The government of India has enacted the Right to Information Act, 2005. 2. It has given right to information to all citizens. [3] 3. It is applicable to whole of India except Jammu 81. Kashmir State. [1(2)] 4. Indian parliament gave assent to it on 15-06-2005 and it has come into force from 12-10-2005. [1(3)] 5. The Freedom of Information Act, 2002 has been repealed. [31] 6. This Act contains 6 chapters, 31 sections and 2 schedules. 7. The provisions of this Act prevail if they disagree with the same of the existing other Acts. [22] 8. If anyone does or tries to do anything in good faith under the Act or rules made under the Act, no suit, prosecution or other legal proceeding shall lie against the person [21]. No court shall entertain any suit, application or other proceeding in respect of any order made under this Act and no such order shall be called in question otherwise than by way of an appeal under this Act. [23]

If It shall be a constant endeavour of every public authority to take steps in accordance with the requirements of 4(1b) to provide as much information suo motu to the public at regular intervals through various means of communications, including internet, so that the public have minimum resort to the use of this Act to obtain information. They receive and inquire into a complaint from any person with regard to [a] PIO not appointed or refusal to receive applicant or to give information or to send appeal to higher/ appeal authorities; [b] Not giving information in time; [c] Unreasonable fee collections; [d] Giving false information; [e] Other matters of information or access to records. [18(1)] 2. They make enquiry on the eligible complaints. [18(2)] 3. They have the same powers as are vested in a civil court while trying a suit under the Code of Civil Procedure, 1908. (summoning the attendance of persons; calling witness; inspecting documents; requisitioning any public record; etc. ,) [18(3)] 4. They can examine any record disrespect of provisions of other Acts. [18(4)] 5. They act the second appeal authority under this Act. [18(1), 19] 6. Their decisions are abide for all. [19(7)] 7. In their decisions, they have powers to require the public authority to take required steps to secure compliance with the provisions of this Act [19(8)]. viz 1) to keep info in a particular form; 2) Changes in record management; 3) Training of RTI; 4) Reports on voluntary info; 5) Impose of fines; 6) Refusal of application. 8. If they have opinioned that P. I.O. deliberately neglected in giving information, they can fine Rs.250 a day with maximum of Rs.25,000 [20(1)]. They can recommend to initiate disciplinary action against the P. I.O. who persistently neglected his duty under this Act.

For this purpose, all departments are to give details to the commissions. [25(2,3)] ‘Appropriate governments are to place the reports given by the information commissions before the legislative bodies [25(4)]. If any department is not implementing effectively, the commissions may suggest apt steps [25(5)]. ‘Based on the availability of financial and other assets the governments are to take steps to provide awareness on the rights given by the Act to people, chiefly to the down trodden, arrangements, training, printing guide etc. , [26] The governments, competent authorities are to pass rules to implement of the Act such as cost of the materials to be disseminated, fees for applications, information provision, salaries of Commissioners etc. , [27, 28] ‘All the rules made under this Act are to be placed before the Legislature. With consent of them, they will be in force otherwise cancelled [29]. The Central Govt. has to clear hurdles in the implementation of the Act. [30]
