  2. 2. The state of California recognizes two forms of child custody: physical and legal. Matters of physical custody typically relate to where children primarily reside, attend school and how much time they spend with each parent or guardian. Cooperative parents can arrange parenting schedules based on their mutual agreement,. A traditional arrangement involves the children spending the school week with one parent and the weekend with the other.
  3. 3. Joint physical custody is ideal, but it is common for a judge to grant one parent primary physical custody while awarding joint legal custody. Legal custody refers to the right to make health, education and welfare decisions on a child’s behalf. A parent lacking legal custody orders does not have the right, for example, to contact their child’s doctor or school for records or information regarding the child.
