At one point, Ms. Serrano informed her mother that he had not eaten anything but breast milk for a two week period. Over the last few days, Ms. Serrano has stated that Mateo has had a high fever, vomit, and a cough. I am deeply concemed that the detained setting in which Mateo is being held is having a severely prejudicial effect on his health. I am aware that Ms. Serrano was already afforded a credible fear interview, which was denied, and that an immigration judge affirmed the asylum officer’s negative decision. Given that Ms. Serrano was not afforded an attorney at the interview, I intend to request a re-interview with the Houston Asylum Office pursuant to 8 C. Ms. Serrano was interviewed under duress. She and her infant son have been detained in substandard conditions for almost 2 months. She entered the United States with her infant son in June of this year. She was held with her son in a freezing cold holding cell for 6 days. Her son became very ill in this same time period and has been very ill for the entire time he has been detained. Mateo’s health was so bad that he was hospitalized for several days last week because he had not eaten anything solid for two weeks. Upon information and belief, Ms. Serrano was interviewed in the presence of her infant son who was seriously ill. It is apparent that she was rushed through the credible fear interview with the intent—along with the majority of individuals detained at Artesia——to prevent her from obtaining legal counsel. It is unconscionable that Ms. Serrano and others have been forced to undergo credible fear interviews while they are detained with their young or infant children and without any opportunity to have counsel present. Additionally, I have not been able to review any her file because the Houston Asylum Office refuses as a matter of policy to provide copies of an applicant’s file. I am expected to obtain all of the paperwork from the person detained, which is impossible given the severe restrictions on communication. I have already sent a written request to the ICE El Paso Field Office Director Adrian Macias for Ms. Serrano and her infant son’s release from detention so that so that she can be given a credible fear interview where she is not under duress. Given the foregoing, I respectfully request that Katy Elizabeth Serrano Calderon be granted a credible fear re-interview so that she is interviewed without duress and with the presence of legal counsel.
