Collection Process <ul><li>Debtor will either make payment arrangements, dispute or ignore </li></ul><ul><li>We ask for disputes in writing. </li></ul><ul><li>We submit debtor’s dispute to client with our recommendations </li></ul><ul><ul><li>Suit or no suit </li></ul></ul><ul><ul><li>Client’s decision to sue or write-off </li></ul></ul>

Legal Process <ul><li>Suit is recommended </li></ul><ul><li>Costs received –Summons and Complaint prepared and filed with Court </li></ul><ul><li>Defendant served with papers. </li></ul><ul><li>If answer filed by defendant, discovery period begins and we await trial date </li></ul><ul><li>If counterclaims, client may choose to have in-house counsel handle the defense or we can handle on an hourly fee. </li></ul><ul><li>If no answer, we petition the Court for entry of default judgment. </li></ul><ul><li>Judgment—ultimately entered. </li></ul>

Post Judgment Remedies <ul><li>Liens: Liens are placed on known properties owned by debtor. </li></ul><ul><li>Property Execution: Sent to Sheriff/Marshal to levy at debtor’s place of business, financial institutions or to proceed with the sale of any property and/or known assets. </li></ul><ul><li>Income Execution: Sent to Sheriff/Marshal to proceed with wage garnishment. </li></ul><ul><li>Information Subpoenas: Sent to financial institutions, landlords, employers, debtor’s customers and suppliers in effort to obtain information on debtor’s assets and/or credit information. </li></ul>
