The official decision by Acting Supreme Court Justice John F. Lambert ruling that a fracking moratorium law passed by the Town of Sidney, NY is invalid. The judge did not rule on the legality of the moratorium itself. His ruling found that the way in which the law was passed violated state law that required a super majority to vote in favor (which would have been 4-1). The law enacted was passed with a 3-2 vote, which violated procedure. Therefore, the law was/is invalid. A victory for landowner Inge Grafe-Kieklak who brought the lawsuit.
