You might remember back in 2003 through 2006 when Neighborhood Preservation (NP) would
send Landlords a letter on a property stating a violation that was never witnessed, such as a ten-
ant parking in the yard, and after 10 days, NP would fine the Landlord if a car was found in the
yard again. The tickets started at $116.00 for the first offense and went up to $1,000.00 after the
3rd offense. That's right, one letter and if the violation happened again a year later, someone
parked on the yard, even if it was a different tenant, the Landlord would receive a ticket in the
mail for up to $1,000.00 without warning.
That was the first time Fred McGary called on Landlords, through Landlords Inc., for donations to
fight the city ordinance. The City appealed that case to the Missouri Supreme Court and were de-

After trying to work with Landlords Inc
of Kansas City, following the refusal of
a motion by their attorney, Fred
McGary in June of 2012 formed the
L.L. LEGAL DEFENSE FUND LLC.,
with the mission of hiring some of the
best law firms in Kansas City to fight
city and state, ordinances and statutes,
that violate Landlords (LL) legal rights.
This was done because city council
members decided not listen to Land-
lords in Kansas City, even when they
showed up by the mass, warning them
these types of ordinances would be
implemented in a way that would vio-
late their rights.
The cost to fight each ordinance
through the courts, with a good law
firm, a "super attorney," can cost be-
tween $20,000 and $70,000.00 per or-
dinance. L.L. Legal Defense Fund
LLC., concentrates on the ordinances
that cost Landlord's $1000's of dollars,
like ordinance 78-15.1.
Ordinance 78-15.1 allows KCMO Water
Dept to transfer the water bill from the
tenants name to the property owners
name and to hold the property owner
responsible for the water bill. It does
not matter if the property owner or-
dered the water service on, or used the
water, or any service, but just because
they own the property they are getting
billed, a monthly service fee (which is a
TAX!). The water bill is automatically
reverted into your name, whenever
KCMO Water determines vacancy.
KCMO Water Dept. would not shut off
the water in a timely manner, they don't
want to, so they charge a $100 shut-off
fee, take their time, run up the bill, and
in a month or so, they might get the
water shut-off. When they do finally
shut-off the water, then you are
charged a monthly, service (tax) fee.
Yes, while the water is turned off, paid
$100, then every month while the water
is off the owner receives a $30 or so
tax bill, they call a service fee.
“We have had a couple landlords get a
1st time bill of over $7,000.00, and
many with over $2,000 bills.” –Fred
The policy of KCMO Water department,
according to the Director Terry Leeds,
has always been ‘we do not charge
Landlords for 3rd party bills.’ Which
they do. We have documented this to
his department many times.
In Nov. 2012, the KCMO Water an-
nounced to the public, in writing, they
do not charge Landlords for tenants
water usage. We have documented
they still do. Because as of today, July
2013, they still will transfer the billing
into the Landlords name while the ten-
ant still occupies the property. KCMO
Water has no way to determine legal

KCMO Water monthly fees/taxes alone
total that. However, there are many
other examples of cost: there were two
different Landlords, that got a bill over
$7000.00 on one of their properties
because of this ordinance. There was
another Landlord that had over
$75,000.00 in damages due to water
running down the interior of a 2 Story
residential home, for over a month, be-
fore the property owner was ever noti-
fied. L.L. Legal Defense Fund LLC, has
heard many of the horrible stories and
with financial help they are taking Legal
L.L. LDF LLC, hired Wyrsch, Hobbs,
Mirakian, P.C. with super attorney Ste-
ve Mirakian as the lead attorney. The
city attorney, hired a lawyer from St.

trying to delay the judge’s order, argu-
ing that the court’s decision should be
only for the one named plaintiff, land-
lord, Joe Cangelosi. In rebuttal L.L.’s
lawyer argued that all citizens should
be included in the case. That everyone
knew for over a month, this case was
about all citizens in Kansas City. The
drawn out debate over this issue con-
tinued for over an hour. The St. Louis
attorney drawing out every minute as to
delay the court. Over 40 landlords that
attend court witnessed this when court
lasted till 5 pm. Only about 5 people of
the 40 were left in court at 5 pm. Then

the courts will agree this is an illegal tax. Perhaps not in the county court (16th Circuit.) But, I am
about 90% confident the final decision will be its a tax not voted on.

many remaining issues yet to be ad-
dressed. The Three primary issues are:
-The monthly fee is a tax and should be
stopped and refunded, because it was
never voted on by the people.
-A proper notification letter would give
us advance notification that the water is
going to be transferred into our name, 5
business days, anytime the Water Ser-
vices Dept transfers the water into our
name, vs the current Judges order
which seems to only require notification
after the water is shut off or turned on
at the curb-box, #4. Also we need the
past service fees billed to us, dismiss
for improper notification.
-The shut-off, turn on water fees, are
double billing, because the water being
turned on and turned off, this cost was
already figure in the cost analysis the
Water Co did in the month of Feb and
no mention of fees was recommend by
the city advisers.
However, the most expensive issue
that is left for the court to decide is: The
KCMO Water monthly fee, an illegal tax
that should be stopped and refund-
ed. This will be appealed to the Mo
Supreme Court as the Eastern District
Court of Appeals, as the Western Dis-

What to Expect
Many of our guest and new members are unsure as to what to expect at our monthly meeting.
Where do I go? What should I bring? What happens?
We meet on the First Thursday of the Month at the North
Kansas City Community Center at 1999 Iron Street in North
Kansas City Missouri. This is located almost directly across
the Street from the Police Station on Armour Boulevard. We
also meet on the Second Tuesday of the Month at Career
Education Systems located on the top floor of Ward Parkway
Shopping Center at 8600 Ward Parkway, Kansas City Mis-
You should prepare a bit to attend this meeting. This is a
place to meet people and do deals. So if you offer a product
or service, please bring business cards. Have a property for
sale, bring a stack of flyers or stack of brochures. We have a
general marketing table where all attendees may place a
stack of business cards or brochures or flyers. We also sug-
gest a small notebook to take notes or a new tech tool to take
notes through out the meeting.
So what happens. As you walk in we have a check in table.
MAREI members will need to check their name off the roster
and pull out their name tag and wear it through out the meet-
ing. New members and guests will want to check in at the
registration table and pay their fees.
Note that if you are a first time guest, meaning you have nev-
er attended a MAREI meeting before you can use the FREE
guest registration in this newsletter. If you are a second time
or a third time guest, you will need to pay $25 at the door or
save and register online on our calendar of events for $15.
Any fees that you pay to attend a meeting can be applied
toward a full membership should you join right there at the
meeting that night. We also have a bonus for those joining at
the meeting or in advance of the meeting. We have a box of
assorted books, Audio CDs, and software that all new mem-
bers can select one item out of the box.
After checking in, find our general marketing table and place
your flyers, brochures or what ever it is that you brought with
you. Then work your way around the room and find out what
each and every one of the vendors have to offer. We often
have CDs or Magazines that we give away, so be sure to
look for them.
Next we suggest you take a bit of time and brush up on your
networking skills before you attend a meeting. We have a full
hour from 6 to 7 where attendees can work the room to meet
as many new contacts as possible. Feel free to introduce
yourself to everyone, in fact we highly encourage this.
Be sure to ask one of the check in staff or current members
about benefits of Membership. Members should have pre-
printed name tags and most are willing to share why they are
a member of MAREI. We also have staff at most meetings
that are willing to take you through all of the benefits we have
for our members and answer questions about MAREI.
At 7:00 we start with our meeting announcements. This is
the time we let you know the important things you need to
know about the real estate community as well as upcoming
events. And as time permits we have the Vendors who have
reserved a Vendor Table take 1 minute to tell you about
At 7:15 we take our seats and introduce the guest speaker or
speakers. Our presentation is always an educational presen-
tation, not a sales pitch, where you will have the opportunity
to learn. Our speakers run till 8:30, when we end the presen-
tation and have the speaker available for more one on one

tion does not mean that the meeting is over. We encourage
further, more personal type questions for the speakers.

tion program designed to recognize the high level of
knowledge and professionalism among the designation hold-
ers. It is sponsored and overseen by the National Real Estate
Investors Association, a non-profit trade association serving
the real estate industry.
Why Obtain the PHP Designation?
Only individuals completing the educational requirements will
be permitted to hold themselves out to the public as a
“Professional Housing Provider”. The designee will be recog-
nized in the form of an award certificate, pin, and the right to
use the designation. By having a standardized education in
the topics outlined increase your ability to achieve your goals
in real estate investing.
Further, as National REIA works to increase the visibility of
the PHP designation, individuals who have earned the certifi-
cation are held to a higher standard of credibility when deal-
ing with legal and governmental bodies. It aids legislators in
perceiving educated investors as a larger group for political
action, and in turn, provides our industry with greater legisla-

When attending a MAREI PHP certified training event, at-
tendees must arrive within 5 minutes of the start time to be
issued a PHP Certificate and sign up on the final registration
sheet at the end of the monthly meeting when they turn in
their name tag. Attendance will also be tracked on other
qualifying training events.
Attendees are responsible for keeping track of PHP certifi-
cates and will not be replaced. Attendees are also responsi-
ble for tracking progress towards completion of their PHP
designation. A tracking folder is available for download and at
meetings. Once all courses have been completed, submit
your PHP certificates to the PHP committee for verification of
