Who is the dietary supplement industry?
Dietary supplement products include vitamins, minerals, botanicals, sports nutrition supplements, weight management
products, and specialty supplements. These products are intended to be used as supplements to, not substitutes for, a
well-balanced diet and a healthy lifestyle. When used properly, they help promote overall good health and prevent disease.
More than 150 million Americans take dietary supplements annually.
Is the dietary supplement industry regulated?
Yes. The dietary supplement industry is regulated by FDA and the Federal Trade Commission (FTC), as well as by government
agencies in each of the 50 states. The FDA has regulatory authority under the Dietary Supplement Health and Education Act
(DSHEA), a 1994 amendment to the Federal Food, Drug and Cosmetic Act that was passed by unanimous consent in both
the House and Senate.
Why do some people say the industry is unregulated?
When critics say dietary supplements are âunregulated,â what they generally mean is that dietary supplements are not regu-
lated like drugs. Dietary supplements have always been regulated as a category of food in this country, and DSHEA did not
change that fact. Virtually all facets of dietary supplement manufacturing, labeling and marketing are covered by extensive
regulations issued and enforced by FDA and FTC. If dietary supplements were regulated like drugs, there would likely be no
dietary supplement industry and the products that did exist would cost what drugs cost.
Is it true that before DSHEA was passed, FDA had pre-market approval authority?
No. FDA never had pre-market approval over dietary supplements, and DSHEA did not change that fact. Under the law,
dietary supplements marketed in the U.S. before passage of DSHEA are âgrandfatheredâ and assumed to have a history of
safe use. If a supplement manufacturer wants to introduce a new ingredient, it must provide FDA with 75 days notice, along
with safety information. If FDA has any concerns about the ingredient or submitted safety profile, the agency can request
more information or deny the productâs entry into the marketplace. Since the passage of DSHEA, FDA has turned down
about half of the New Dietary Ingredient notifications filed.
What did DSHEA do?
DSHEA specifically reaffirmed the status of dietary supplements as a category of food and created a specific definition for
dietary supplements. Further, DSHEA provided FDA with additional enforcement authority, including the ability to remove from
the market products the agency deems unsafe through: 1) an âimminent hazardâ clause which permits FDA to immediately
remove a product it considers to present a safety concern and 2) an âunreasonable riskâ clause that allows removal of a
product considered to have an unfavorable risk/benefit profile.

11. Topically applied creams and lotions provide some benefit, but they are not capable of
undoing the effects that years of environmental exposure have inflicted upon the skin. In many
cases, the benefits obtained through the topical application of such products are all too brief.
Furthermore, such products do not normally address all of the needs of the skin as the
human body ages. It is widely recognized that sunscreen products, when properly applied,
can protect the skin against some of this damage. However, even these products do not

state by reacting with virtually any molecule that it encounters, including the proteins and
lipids as well as with the genetic code of skin cells (the DNA and RNA) that are capable of
sustaining the life of those cells.
Since even the best sunscreen products available in the market today do not absorb visible
light, they cannot provide protection against free radical attack caused by exposure to these
light sources. Additionally, since visible light is capable of penetrating the skin to its maximum
thickness as well as to depths greater than the most penetrating wavelengths of ultraviolet
light, visible light is capable of creating free radicals throughout all layers of the skin, not just
in the outermost layers.
The skin possesses some natural protection against free radicals. Materials called
antioxidants provide that protection. This antioxidant capacity of the skin comes from a
mixture of vitamins, minerals, and foods that we eat as well as from enzymes produced by
the skin cells themselves. However, this natural protective system is easily overwhelmed by
the nature and degree of the environmental factors assaulting the skin today. This is
especially true considering todayâs outdoor lifestyles that result in significantly greater
exposure of skin to visible and ultraviolet light.
