  1. 1. Western Balkan recommendations on public consultations on draft legislation and public policy documents Goran Forbici, CNVOS
  2. 2. Aim • codification of best practices in the field of public consultations on draft legislation and public policy documents in order to encourage and assist governments to design policies and legislation in an inclusive manner, enabling active participation of society
  3. 3. Structure of today’s discussion 2 tour de tables: - Key rules/recommendations - Recommendations for individual steps of decision making cycle
  4. 4. Key rules • Embededness into policy making cycle • Careful planning • Sufficent resources • Proportionality • Sufficent time • Proactivness • Advance notification • Early involvment • Targeted approach • Accessebility of information • Responsivness and transparency
  5. 5. • Both broad and deep engagment of all stakeholders affected • Targeted approach - sets of questions for different stkeholders • Proactive approach with tailor-made invitations • Methods adjusted to the individual characteristics of each (group of) stakeholder(s) About policy making stages - Issue identification
  6. 6. Policy formulation (drafting) Time for expert deliberation with expert groups and representative associations (business, trade unions, umbrella ngos etc.) Methods: working group, focus groups, deliberative workshops Need to share all background documents and materials
  7. 7. Decision-making Time for final public consultations Need to be broad – e-consultations with live debates/hearings for those not used electronic tools or writting in general Single e-platform Reasonable timeline Minimum deadline (20, 30?) Report on the outcome of consultations Need for on-going monitoring Internal evaluation at the end Framework for central quality control and oversight of processes (to secure quality and harmonisation)

Implementation phase • Cooperation with stakeholders that were engaged in policy formulation in on-going monitoring • Comprehensive reforms: possiblity of advisory council with external members • Need to enable the public to communicate their expirience with new legislation Evaluation phase Last step of old policy = first step of new policy Hence all recommendations that apply for „issue identification“
