  8. 8. Individuals with Disabilities Education Improvement Act,2004 I t A t 2004 • Mandates a free, appropriate public education (FAPE) for children and youth with disabilities. • Two parts: Part B – for students with disabilities 3 -22 years of age; Part C – infants and toddlers with disabilities from birth to age 3. ( In VA, if child is 2- 3 yrs of age parents can chose Part B or Part C Part C is the Department yrs. age, C. of Behavioral, Health, and Developmental Services. 9. 9. What IDEA says about Assistive Technology (300.105) • Each public agency shall ensure that AT devices or AT p g y services or both, as defined in 300.5 and 300.6 are made available to a child with a disability if needed as part of the child s child’s 1. special education (300.36) 2. related service (300.34) 3. or supplemental aids or services (300.38 and 300.114(a)(2)(ii) Free Powerpoint Templates Page 9
  10. 10. Legal definition of AT • Assistive Technology consists of DEVICES and SERVICES that help children with disabilities carry out a functional activity in their environment. Free Powerpoint Templates Page 10
  11. 11. What i Wh is an Assistive Technology A i i T h l device? “any item, piece of equipment or product system, whether acquired commercially off the shelf, h th i d i ll ff th h lf modified, or customized, that is used to increase, maintain, or improve functional capabilities of a child with a disability.” Free Powerpoint Templates Page 11
  12. 12. 2004 IDEA revisions • IDEA, 2004 revised the definition of Assistive Technology DEVICE by adding an exception. The NEW definition EXCLUDES a medical device that is surgically implanted or the replacement of such a device.
