FOWLER ELEMENTARY SCHOOL DISTRICT PHOENIX, ARIZONA 85043 RFP NO. 06-07-09 RFP ITEM: Engineering Testing Services SERVICES REQUIRED Fowler Elementary School District extends an invitation to qualified engineering testing firms to submit their proposals, experience, and capabilities to provide Engineering Testing Services for the construction of miscellaneous schools, offsite improvements and additions and improvements to existing schools outlined in the Project Description. Proposals should emphasize personnel assigned to the project and their timetable to complete their services. Top ranked firms will be asked to negotiate a detailed scope of services for a fixed fee. Do not include any type of fee proposal with your response. The District will select the most qualified firm and then start the negotiation process. The Engineering Testing Consultant will work closely with G. V. Enterprises’ Project Managers, the architectural consultant, the environmental consultant, utility companies, and government officials. The services may include, but not be limited to: 1. Assist the Architect and District Civil Engineer with site programming and master planning. 2. Assist in site evaluations/preliminary soil recommendations. 3. Work with the Project Manager, Architect, District Civil Engineer and Environmental Engineers to provide Corps of Engineers submittals (if required). 4. Assist in recommending site soil sampling for building bearing design. Specify pavement section for the Civil Engineer. 5. Design pavement sections for off site design use. 6. Coordinate soil sampling for the projects. Prepare soil-sampling logs. 7. Prepare and seal a soils report for the District Architect and Civil Engineer. Include any special information for the building substructure design. 8. Assist in preparation of construction documents (as they relate to soils engineering or as assigned) with the District Architect and Civil Engineer, including specifications. 9. Perform evaporative transmission tests on concrete floors. 10. The inspection and observation of engineering testing on a consistent basis. Inspection and observations documented in an observation report. 11. The preparation of all testing closeout material for submittal to the Project Manager. 12. Attendance at administrative project review meetings and functions related to the Owner’s building program, if required. 13. Consulting services as requested. 14. Soils engineer and all sub consultants to all maintain at least $1 million each of general liability and professional liability, and provide evidence to the Owner. FOWLER ELEMENTARY SCHOOL DISTRICT PHOENIX, ARIZONA 85043 RFP NO. 06-07-09 RFP ITEM: Engineering Testing Services GENERAL TERMS AND CONDITIONS Responses to the Request for Proposals will be received until 1:30 p.m., March 22, 2007, by the Governing Board of Fowler Elementary School District for Engineering Testing Services, RFP No. 06-07-09. A pre-proposal meeting will be held at the Fowler Elementary School District Office, 1617 South 67th Avenue, Phoenix, Arizona 85043 on March 13, 2007 at 9:00 a.m. Responses must be in a sealed envelope and marked on the outside of the envelope “ENGINEERING TESTING SERVICES, RFP 06-07-09”. The award of contract(s) will be made by the Governing Board at a later date. Responses to the Request for Proposals shall be accepted up to and no later than the time indicated in the Request for Proposals. All responses received after the time stated in the Request for Proposals shall not be considered. The respondent assumes the risk of any delay in the mail. Fax and telephone responses are not acceptable. All telephone or personal contact regarding information concerning this response to the Request for Proposals must be made with Gordon Vasfaret, Project Manager (GVE), 623-872-1852. Only the handwritten signature of an officer or designated representative of your company will be accepted a valid. The signature must be the actual signature of that person and must be signed in ink. A second party initialed signature will be invalid. Illegible or vague responses may be rejected. Please show company name on all pages of Request for Proposals responses. The submission of a response will indicate that the respondent understands the requirements and that he can supply the service specified. Each applicant is requested to submit a formal letter of interest for consideration for selection as the Engineering Testing Consultant. Certain minimum data, as described herein, must be furnished. 2. Furnish a description of the firm, its organization, size and nature of staff, office facilities available, special equipment such as computers, computer aided drafting, etc. 3. Furnish a statement of proposals and performance data which shall include a listing of educational projects, project descriptions, contract amounts, scheduling data, type of services performed, as well as education, training and proposals of members of the firm and key employees. 4. Furnish a list of current projects, including information similar to No. 3. 5. Data on past performance regarding maintainability of project budgets and schedules. Describe specific cost saving measures affected by your services on past projects and their magnitude. Describe by example how project budgets were improved or maintain to the Owner’s benefit. 6. Describe training and experience of assignable personnel including areas of specialization, professional achievements, etc., to indicate the nature, quality and depth of your staffing. 7. Submit your management plan, describing how you would organize and manage your efforts to meet your obligations as the Engineer for Testing Services for this contract. 8. Submit five (5) references (names, titles, addresses, phone numbers, fax numbers) familiar with your work, capabilities and performance as well as a copy of professional liability, general liability and Workman’s Compensation certificates. 9. Assist the Architect and District Civil Engineer with Site Programming and Master Planning – 30 Points 1. Describe your approach to assist in the site programming and master planning as it relates to Engineering Testing. B. Prepare a Development Plan – 15 Points 1. Describe how your firm implements a project. C. Office Staff – 15 Points 1. Express the general and specific project related capability of the in-house staff. Indicate the depth and abilities of the organization, which it can draw upon as needed. This will include engineering, technical and support staff. Also, indicate local support staff to be assigned to this project. 2. Give brief resumes of key persons to be assigned to the Project including, but not, limited to, the following: a. Name and title b. How many years with this firm. c. How many years with other firms. d. Experience including types of projects, size of projects, and specific project involvement. e. Education f. Develop an organizational chart as it relates to this RFP, indicating key personnel. It shall be understood that it is the intent of the District to insist that those key personnel indicated as the project team in the RFP response actually execute the Projects. 2. Field Services – subcontracted or in-house? How are field services implemented and managed? 3. Explain your approach to scheduling methods, management services, quality assurances, inspection and cost control as they relate to geotechnical services. F. Information System – 10 Points 1. FOWLER ELEMENTARY SCHOOL DISTRICT PHOENIX, ARIZONA 85043 RFP NO. 06-07-09 RFP ITEM: Engineering Testing Services INTERVIEWS AND PRESENTATION (if required) After the firms have been evaluated based on their written submissions, at least three (3) firms with the highest scores may be more closely considered through a presentation (if determined by the committee that interviews are necessary) of their approach to perform on this particular project. The interviews shall be a total of 30 minutes with a 15-minute oral presentation on the firm and 15 minutes of questions. Time will be allowed for questions and answers after the presentation. The interviewed firms will be expected to address the following: A. References – 10 Points 1. Recommendations of previous owners, architects and engineers. BESD will contact references listed in the submittal. Results will be provided to the Selection Committee. During the interview firms shall provide recommendations and examples from previous owners. B. Knowledge of the Site(s) and Local Conditions – 10 Points C. Proposed Project Staff and Functions – 20 Points 1. The firm shall name the actual staff to be assigned to this Project, describe their ability and experience, and indicate the function of each within their organization and their proposed role on this Project. The staff shall be present at the time of the interview. Resumes and background information of the assigned staff member shall be provided at this time. D. Insurance Program – 5 Points 1. Professional liability awareness. E. Overall Approach and Methodology – 20 Points 1. The firm shall demonstrate verbally and graphically its plan for performing the Project, documenting the services to be provided and showing the interrelationship of all parties. F. Cost Control/Value Engineering – 15 Points 1. As part of its services, the firm shall indicate knowledge and experience in the evaluation of project potential geotechnical work, and participate or recommend materials to create an optimum value in meeting the design and budget requirements. Discuss Army Corp 404 design process as it relates to soils/geotechnical recommendations. G. Project Scheduling – 20 Points 1. FOWLER ELEMENTARY SCHOOL DISTRICT PHOENIX, ARIZONA 85043 RFP NO. 06-07-09 RFP ITEM: Engineering Testing Services SELECTION PROCESS During the course of the selection process, all prospective companies are cautioned not to contact School Board members or Selection Committee members or attempt to persuade or promote through other channels. A. The Selection Committee may consist of representatives as follows: 1. Architect/Engineer 2. Project Manager 3. Business Manager and/or Superintendent 4. District Construction Coordinator 5. Licensed Contractor B. The Selection Committee will review all Proposals received on time that are responsive to the solicitation requirements and determine the firms with the highest score using the selection criteria established for the Project. C. The Selection Committee will conduct interviews and receive presentations from the firms with the highest scores, and will establish ratings for each firm in accordance with the scoring criteria established for the Project. Following interviews, firms will be evaluated based on their submission, references, and presentation. D. Each member of the Selection Committee shall rank each Contractor. The results will then be discussed among the Committee. A Contractor will then be selected. E. The Selection Committee shall engage, or authorize one or more persons to engage the highest ranked Finalist in negotiations for the purposes of executing a Contract. In so doing, the Selection Committee shall determine and negotiate compensation that is fair, competitive, and reasonable for the Services to be supplied. Should the School Board or its designee(s) be unable to negotiate a satisfactory contract with the Finalist, at a price the Selection Committee determines to be fair, competitive and reasonable, the Selection Committee shall formally terminate negotiations and then undertake negotiations with the second choice Finalist(s). Failing accord with the second most qualified firm, the Selection Committee shall formally terminate negotiations with such firm(s) and then undertake third choice Finalist(s). Failing accord with the third most qualified firm, the Selection Committee shall formally terminate negotiations with such firm(s) and then under negotiations with the fourth choice. Failing accord with the fourth most qualified firm, the Selection Committee shall formally terminate negotiations with such firm(s) and then under negotiations with the fifth choice. Submit Request for Proposal in a sealed envelope in accordance with instructions contained in the Request for Proposal (RFP). Submittals are to be clearly marked with the RFP number and the firm’s name and address on the outside of the sealed envelope. B. Furnish the number of copies as instructed in the RFP. C. The response shall contain manual signature of an authorized representative of the responding firm. D. Responses received after the receipt time noted in the RFP will not be opened or considered. Proposers of unopened responses will have 14 days to retrieve their responses from the District. Any responses left after such time will be discarded. E. The District is not liable for any costs incurred by the proposers prior to the issuance of an executed contract. Firms responding to the RFP shall be available for presentations and interviews to the District’s Selection Committee. F. The contents of the Request for Proposal of the successful firm may become part of the contractual obligations. G. Request for Proposal shall be typed. All corrections made by the proposer prior to the opening shall be initialed and dated by the proposer. No changes or corrections will be allowed after proposals have been opened. H. Any questions concerning the RFP should be directed in writing to Gordon Vasfaret, Project Manager, G. V. Enterprises via fax 623-872-0877. All requests for information shall be submitted no later than seven (7) days prior to the receipt time noted in the RFP. Only the interpretation or correction so given by the Superintendent or his Project Manager in writing shall be binding and prospective firms are advised that no other source is authorized to give information concerning, or to explain or interpret the RFP and the selection process. All such interpretations and supplemental instructions will be in the form of written Addenda to the RFP. I. The District personnel are not to be contacted prior to the School Board’s decision to approve or reject the District Administration’s recommendation. At the District’s discretion failure to comply with this requirement will be grounds for disqualification. J. Specifically, this NO-CONTACT PERIOD will commence on the initial date of the advertisement for the Request for Proposal and continue through and include the date the FESD Governing Board makes its determination to approve or reject the Selection Committee’s recommendation. K. Failure to meet any of these requirements may disqualify your firm from consideration. L. The respondent may designate a portion of their response as proprietary. The District reserves the right to accept or reject any or all Proposals in the best interest of the District. The FESD Governing Board reserves the right to waive any informality in the selection process. B. The District reserves the right to award the contract to the next most qualified firm if the successful firm does not begin the contracted services within fourteen (14) calendar days of acceptance by the FESD Governing Board, or if an acceptable fee cannot be negotiated. C. Proposals that do not comply with these instructions or that do not include the requested data may not be considered. D. The successful firm shall not discriminate against any person in accordance with Federal, State or local law. E. It is the sole responsibility of the submitting firm to ensure Proposals are received at the proper place on or before the time and date required, and in the format stated. F. RESOLUTION OF THE GOVERNING BOARD OF THE FOWLER ELEMENTARY SCHOOL DISTRICT WHEREAS, the Governing Board of the Fowler Elementary School District has been informed of a recent decision by the Arizona Count of Appeals in Ry-Tan Construction, Inc., v. Washington Elementary School District No. 6, 93 P3d. 1095 (Ariz. App. 2004), wherein the Court held that a contract award immediately created an enforceable contract, binding on the Washington Elementary School District, even though no written contract had as yet been entered into between the parties. The Court found in that case that the intent of the parties to form a contract could be inferred from the circumstances of the award in that case; and WHEREAS, the Governing Board hereby desires to clarify and unequivocally state its intent with respect to making this conditional award under RFP #06-07-09 and WHEREAS, the Governing Board hereby desires to clearly set forth that by making this conditional award it does not intend to enter into an immediate enforceable contract with awardee; that an enforceable contract, if any, will only arise after noted conditions are completely satisfied; that this award and any implied contractual right may be revoked and/or rescinded, without prejudice to the District, until all conditions are met. NOW, THEREFORE, BE IT RESOLVED that: 1. The Governing Board of the Fowler Elementary School District makes a conditional award to ___________________ pursuant to RFP #06-07-09. The award is conditioned upon the following: A. All conditions and requirements in the RFP, including but not limited to, bonding requirements, insurance requirements, and all other required submittals, must be complete, submitted and verified; B. A written contract, insuring the District’s best interest shall be negotiated and fully executed; and 2. It is the Board’s intent that no enforceable contract shall be formed, if at all, until all conditions set forth herein and in the RFP are fully met and verified and until a written contract, which serves the interests of the District, is executed. This award shall remain subject to revocation and/or rescission at the District’s sole discretion, without prejudice to the District, and for any reason until such time as these conditions are met.
