She was born without complete brain or skull. Her parents wanted to donate her organs to the other babies. Her parents sought her to declare brain- dead but on March 26, the Florida Circuit Judge Estella Moriarty ruled that the body had a functioning brain stem and could not be declared as brain dead. The two other courts also rejected the parents appeals but the time Theresa died, her organs had deteriorated too much to still be viable for transplant.
It is a congenital birth defect that occurs in approximately one in one thousand pregnancies. It is a neural tube defect, just as is spina bifida. Life expectancy for a baby with anencephaly after birth is just a few hours, sometimes a few days at most.
