INTRODUCTION
 Intellectual Property (IP) refers to the creations of the
mind in the fields of inventions, literary and artistic
works, scientific works, symbols, names and images used in
industry, commerce & communication areas.
 IP is divided mainly into two categories such as Industrial
Property and Copyright & Related Rights.
 Industrial Property includes patent for invention,
industrial design, integrated circuits, utility models,
trade marks etc.
WHAT IS COPYRIGHT ?
 Copyright is a legal right created by the law of a country
that grants the creator of an original work exclusive rights
for its use and distribution.
 This property right can be sold or transferred to others.
 A major limitation on copyright is that copyright protects
only the original expression of ideas, and not the
underlying ideas themselves.
WHAT IS COPYRIGHT ?

COPYRIGHT LAW OF INDIA
 The Copyright Act 1957 (as amended by the Copyright Amendment Act
2012) governs the subject of copyright law in India.
 The Act is applicable from 21 January 1958.
 India is a member of most of the important international
conventions governing the area of copyright law, including the
 Berne Convention of 1886 (as modified at Paris in 1971)
 The Universal Copyright Convention of 1951.
 The Rome Convention of 1961 and the Agreement on Trade Related
Aspects of Intellectual Property Rights (TRIPS).
RIGHTS TO THE AUTHOR
 Copyright law assures ownership, which comes with
several rights, that the author has exclusively. For
example:
 Make copies of the work
 Distribute copies of the work
 Perform the work publicly
 Display the work publicly
 Make derivative works

 Copyright holder may grant permission or license
anyone else to do these things, without affecting
their ownership of the actual copyright in their work.
For example, an author may permit a television
adaptation of their book to be made and broadcast .
KNOW YOUR RIGHTS
 The law provides certain ways in which copyright works
may be used without the need to first obtain
permission from the copyright holder - these include:
 Fair use (e.g. to make copies)
 Public domain
 Library privilege
 Copying for examinations and copying for
instruction
COPYRIGHT PROTECTION
 Copyright covers both published and unpublished works.
 Copyright protection is automatic at the moment the
work is created and fixed in a tangible form that it
is perceptible.
COPYRIGHTABLE WORKS AND IT’S
DURATION (copyright protection
under the Copyright Act 1957)
 Lifetime of the author + sixty years from the beginning of
the calendar year next following the year in which the
author dies.
1. Literary work2. Dramatic work 3. Musical work 4. Artistic work

 Until sixty years from the beginning of the calendar years
next following the year in which the work is first published.
1. Anonymous and pseudonymous works
2. Posthumous work
3. Cinematograph films
4. Sound records
5. Government work
6. Public undertakings
7. International Agencies
8. Photographs
NON – COPYRIGHTABLE WORKS
 Not everything is protected by copyright law.
 Copyright does not protect
 Facts
 Ideas
 Systems or
 Methods of operation.
COPYRIGHT IN BUSINESS
 Copyright covers a whole range of other things which may be of
more practical use to most businesses.
 Examples of things which can be covered by copyright include:
1. The layout and content of your company website
2. Your company’s written marketing materials
3. Any images or videos your company produces
4. Logos
5. Diagrams
6. Instruction manuals
7. Computer programmes
8. Blog articles
THINGS TO KNOW BEFORE USING THE
COPYRIGHT WORKS
 Check who owns it.
 Get a permission to use it.
 Give credit to the creator.
 Buy it (if necessary).
 Use it responsibly.
FAIR USE OF COPYRIGHT WORKS
 Using copyright works without permission or, paying a
fee is called fair use.
 Fair uses of works are;
1. School work and education
2. News reporting
3. Criticising or, commenting
4. Comedy or, parody
CONTD.
 Guide lines of fair use are;
1. Only use a small amount of work
2. Add new meaning to the work to make it original
3. Rework it and use it in a totally and different way
4. Use it for non profit use
CONCLUSION
 A copyright is a form of protection provided by the laws to
authors of "original works of authorship.“
 A copyright holder can prevent others from copying,
performing or otherwise using the work without his or her
consent.
 In general, only the creator of an original work (or someone
to whom the copyright has been lawfully transferred) can
register a copyright.
 Copyright is secured automatically when an original work is
created.
 Artistic, musical, literary, dramatic works, photographs,
sound records etc.. can be copyrightable but, ideas, recipes
etc.. can not be copyrightable.
 We can use of copyrighted works with the consent of author.

  • 2. COPYRIGHT – CONCEPT & USE MANAGEMENT AND ENTREPRENEURSHIP DEVELOPMENT
  • 3. INTRODUCTION  Intellectual Property (IP) refers to the creations of the mind in the fields of inventions, literary and artistic works, scientific works, symbols, names and images used in industry, commerce & communication areas.  IP is divided mainly into two categories such as Industrial Property and Copyright & Related Rights.  Industrial Property includes patent for invention, industrial design, integrated circuits, utility models, trade marks etc.
  • 4. WHAT IS COPYRIGHT ?  Copyright is a legal right created by the law of a country that grants the creator of an original work exclusive rights for its use and distribution.  This property right can be sold or transferred to others.  A major limitation on copyright is that copyright protects only the original expression of ideas, and not the underlying ideas themselves.
  • 7. COPYRIGHT LAW OF INDIA  The Copyright Act 1957 (as amended by the Copyright Amendment Act 2012) governs the subject of copyright law in India.  The Act is applicable from 21 January 1958.  India is a member of most of the important international conventions governing the area of copyright law, including the  Berne Convention of 1886 (as modified at Paris in 1971)  The Universal Copyright Convention of 1951.  The Rome Convention of 1961 and the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS).
  • 8. RIGHTS TO THE AUTHOR  Copyright law assures ownership, which comes with several rights, that the author has exclusively. For example:  Make copies of the work  Distribute copies of the work  Perform the work publicly  Display the work publicly  Make derivative works
  • 9. CONTD.  Copyright holder may grant permission or license anyone else to do these things, without affecting their ownership of the actual copyright in their work. For example, an author may permit a television adaptation of their book to be made and broadcast .
  • 10. KNOW YOUR RIGHTS  The law provides certain ways in which copyright works may be used without the need to first obtain permission from the copyright holder - these include:  Fair use (e.g. to make copies)  Public domain  Library privilege  Copying for examinations and copying for instruction
  • 11. COPYRIGHT PROTECTION  Copyright covers both published and unpublished works.  Copyright protection is automatic at the moment the work is created and fixed in a tangible form that it is perceptible.
  • 12. COPYRIGHTABLE WORKS AND IT’S DURATION (copyright protection under the Copyright Act 1957)  Lifetime of the author + sixty years from the beginning of the calendar year next following the year in which the author dies. 1. Literary work2. Dramatic work 3. Musical work 4. Artistic work
  • 13. CONTD.  Until sixty years from the beginning of the calendar years next following the year in which the work is first published. 1. Anonymous and pseudonymous works 2. Posthumous work 3. Cinematograph films 4. Sound records 5. Government work 6. Public undertakings 7. International Agencies 8. Photographs
  • 14. NON – COPYRIGHTABLE WORKS  Not everything is protected by copyright law.  Copyright does not protect  Facts  Ideas  Systems or  Methods of operation.
  • 15. COPYRIGHT IN BUSINESS  Copyright covers a whole range of other things which may be of more practical use to most businesses.  Examples of things which can be covered by copyright include: 1. The layout and content of your company website 2. Your company’s written marketing materials 3. Any images or videos your company produces 4. Logos 5. Diagrams 6. Instruction manuals 7. Computer programmes 8. Blog articles
  • 16. THINGS TO KNOW BEFORE USING THE COPYRIGHT WORKS  Check who owns it.  Get a permission to use it.  Give credit to the creator.  Buy it (if necessary).  Use it responsibly.
  • 17. FAIR USE OF COPYRIGHT WORKS  Using copyright works without permission or, paying a fee is called fair use.  Fair uses of works are; 1. School work and education 2. News reporting 3. Criticising or, commenting 4. Comedy or, parody
  • 18. CONTD.  Guide lines of fair use are; 1. Only use a small amount of work 2. Add new meaning to the work to make it original 3. Rework it and use it in a totally and different way 4. Use it for non profit use
  • 19. CONCLUSION  A copyright is a form of protection provided by the laws to authors of "original works of authorship.“  A copyright holder can prevent others from copying, performing or otherwise using the work without his or her consent.  In general, only the creator of an original work (or someone to whom the copyright has been lawfully transferred) can register a copyright.  Copyright is secured automatically when an original work is created.  Artistic, musical, literary, dramatic works, photographs, sound records etc.. can be copyrightable but, ideas, recipes etc.. can not be copyrightable.  We can use of copyrighted works with the consent of author.
