER BEEN AUDITED.
