Diminishing Musharah is best instrument in my opinion for Housing Finance. With its structure and flexibility it can play very important role in growing the Islamic Finance.
There are three possible structures of musharakah partnership in a business venture, namely, permanent musharakah, temporary (redeemable) musharakah and diminishing musharakah. The term Musharakah means joint venture where profits are shared amongst the partners as agreed between them and losses have to be borne by each partner according to their investment.
In DM, a financer and a client participate in either ownership of a joint property, or in a joint commercial business, with the understanding that the client partner will buy the equity share of the financier partner over an agreed period of time until the title to the equity is completely transferred to the client by payments of installments to the financier for purchase over the agreed period. The buying and selling of equity is not stipulated in the partnership contract as it is not allowed - one partner is allowed to give only a promise to buy.

Nifty Trading Agreement
- 1. Nifty Trading Agreement This Nifty Trading Agreement (the “Agreement”) is entered into on date 22 Nov 2019 by and between “JMD Consulting LLP” (the “Company”) with LLP Identification Number: AAL-7726, having its principal address at: “1484, 1st Floor, Old Court Compound, Kashmere Gate, Near Ritz Cinema, Delhi – 110006” and “Vishal Verma“ (the “Client”) having its principal address at: “ XXX, Sector XX, Vashi, Navi Mumbai – 400703” Both parties agree to be bound by this Agreement. The terms of this Agreement are as follows: 1. JMD Capital and JMD Ventures are the operating names of the company JMD Consulting LLP in India. All regulatory filings in India will have the name: JMD Consulting LLP. 2. Tenure: This Agreement is for a period of 2 years from the date of the Agreement. 3. Capital: The Client will invest Rs 25.00 lakh (Twenty Five lakh) in this trading venture. 4. Operating Model: The Client will use the Capital to buy specific high quality Nifty stocks suggested by the Company at specific prices, and sell them later at a predefined price suggested by the Company, to convert the stock into cash, and thereby creating a profit. Multiple trades maybe done in the Tenure of this Agreement. 5. Profit Sharing: After successful completion of a trade, the Client will give 15% of the gross trading profit to the Company. For example, if the Client buys 1000 shares of HDFC at Rs 1900 per share and sells them at Rs 2300 per share, then the gross trading profit will be Rs 400 per share (which is 2300 minus1900). Therefore, the profit share of the Company will be Rs 60 per share (15% of 400), or Rs 60,000 for 1000 shares. The Client will transfer this profit share to the Company via online bank transfer or cheque. 6. Trading Instruments: All trades will be done only in the following eight Nifty index stocks: Reliance (RIL), HDFC, TCS, Infosys, L&T, SBI, Axis Bank, ICICI Bank. 7. Market Risk: The Client understands that all equity investments and trades are subject to market risk. Profits are be guaranteed in the equity market. Even though we will buy some of the best quality stocks available in India, their stock price can fall below the Client's buying price in case of a market correction. 8. Termination: The Agreement can be terminated only with mutual consensus. If the Client must terminate this agreement to sell the stocks for an urgent capital need, then the Client understands the market value of the stocks maybe below the buying price at that particular time. If the price of the stocks is above the buying price, then the Profit Sharing clause will apply. 9. Confidentiality: The Client may periodically receive emails with updates regarding the trades being done by the company. This is the intellectual property of the Company and it is “Confidential Information”. The Client shall not disclose such Confidential Information to any third party. 10. Indemnification: The Client agrees to indemnify and hold harmless the Company from any third party claims that are based upon the Client's violation of the law, or this Agreement, or of any third party’s rights. 11. No Modification Unless in Writing: No modification of this Agreement shall be valid unless in writing (by email) and agreed upon by both Parties. Both parties can communicate via email.
