What are the functions of the Board of Election Inspectors (BEI)? <ul><li>To conduct the voting and electronic counting of votes in their respective polling places. </li></ul><ul><li>Print election returns and transmit electronically the results through the PCOS Machines </li></ul><ul><li>Act as COMELEC deputies in the conduct of elections </li></ul><ul><li>Maintain order in the polling place and premises </li></ul><ul><ul><li>Keep access to polling place open and unobstructed </li></ul></ul><ul><ul><li>Prohibits use of cameras and celphones of voters (not watchers) </li></ul></ul><ul><ul><li>Issue written order to peace officer to take into custody persons who refuse to follow orders or is behaving in a disorderly manner (but not so as to prevent that person from voting) </li></ul></ul><ul><li>Other functions to be designated by law or Comelec </li></ul><ul><li>One (1) BEI for every precinct/clustered precinct </li></ul>PLN

Qualifications: <ul><li>Good Moral Character and Irreproachable reputation </li></ul><ul><li>Registered Voter of the city or municipality </li></ul><ul><li>Has not been convicted of any election offense or any other crime punishable by more than six (6) months of imprisonment </li></ul><ul><li>No pending case against filed in the COMELEC/court for any election offense </li></ul><ul><li>Able to speak, read and write English or the local dialect </li></ul>PLN

Disqualification : <ul><li>Relationship - No person shall serve as chairman or member of the BEI if he is related within the 4 th civil degree of consanguinity or affinity: </li></ul><ul><ul><li>to any member of the BEI; or, </li></ul></ul><ul><ul><li>to any candidate to be voted for in the polling place or his spouse ( § 167 of BP Blg. 881) .  </li></ul></ul>PLN

Before the voting begins, the BEI shall: <ul><li>Post a copy of the PCVL at the door of the polling place. </li></ul><ul><li>Show to the public: </li></ul><ul><ul><li>The PCOS is sealed </li></ul></ul><ul><ul><li>Ballot Box is locked and empty (transparent compartment) </li></ul></ul><ul><ul><li>the package of official ballots and the Book of Voters duly sealed </li></ul></ul><ul><li>Remove the sticker seal of the PCOS Box </li></ul>PLN

Before the voting begins, the BEI shall: <ul><li>Show to public that the following were duly sealed: </li></ul><ul><ul><li>PCOS Printer Cover </li></ul></ul><ul><ul><li>Slots labeled POLL WORKER and ADMINISTRATOR </li></ul></ul><ul><ul><ul><li>These contain the main memory and backup memory cards, respectively </li></ul></ul></ul><ul><li>Unlock the sliding cover of the ballot box and break its plastic security seal </li></ul><ul><li>Place PCOS properly on top of the ballot box </li></ul><ul><li>Break the printer cover seal </li></ul><ul><li>Open printer cover </li></ul><ul><li>Chairman takes out iButton security key </li></ul><ul><li>Verify roll of paper is properly installed </li></ul><ul><li>Close the printer cover </li></ul>PLN

Before the voting begins, the BEI shall: <ul><li>Connect power adaptor to the PCOS AC power port (220 VAC) </li></ul><ul><li>Plug to electrical outlet </li></ul><ul><li>Connect battery to PCOS DC power port (12 VDC) </li></ul><ul><li>If there is no power: </li></ul><ul><ul><li>Using a pen, press the RESET button on top of PCOS AC power port </li></ul></ul><ul><li>PCOS displays “PLEASE INSERT SECURITY KEY FOR AUTHENTICATION” </li></ul><ul><li>Chairman places iButton security key on the correct receptacle </li></ul><ul><li>PCOS displays “SECURITY KEY VERIFIED” </li></ul>PLN

Voting hours <ul><li>7:00 a.m. to 6:00 p.m., except when there are voters present within 30 meters in front of the polling place who have not yet cast their votes. </li></ul><ul><li>The voting shall continue but only to allow said voters to cast their votes without interruption ( § 190, B.P. Blg. 881) . </li></ul><ul><li>Procedure: </li></ul><ul><ul><li>Poll clerk prepares complete list of names of unfinished voters, consecutively numbered. </li></ul></ul><ul><ul><li>Announce name to call them to vote 3 times in the order listed </li></ul></ul><ul><ul><li>If voter does not respond the call, voted cannot vote at any later time </li></ul></ul>PLN

Voting hours <ul><li>Be alert! </li></ul><ul><li>Observe! </li></ul><ul><li>Take notes! </li></ul><ul><li>Consult with or report to your superiors! </li></ul><ul><ul><li>Check for and report anything suspicious, even the loss of power and/or celphone signal. Remember you are allowed to use a celphone, voters are not allowed to use one (with the intention of recording/taking a picture of his/her ballot). </li></ul></ul>PLN

Voting Privilege of BEI and Support Staff <ul><li>BEI and Support Staff may avail of local absentee voting or vote in the precinct other than where they are assigned: </li></ul><ul><ul><li>Provided voting in the precinct is light </li></ul></ul><ul><ul><li>Allowed to leave to post for 30 minutes maximum and </li></ul></ul><ul><ul><li>One at a time only </li></ul></ul>PLN
  39. 39. Who may vote? <ul><li>All registered voters </li></ul><ul><li>Names appearing in PCVL or EDCVL </li></ul><ul><li>Whose registration records have not been cancelled or deactivated </li></ul>PLN
  40. 40. Rules to be observed during voting: <ul><li>Voters vote in the order of their arrival at the polling place </li></ul><ul><li>No watcher shall enter the place reserved for the voters, BEI </li></ul><ul><li>No watcher shall mingle or talk with the voters </li></ul><ul><li>No firearms or deadly weapons in polling place, except those authorized by COMELEC </li></ul><ul><li>No crowding of voters and disorderly behavior inside polling place </li></ul><ul><li>Ballot box locked during voting </li></ul>PLN
  41. 41. Persons allowed in and around the polling place: <ul><li>Members of the BEI and support staff, if any </li></ul><ul><li>Watchers </li></ul><ul><li>Comelec representatives </li></ul><ul><li>Technical Support Staff, when summoned by BEI to address technical problems </li></ul><ul><li>Voters casting their votes </li></ul><ul><li>Voters waiting for their turn to cast their votes (10 at a time) </li></ul><ul><li>Other persons specifically authorized by COMELEC </li></ul>PLN
  42. 42. Persons not allowed to enter or stay inside the polling place and within 50 meter radius: <ul><li>Any officer or member of the AFP and PNP </li></ul><ul><li>Any person belonging to any extra-legal police agency, special forces, reaction forces, strike forces, CAFGUs, barangay tanods, or other similar forces or para-military forces, including special forces, security guards, special policeman </li></ul><ul><li>All other kinds of armed or unarmed extra-legal police officers </li></ul><ul><li>Any barangay official </li></ul><ul><li>Except when these people will vote (subject to firearm prohibition) </li></ul>PLN

Exception: Special Security Details: conditions <ul><li>BEI decision by majority vote </li></ul><ul><li>For the protection of the BEI or election paraphernalia </li></ul><ul><li>Entered into the Minutes (A11) </li></ul><ul><li>Stays just outside near enough to be easily called by the BEI anytime </li></ul><ul><li>Police or peace office shall not talk to voter, disturb or obstruct the proceedings </li></ul>PLN

Other prohibitions on voters (§ 30, Res. 8786): <ul><li>Cannot bring ballot, secrecy folder or marking pen outside of polling place </li></ul><ul><li>Cannot speak anyone while inside polling place other than BEI or assistors </li></ul><ul><li>Must use secrecy folder when preparing ballot </li></ul><ul><li>Cannot exhibit contents of ballot </li></ul><ul><li>Cannot fill ballot accompanied by another, unless a legitimate assistor </li></ul><ul><li>Cannot erase any printing from ballot or put any distinguishing marks in it </li></ul><ul><li>Cannot use carbon paper or any means to copy contents </li></ul><ul><li>Cannot use camera, celphone, or any other scheme to record ballot contents </li></ul><ul><li>Cannot intentionally tear or deface the ballot </li></ul><ul><li>Cannot disrupt or attempt to disrupt normal PCOS operations </li></ul>PLN

  48. 48. First, the voter looks for his name is on the list (PCVL) to get precinct and sequence number PLN
  49. 49. Then the voter enters precinct to obtain his ballot <ul><li>The voter approaches the BEI member or support staff-in-charge and gives his sequence number in the PCVL, name, address and other data. </li></ul><ul><ul><li>BEI verifies identity in EDCVL </li></ul></ul><ul><li>If the BEI is satisfied as to his identity, the Chairman shall announce the voter’s name in a tone loud enough to be heard throughout the polling place. </li></ul><ul><ul><li>If you are not familiar with the person, challenge his/her identity. </li></ul></ul><ul><ul><li>If you know he/she has done something illegal, issue a challenge. </li></ul></ul>PLN

  51. 51. Challenging Voters <ul><li>As a watcher, can challenge on two grounds: </li></ul><ul><ul><li>He is an illegal voter </li></ul></ul><ul><ul><li>He has done (an) illegal act (s) </li></ul></ul>PLN

Challenging Voters <ul><li>What is an illegal voter? </li></ul><ul><ul><li>not being registered </li></ul></ul><ul><ul><li>using the name of another voter </li></ul></ul><ul><ul><li>suffering from an existing disqualification </li></ul></ul><ul><ul><li>being a double/multiple registrant </li></ul></ul>PLN

Challenging Voters <ul><li>What are illegal acts? </li></ul><ul><ul><ul><li>he/she has received or expects to receive, has paid, offered or promised to contribute money or anything of value as consideration for his/her vote or for the vote of another; </li></ul></ul></ul><ul><ul><ul><li>he/she has made or received a promise to influence the giving or withholding of such vote; </li></ul></ul></ul><ul><ul><ul><li>he/she has made, or is interested directly or indirectly in, a bet which depends upon the result of the election. </li></ul></ul></ul>PLN

Challenging Voters <ul><li>How are challenges made? </li></ul><ul><ul><li>Issue a verbal challenge to the voter clearly heard by the BEI </li></ul></ul><ul><ul><li>State your grounds </li></ul></ul><ul><ul><li>Be clear, firm and assertive, as this voter may be the difference between the candidate winning or losing this election </li></ul></ul><ul><ul><li>Make sure that the challenge is recorded in the minutes (A11), as well as obtain all other documents regarding such challenge (A35, A39 and A40) </li></ul></ul><ul><ul><li>Inform your superiors immediately </li></ul></ul>PLN

Challenging Voters <ul><li>How are challenges resolved for illegal voters? </li></ul><ul><ul><li>The BEI shall ask the person challenged to present proof of registration, identity or qualification. If the challenged voter cannot produce his/her voter’s registration card, you can confirm his/her identity by checking his/her photograph or specimen signature in his/her registration record or in any other valid identification document. </li></ul></ul><ul><ul><li>A member of the BEI may identify the voter, under oath, and record this in Part E of the Minutes o f Voting and Counting of Votes and issue form A40 </li></ul></ul>PLN
  56. 56. Challenging Voters <ul><li>How are challenges resolved for illegal acts? </li></ul><ul><ul><li>The voter will take an oath denying the facts alleged in the challenge.
