JOHN DOE, Defendant. / COMPLAINT FOR INJUNCTIVE RELIEF AND DAMAGES PIaintiff, IGLESIA DE DIOS MINISTERIAL DE JESUCRISTO INTERNACIONAL (“IDMJI” or “Plaintift”), a Colombia corporation, by and through its undersigned counsel, hereby sues JOHN DOE, an individual (“Defendant”), and alleges: Nature of Suit This is an action at law brought under the Copyright Act to remedy acts of copyright infringement, and to prevent further acts of copyright infringement, caused by Defendanfis unauthorized reproduction, distribution and publication on YouTube of a vídeo owned by IDMJ l. After IDMJ I provided YouTube with a takedown notice under the applicable provisions of the Digital Millennium Copyright Act (“DMCA”), Defendant supplied a counter-notice to YouTube; however, the counter-notice was replete with false and misleading information. Subiect Matter J urisdiction and Venue l. This Court has subject matter jurisdiction over this action under 28 U. S.C. 55 i331 and 1338(a). 2. Venue is proper in the Southem District of Florida because (i) PlaintifFs church maintains a significant presence in Broward County, Florida, (ii) the Plaintiff’ s co-founder and officer resides in Broward County, Florida, and (iii) upon information and belief, the Defendant may be a resident of Broward County, Florida. ’ The Parties 3. Plaintiff, IDMJI, is a Colombia corporation, located in Bogota, Colombia, which operates as a Christian church (the “Church”). Beginning with a single location in Bogota in i972, the Church has now expanded to over 500 locations globally, including locations in Broward County, Florida. 4. Defendant, John Doe, is an unknown person who, as described below, intentionally and knowingly submitted false and misleading information in a DMCA counter-notice to YouTube. General Facts The Video 5. In May i996, Hermano Luis, one of the founders of the Church, passed away. 6. Hermano Luis’s funeral, which was held in Bogota on or about May 9, 1996, was videotaped by IDMJ I for archival, documentary and/ or historical purposes (the “Video”). ' Due to Defendanfs provision of false information concerning his/ her address, Plaintiiï cannot be certain that Defendant is a resident of Broward County Florida; however, due to Plaintiffis significant presence in Broward County, Plaintiff believes that Defendant may be n Broward County resident. The Video, which is approximately 57 minutes long and is entitled “FUNERAL HERMANO LUIS 1996”, was produced entirely by IDMJI, and is the original work of IDMJI. Screenshots of the Video are attached to this Complaínt as Exhibit “A". 8. IDMJI owns all rights in and to the Video; no third party has any owner-ship rights in the Video whatsoever. 9. IDMJI possesses all Iicensing rights in and to the Video; no third party has any licensíng rights in the Video except for those limited rights expressly granted to such party by IDMJ l. 10. The Video has never been “published” as that term is defined under the Copyright Act (l7 U. S.C 5 101) because copies of the Video have never been offered to the public by sale or other transfer of ownership, or by rental, lease, or lending. li. Over the years, IDMJI has provided a small number of copies of the Video to Hermano Luis’s family members and to certain officials in the Church (collectively, “Licensees”), granting the Licensees a limited, non-exclusive license to view the Video. l2. The Church has never authorized the Vídeo to be rca-distributed, re-publíshed, disseminated or displayed to the public by any of the Licensees. 13. The Vídeo is a foreign work, protected in the United States under 17 U. S.C. Q lO4(b)(2) pursuant to the Berne Convention. l4. Registration of the Video with the copyright office is not a prerequisite to filing a claim for copyright infringement under 17 U. S.C Q 4l l(a) because the Video is not a United States work. YouTubecom (“YouTube”) is a popular website that allows its users to instantly upload, search and view millions of videos. YouTube receives over l billion unique user visits every month. ln order to upload and share content, YouTube requires its users to create a YouTube account. Anyone can create an account, log in to that account, and start uploading content with in minutes. 16. Upon infomiation and belief, Defendant created an account on YouTube and, using that account, intentionally uploaded the Video to YouTube. By Uploading the Video to YouTube, Defendant (i) caused the Video to be copied to YouTube’s servers, and (ii) made the Video available for display and viewing by millions ofvisítors to YouTube. 17. Defendant was not authorized by IDMJi to upload the Video to YouTube, nor was Defendant authorized to make the Video available for display to any third party. Defendant Submits False & Misleading Information to YouTube 18. In or about April 16, 2014, IDMJI discovered that the Video was uploaded to YouTube, and immediately sent a “take down notice” to YouTube pursuant to Section S12 of the DMCA. l9. A few days later, Defendant submitted a “counter-notice” to YouTube (the “Counter-Notice”) , requesting that the Vídeo be rca-posted by YouTube. 20. In the Counter-Notice, Defendant claimed to be someone named “Stev Vaccaro”, with an address of 909 3'“ Avenue, New York, New York 10022. Defendant provided a contact telephone number of 212-9094209. The address provided by Defendant is a thirty-three story commercial office building in Manhattan, and upon infonnation and belief, there is no tenant at that location with the name “Stev Vaccaro. ” 22. The telephone number submitted by Defendant is a non-working number. 23, Despite the fact that Defendant submitted false and misleading information to YouTube in the Counter-Notificatíon, YouTube requires IDMJI to commence litigation against Defendant in order to keep the Video offline. 24. if this litigation was not brought by Plaintiff, the Video would be re»posted by YouTube, and Plaintiff would continue to suffer damages due to the unauthorized publication and dissemination of the Video. Conditions Precedent and Attorneys’ F ees 25. All conditions precedent to the bringing and maintenance of this action have been performed, waived, or have occurred. 26. IDMJI has retained the undersigned law firm to represent it ín this action and is obligated to pay undersigned counsel a reasonable fee for their services. COUNT I Direct Copyright Infringement Under 17 U. S.C. fi 501 {Unauthorized Copying of the Video by Defendant) 27. The allegations contained in paragraphs l-26 above are hereby re-alleged as if fully set forth herein. 28. Registration of the Video with the United States Copyright Office is not a prerequisite to filing a claim for copyright infringement under l7 U. S.C. Without lDMJl’s authorization or approval, Defendant knowingly, intentionally and willfully uploaded the Video to YouTube causing the Video to be re-copied on to YcuTube’s servers, in Violation of lDMJl’s exclusive rights in the Video. 30. IDMJI has been and will likely continue to be damaged by Defendant’s Violation of its rights. 3l. Upon infonnation and belief, as a result of his conduct, Defendant has realized and continues to realize profits or other benefits rightly belonging to lDMJl. COUNT II Direct Copyright Infringement Under 17 U. S.C. fi 501 (Llnauthorized Publication of the Video by Defendant] 32. The allegations contained in paragraphs I-26, and 28-31 above are hereby re- alleged as if fully set foi-th herein. 33. Without lDMJl’s authorization or approval, Defendant knowingly, intentionally and willfully uploaded the Video to YouTube causing the Video to be capable of being displayed, and actually displayed, through YouTube in Violation of IDMJl’s exclusive rights in the Video. 34. IDMJ l has been and will likely continue to be damaged by Defendanfs Violation of its rights. 35.
