2/12/2010 21:21
InfusionNurse: T1 can't help but think if SM/Media didn't talk about the case, would the outcome be
different? #RNchat
2/12/2010 21:21
holisticnurses: Hi nurses! T1 That a jury can be objective and hear all sides. #rnchat
2/12/2010 21:22
rnchat: T1 Its almost impossible to fathom the nursing organizations working against RNs on this
issue. It was vital that they support them #RNchat
2/12/2010 21:22
nursingpins: T1 was a topic at work that night - sm spread the word like fire! #rnchat
2/12/2010 21:22
KaitlynAliano: Hey, #RNchat! A little late, but I'm here. :-)
2/12/2010 21:24
holisticnurses: T1 Twas happy to see an article in the NYTimes about it too. #rnchat
2/12/2010 21:25
nursingpins: T1 I don't think the case would have ended so fast - but I like to think the outcome would
have been the same - SM #rnchat
2/12/2010 21:25
chuymatt: @InfusionNurse T1 I agree. I guess I am really biased against the justice system in the
south; I lived there too long. #rnchat
2/12/2010 21:26
ocdgirl2000: #rnchat T1 I've become MORE familiarized with the word "whistleblower" especially as it
relates to workplace employment issues.
2/12/2010 21:26
marypoole: T1:It should never have been a case in the first place #RNchat
2/12/2010 21:26
rnchat: T1 I was hoping to hear from some physicians tonight! #RNchat
2/12/2010 21:26
drval: #rnchat T1: I worry about financial implications for Mitchell. I'm very glad she was
acquitted but the cost and hassle factor is unfair!
2/12/2010 21:26
InfusionNurse: T1 - happy with the outcome for Ann but what happens to the doc? Does he get away?
#RNchat

the first place #RNchat
2/12/2010 21:30
drval: Agree - it's outrageous that the doc was subjecting patients to snake oil - and there's no
justice for the patients. #RNchat
2/12/2010 21:30
marypoole: T1:After what she went through, many would think twice about whistleblowing. Even if she
could resume her life, would she want to? #RNchat
2/12/2010 21:30
rnchat: @drval T1 Yes you are right, cost & hassle factor are always great, especially after a
public trial like that one #RNchat

marypoole: T1: small town, many supported the physician #RNchat
2/12/2010 21:33
drval: @marypoole Ann lost her job, was subjected to emotional turmoil, had to front costs, was
harassed by sheriff. Who will dare follow? #RNchat
2/12/2010 21:34
rnchat: This brings us to T2 > Whistle Blowing: What are best practices for professionals who
wish to alert licensing boards of corruption? #RNchat
2/12/2010 21:34
lisagualtieri: Hi #RNchat! Just joining, hoping to ask "T5" at the end about patient blogs if @RNchat

2/12/2010 21:34
KaitlynAliano: @ocdgirl2000, you're right. *I* would definitely be interested in reading a book and/or
seeing a movie on the case. #RNchat

2/12/2010 21:35
ali_rn: @marypoole heh! good point! #RNchat
2/12/2010 21:36
rnchat: @drval T1 hopefully Ann's ordeal will prevent a trial like this from occurring for future
whistleblowers #RNchat
2/12/2010 21:36
InfusionNurse: T2 - aren't organizations required to have a whistle blower policy to protect the person?
#RNchat
2/12/2010 21:36
onlinenursing: RT @ocdgirl2000: #rnchat T1 she'll have offers to write a book and make a movie. (Great
idea! Re: #WinlkerRN case)
2/12/2010 21:36

2/12/2010 21:36
InfusionNurse: LOL...RT @marypoole: T2: use someone elses computer :) #RNchat
2/12/2010 21:37
nursingpins: T2 Hopefully the case will bring attention to reporting "bad practice" some hosps don't
have policies. #rnchat
2/12/2010 21:37
onlinenursing: @drval So do you think she should create a civil suit against the physician and sheriff?
(Tangential Question) #RNChat
2/12/2010 21:37
ocdgirl2000: #rnchat T2 "whistleblowing" is also used in many other ways.It is also a legal term used
in employment disputes when an employer abuses you.
2/12/2010 21:37
rnchat: I hate to laugh, but LMAO! >> RT @marypoole T2: use someone elses computer :)
#RNchat
2/12/2010 21:37
consultdoc: @InfusionNurse Most compliance "hotlines" are designed to be anonymous to all except
the compliance officer. #RNchat
2/12/2010 21:38
ali_rn: @nursingpins to be honest I have no idea how to go about this if i needed to #rnchat
2/12/2010 21:38

2/12/2010 21:38
drval: I guess part of the problem is with the US legal system - no real penalty for those who
bring frivolous law suits. #RNchat
2/12/2010 21:39
ali_rn: @onlinenursing oh yes, civil suit to be sure, that sheriff perverted laws to protect his own
wallet #RNChat
2/12/2010 21:39
KaitlynAliano: @nursingpins, was going 2 say something similar. Maybe the #WinklerRNs case will bring
about a better way 2 handle such situations. #RNchat
2/12/2010 21:39
consultdoc: RT @drval: I guess part of the problem is the US legal system - no real penalty for those
who bring frivolous law suits <Agreed!> #RNchat
2/12/2010 21:40
holisticnurses: I agree, but that's more time and stress. RT @nursingpins: T2 - I think she should follow
up on the civil suit . #rnchat
2/12/2010 21:40
ali_rn: @drval good point! #RNchat
2/12/2010 21:40
chuymatt: @drval T1 in this case, it was the govt. bringing the case. #rnchat
2/12/2010 21:40
rnchat: T2 This certainly was a trial that should force us to create better avenues for future issues
like this #RNchat
2/12/2010 21:40
InfusionNurse: Does anyone know if the doc lost his license? Shame on the Texas med board if he
didn't #RNchat
2/12/2010 21:41
marypoole: T2: There was new laws enacted last year for whistleblowers, involving sexual
harrasement I think) not sure how it applies here #RNchat
2/12/2010 21:41
ocdgirl2000: #rnchat T2 remember, after whistleblowing, comes retaliation! Which is where you can file
complaint with EEOC!
2/12/2010 21:41
ali_rn: @KaitlynAliano I work in a 700 bed facility and we still don't have a code team, chance
we have a way to report? #RNchat
2/12/2010 21:41
onlinenursing: @consultdoc Great point re-anonymous.Actually,speaking of another situation. In MO now
you cannot anon. Hotline parents to DFS. #RNChat
2/12/2010 21:42
rnchat: @consultdoc T2 Can a whistleblower anonymously report a physician to the state board?
Or must a person step forward? #RNchat
2/12/2010 21:42
drval: It's very hard to report bad MD behavior to state boards. I appealed to my former
hospital's ethics committee once. That worked. #RNchat
2/12/2010 21:42
macobgyn: RT @drval: I guess part of the problem is with the US legal system - no real penalty for
those who bring frivolous law suits. #RNchat

2/12/2010 21:43
nursingpins: @InfusionNurse Did not loose them yet - had been reprimanded by MB before. #rnchat
2/12/2010 21:43
consultdoc: @rnchat Most states require a person to step forward. Agree with @drval that it is tough
to report bad behavior to most state boards #RNchat
2/12/2010 21:43
rnchat: Great point >> RT @drval: Part of the problem is with the US legal system - no real
penalty for those who bring frivolous law suits. #RNchat
2/12/2010 21:43
KaitlynAliano: @onlinenursing, I don't know, but this would be a good idea... re: Can a whistleblower
anonymously report a physician to the stat... #RNchat
2/12/2010 21:44
marypoole: T2: Its hard even for patients; Do physicians have their names publicly listed if
disciplined? (like nurses do) #RNchat
2/12/2010 21:44
onlinenursing: RT @chuymatt: @drval T1 in this case, it was the govt. bringing the case. #rnchat (Great
point! Civil suit against the county then/govt.)
2/12/2010 21:44

2/12/2010 21:50
bgaustin: West TX has a good 'ol boy network like nowhere else in the state/country - would never
have happened in Dallas/Houston etc #rnchat
2/12/2010 21:51
