INTERNATIONAL CONVENTION ON
THE ELIMINATION OF ALL FORMS
OF RACIAL DISCRIMINATION

ICERD
It was adopted and opened for signature and ratification by U.N
General Assembly resolution 2106 (XX) of 21 December 1965 and
entered into force 4 January 1969, in accordance with Article 19.

ICERD
It is a specific International
Instrument that defines a particular
form of social practice (racial
discrimination) and specifies a
programme of legal obligations
necessary to combat it.

than separates us … We must find a
way to look after one another as if we
were one single tribe.” T’Challa.

ICERD
The Convention consists of a
preamble and 25 articles divided
into three parts. Summary:
◈ Prevention of discrimination
◈ Condemnation of apartheid
◈ Prohibition of incitement
◈ Promotion of tolerance
◈ Dispute resolution mechanism
◈ Individual complaints

◈ Obligations beyond existing
constitution
◈ Hate speech
◈ Immigration
◈ Indigenous people

ICERD
◈ States parties condemn racial discrimination
and undertake to pursue by all appropriate
means and without delay a policy of
eliminating racial discrimination in all its
forms.

ICERD
◈ The Convention establishes a Committee on
the Elimination of Racial Discrimination,
which is to report annually to the General
Assembly on, inter alia, measures
undertaken by States parties to give effect to
the provisions of the Convention, and which
may handle disputes between States parties
concerning the Convention. 7
ICERD
◈ It proclaims that parties to the convention
believe theories of superiority based on
racial difference are ‘scientifically false,
morally condemnable, socially unjust and
dangerous.’
◈ They also believe that there is ‘no
justification for racial discrimination, in
theory or in practice, anywhere.’ 8
ICERD
◈ States commit to make it a criminal offence
to ‘disseminate’ ideas based on racial
superiority or hatred.
◈ States also agree to criminalize acts of
violence, or acts ‘inciting’ violence, against
any race or group of persons of another color
or ethnic origin.

ICERD IN ARGENTINA
◈ The ICERD was included into an official act in
Argentina on the 26th of April, 1968 (17722 Act).
Ratified by Argentina on the 2nd of October, 1968;
nowadays it is one of the Human Rights instruments
with constitutional hierarchy according to Art. 75 i.22
of the National Constitution.

Ethnicity
It is a multifaceted quality that
refers to the group to which
people belong, and/or are
perceived to belong, as a result of
certain shared characteristics,
including geographical and
ancestral origins, but particularly
cultural traditions and languages
RACE DISCRIMINATION
Race
It refers to the group a person
belongs to, as a result of a mix of
physical features such as skin
color and hair texture. Race
supposedly reflects ancestry and
geographical origins, as
identified by others or,
increasingly, as self- identified.

RACE DISCRIMINATION
While race and ethnicity are
different, they are overlapping
concepts that are often used
synonymously, a trend fostered by
the increasing use, particularly in
the United States, of the compound
word race/ethnicity. In contrast, in
Europe race is being abandoned in
favor of ethnicity.

RACISM
◈ It is a belief that states that some races are
superior to others is used to justify
individual and collective actions that create
and sustain inequality.

RACIAL PREJUDICE
◈ It consists in negative beliefs, perceptions, or
attitudes towards one or more ethnic or
racial groups.

RACIAL DISCRIMINATION
◈ There are some groups or individuals, empirically identified by
CERD, who are generally more vulnerable to racial
discrimination prohibited by ICERD. These are among others:
minority groups (e.g.: ethnic, national or linguistic); indigenous
peoples; migrants, refugees and asylum seekers. These groups
of individuals have indeed often been identified by CERD as
victims of racial discrimination in many societies throughout
the world.

THE ICERD CONVENTION against all forms of discrimination

  • 2. ICERD It was adopted and opened for signature and ratification by U.N General Assembly resolution 2106 (XX) of 21 December 1965 and entered into force 4 January 1969, in accordance with Article 19. 2
  • 3. ICERD It is a specific International Instrument that defines a particular form of social practice (racial discrimination) and specifies a programme of legal obligations necessary to combat it. 3

  • 5. ICERD The Convention consists of a preamble and 25 articles divided into three parts.   • 6. ICERD ◈ States parties condemn racial discrimination and undertake to pursue by all appropriate means and without delay a policy of eliminating racial discrimination in all its forms. 6

ICERD ◈ The Convention establishes a Committee on the Elimination of Racial Discrimination, which is to report annually to the General Assembly on, inter alia, measures undertaken by States parties to give effect to the provisions of the Convention, and which may handle disputes between States parties concerning the Convention. 7

ICERD ◈ It proclaims that parties to the convention believe theories of superiority based on racial difference are ‘scientifically false, morally condemnable, socially unjust and dangerous.’ ◈ They also believe that there is ‘no justification for racial discrimination, in theory or in practice, anywhere.’ 8
  • 9. ICERD ◈ States commit to make it a criminal offence to ‘disseminate’ ideas based on racial superiority or hatred. ◈ States also agree to criminalize acts of violence, or acts ‘inciting’ violence, against any race or group of persons of another color or ethnic origin. 9
  • 10. ICERD IN ARGENTINA ◈ The ICERD was included into an official act in Argentina on the 26th of April, 1968 (17722 Act). Ratified by Argentina on the 2nd of October, 1968; nowadays it is one of the Human Rights instruments with constitutional hierarchy according to Art. 75 i.22 of the National Constitution. 10

Ethnicity It is a multifaceted quality that refers to the group to which people belong, and/or are perceived to belong, as a result of certain shared characteristics, including geographical and ancestral origins, but particularly cultural traditions and languages RACE DISCRIMINATION Race It refers to the group a person belongs to, as a result of a mix of physical features such as skin color and hair texture. Race supposedly reflects ancestry and geographical origins, as identified by others or, increasingly, as self- identified. 12

RACE DISCRIMINATION While race and ethnicity are different, they are overlapping concepts that are often used synonymously, a trend fostered by the increasing use, particularly in the United States, of the compound word race/ethnicity. In contrast, in Europe race is being abandoned in favor of ethnicity. 13
  • 14. RACISM ◈ It is a belief that states that some races are superior to others is used to justify individual and collective actions that create and sustain inequality. 14
  • 15. RACIAL PREJUDICE ◈ It consists in negative beliefs, perceptions, or attitudes towards one or more ethnic or racial groups. 15
  • 16. RACIAL DISCRIMINATION ◈ There are some groups or individuals, empirically identified by CERD, who are generally more vulnerable to racial discrimination prohibited by ICERD. These are among others: minority groups (e.g.: ethnic, national or linguistic); indigenous peoples; migrants, refugees and asylum seekers. These groups of individuals have indeed often been identified by CERD as victims of racial discrimination in many societies throughout the world. 16
