  3. 3. 3 1 ABOUT THIS APPENDIX (a) This appendix sets out the terms of the Optus Fusion, Optus ‘yes’ Fusion, Optus ‘yes’ Fusion Lite and Optus ‘yes’ Fusion Plus Offers. (b) The meaning of the words printed like this is set out in this appendix, at the end of the service description for the relevant service or in the consumer terms. (c) This appendix is to be read in conjunction with the service description for each relevant service and the consumer terms. (d) The Optus Fusion Offer, Optus ‘yes’ Fusion Offer (the Optus Fixed ‘yes’ Fusion Offer), Optus ‘yes’ Fusion Lite and the Optus Wireless ‘yes’ Fusion Offer and Optus ‘yes’ Fusion Plus Offer are collectively referred to in this Appendix, unless the context requires otherwise, as the Optus Fusion Offers. 2 WHAT ARE THE OPTUS FUSION OFFERS? (a) The Optus Fusion Offers are made up of the following offers: (i) The Optus Fusion Offer and the Optus ‘yes’ Fusion Offer, together the Optus Fixed ‘yes’ Fusion Offer; (ii) The Optus ‘yes’ Fusion Lite Offer; (iii) The Optus Wireless ‘yes’ Fusion Offer; (iv) The Optus ‘yes’ Fusion Plus Offer; and (v) The Optus Family Value Pack Offer, which are specials offered under the consumer terms and relevant service descriptions. (b) The Optus Fusion Offers are governed by the terms in this appendix and, to the extent that the terms are not inconsistent with the terms set out in this appendix, by the terms of the consumer terms, and each relevant service description and standard pricing table. 3 WHAT DO THE OPTUS FUSION OFFERS ALLOW YOU TO DO? (a) The Optus Fixed ‘yes’ Fusion Offers, including Optus ‘yes’ Fusion Lite allow you to combine: (i) Your Optus Broadband Service; being either: (A) The Optus Cable Service; or (B) The Optus DSL Direct Service Optus Fusion Offer – Appendix I - Part E (SFOA) 25 April 2010
  4. 4. 4 with (ii) Your ‘Home Phone Service’ being either: (A) The Optus Local Service and Optus Long Distance Service (if combined with the Optus Cable Service); or (B) The Optus Local Direct Service and Optus Long Distance Service (if combined with the Optus DSL Direct Service); and in return for paying a fixed monthly charge you receive included value for the services in the bundle. (b) The Optus Wireless ‘yes’ Fusion Offer allows you to combine your Optus Wireless Services being your Optus Wireless Broadband Service with your Optus Wireless Telephony Service and Optus Long Distance Service, and in return for paying a fixed monthly charge you receive included value for the services in the bundle. (i) If you connected between 31 March 2008 and 26 January 2009, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer: (A) The Optus Wireless ’yes’ Fusion $79 Plan with 2GB data allowance and other benefits offered for a $79 monthly charge; (B) The Optus Wireless ‘yes’ fusion $89 Plan with 7GB data allowance and other benefits offered for a $89 monthly charge; and Charges for the Optus Wireless yes’ Fusion $79 2GB and the Optus ‘yes’ Fusion $89 7GB pricing plans are set out in clause 6 and Table 4 below. (ii) If you connected between 27 January 2009 and 4 June 2009, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer: (A) The Optus Wireless ’yes’ Fusion $89 Plan with 2GB data allowance and other benefits offered for a $89 monthly charge; Optus Fusion Offer – Appendix I - Part E (SFOA) 25 April 2010

(iii) If you connect on or after 5 June 2009, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer: (A) The Optus Wireless ‘yes’ Fusion $79 Plan with 2GB data allowance and other benefits offered for a $79 monthly charge; (B) The Optus Wireless ‘yes’ Fusion $99 Plan with 7GB data allowance and other benefits offered for a $99 monthly charge; Charges for the Optus Wireless ‘yes’ Fusion $79 2GB and the Optus Wireless ‘yes’ Fusion $99 7GB pricing plans are set out in clause 6 and Table 6 below. (c) Optus Fixed ‘yes’ Fusion Offer: (i) If you connected prior to 2 December 2007, the following three pricing plans are offered under the Optus Fusion Offer: (A) The Optus Fusion $69 Plan with 2GB data allowance and other benefits offered for a $69 monthly charge; (B) The Optus Fusion $89 Plan with 7GB data allowance and other benefits offered for a $89 monthly charge; and (C) The Optus Fusion $99 Plan with 20GB data allowance and other benefits offered for a $99 monthly charge. Charges for the Optus ‘yes’ Fusion $79, the Optus ‘yes’ Fusion $89 and the Optus ‘yes’ Fusion $99 pricing plans are set out in clause 6 and Table 2 below. (iii) If you connect between 7 September 2008 and 19 September 2009, the following pricing plans are offered under the Optus ‘yes’ Fusion Offer: (A) The Optus ’yes’ Fusion $79 Plan with 4GB data allowance and other benefits offered for a $79 monthly charge; (B) The Optus ‘yes’ fusion $89 Plan with 10GB data allowance and other benefits offered for a $89 monthly charge; and (C) The Optus ‘yes’ Fusion $99 Plan with 20GB data allowance, unlimited calls to any Australian GSM mobile and other benefits offered for a $99 monthly charge. (iv) If you connect between 20 September 2009 and 24 April 2010 , the following pricing plans are offered under the Optus ‘yes’ Fusion Offer: (A) The Optus ’yes’ Fusion $79 Plan with 4GB data allowance and other benefits offered for a $79 monthly charge; (B) The Optus ‘yes’ Fusion $89 Plan with 10GB data allowance and other benefits offered for a $89 monthly charge; (C) The Optus ‘yes’ Fusion $99 Plan with 20GB data allowance, unlimited calls to any Optus GSM mobile and other benefits offered for a $99 monthly charge; (D) The Optus ‘yes’ Fusion $109 Plan with 20GB data allowance, unlimited calls to any Australian GSM mobile and other benefits offered for a $109 monthly charge; and (E) The Optus ‘yes’ Fusion $129 Plan with unlimited data allowance unthrottled up to 30GB (once your data usage reaches 30GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited calls to any Australian GSM mobile and other benefits offered for a $129 monthly charge. (d) If you connect between 1 November 2009 and 24 April 2010, the following pricing plan is offered under the Optus ‘yes’ Fusion Offer to new and existing residential customers only: (A) The Optus ‘yes’ Fusion $149 Plan with unlimited data allowance unthrottled up to 30GB (once your data usage reaches 30GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited calls to any Australian GSM mobile and a ‘PlayStation3 pack’, as well as other benefits offered for a $149 monthly charge. (B) “PlayStation3 pack” contains a PlayStation 3 console, 2 HD BluRay Movie Discs, Singstar PS3 game with 2 wired microphones and a BluetoothTM keyboard (BluetoothTM keyboard available until 14 January 2010). The BluetoothTM keyboard may be delivered separately and delivery may take up to 30 days from activation. Charges for the Optus ‘yes’ Fusion $149 pricing plans are set out in clause 6 and Table 4 below. Charges for the Optus ‘yes’ Fusion $79, the Optus ‘yes’ Fusion $89, the Optus ‘yes’ Fusion $99 , the Optus ‘yes’ Fusion $109, and Optus ‘yes’ Fusion $129 pricing plans are set out in clause 6 and Table 5 below. (e) Optus ‘yes’ Fusion Lite Offer (i) If you connect between 15 February 2009 and 19 April 2009, or between 17 May 2009 and 24 April 2010 the following pricing plan is offered under the Optus ‘yes’ Fusion Lite Offer: (A) The Optus ‘yes’ Fusion Lite $49 Plan with 1GB data allowance and other benefits offered for a $49 monthly charge and $100 upfront plan joining fee.   15. 15. 15 4 AVAILABILITY AND GENERAL ELIGIBILITY REQUIREMENTS 4.1 Availability (a) You can only apply for one Optus Fixed ‘yes’ Fusion Offer, Optus Fixed ‘yes’ Fusion Lite Offer, Optus Wireless ‘yes’ Fusion Optus ‘yes’ Fusion Plus Offer or Optus Family Value Pack on your account. (b) For the Optus Fixed ‘yes’ Fusion Offer: (i) The Optus Fusion offer was available until 2 December 2007. (ii) The Optus ‘yes’ Fusion Offer is available from 3 December 2007. (iii) The Optus ‘yes’ Fusion Lite offer is available from 15 February 2009 to 19 April 2009, or between 17 May 2009 and 24 April 2010. (c) The Optus Wireless ‘yes’ Fusion Offer commenced on 31 March 2008 and, Optus Wireless ‘yes’ Fusion is only available to new customers via selected channels at Optus’ discretion. (d) The Optus ‘yes’ Fusion Plus Offer is available from 7 September 2008. (b) If you already have a non-fixed length or fixed length agreement with us for either your Home Phone Service; your Broadband Service or your Optus Wireless Service, and you choose to connect as a new customer (as the case may be) to our Home Phone Service; our Broadband Service or our Optus Wireless Service, (i) we may agree (at our discretion) to transfer you to (A) one of the Optus Fusion Plans if you connected before 2 December 2007; or (B) one of the Optus ‘yes’ Fusion Plans if you connect on or after 3 December 2007; or (C) one of the Optus Wireless ‘yes’ Fusion Plans, if you connect on or after 25 March 2008; and (ii) in the case of (A) and (B) above for the Optus Fixed ‘yes’ Fusion Offer, you will start a 24 month minimum term fixed length agreement for the new Service; Optus Fusion Offer – Appendix I - Part E (SFOA) 25 April 2010

(c) If you already have a non-fixed length or fixed length agreement with us for either your Home Phone Service; your Broadband Service or your Optus Post-Paid GSM Mobile Service, and you choose to connect as a new customer (as the case may be) to our Home Phone Service; our Broadband Service or our Optus Post- Paid GSM Mobile Service, we may agree (at our discretion) to transfer you to one of the Optus ‘yes’ Fusion Plus Plans if you connected between 7 September 2008 and 19 September 2009. You will start a 24 month minimum term fixed length agreement for the new Service(s). (d) The Optus Fusion Offers are not available with other Optus ‘yes’ rewards such as Free Calls, ‘yes’ Data or the OptusOne Offer. (e) Any other specials we offer only apply to your Optus Fusion Offers if we specifically say so. (f) If you connect to the Optus Fusion $99 plan, Optus ‘yes’ Fusion $99 Plan, Optus ‘yes’ Fusion $109 Plan or Optus ‘yes’ Fusion $129 Plan or Optus ‘yes’ Fusion $149 Plan and receive a wireless modem, you will be required to remain on that plan for 3 consecutive billing months from the time you receive the wireless modem. If you move to a plan lower than the ‘yes’ Fusion $99 plan within 3 months of commencing your plan, you will be charged a fee of $140 for the cost of the wireless modem. (g) If you connect to the Optus ‘yes’ Fusion $79 or $89 Plan and receive a standard modem, you will be charged a fee of $49 for the cost of the standard modem if you move onto the Optus ‘yes’ Fusion Lite plan within 3 months of receiving the standard modem. (h) If you connect to the Optus ‘yes’ Fusion $99, $109, $129 or $149 Plan and receive a WiFi modem, you will be charged a fee of $140 for the cost of the WiFi modem if you move onto the Optus ‘yes’ Fusion Lite plan within 3 months of receiving the WiFi modem. (iv) From one pricing plan to another within the Optus Wireless ‘yes’ Fusion Offer; (v) From your Optus Fusion or Optus ‘yes’ Fusion Offer to Optus ‘yes’ Fusion Plus Offer; or (vi) From one pricing plan to another within the Optus ‘yes’ Fusion Plus Offer; (vii) From Optus ‘yes’ Fusion to Optus ‘yes’ Fusion Lite, however a $100 plan joining fee will be charged and the additional charges set out in paragraphs 4.2(g) and 4.2(h) may apply to existing customers migrating from other Fusion plans; (viii) From one pricing plan to another within the Optus ‘yes’ Family Cap, ‘yes’ Family Cap + MIP, and ‘yes’ Family Cap iPhone plans, but you may be charged a plan change fee to do so and must meet the eligibility criteria for your new plan. at our discretion, provided that the minimum term of your agreement remains unchanged. You can only move once per billing month, either upgrading or downgrading plans. 4.3 What happens if you are no longer eligible or if one or both of the services in your Optus Fusion Offer is cancelled (a) If you are no longer eligible for your Optus Fusion Offers because you cancel one or both of the services before the end of the minimum term, you will be charged a cancellation fee calculated in accordance with clause 4.3(j) below (as relevant) and your remaining services if any will be transferred to a ‘default pricing plan’ as described in clauses 4.3(b) to (i) below. (b) If the Optus Local Service is cancelled the default pricing plans for your remaining services are: (i) For the Optus Broadband service, (A) the Optus Easy Start plan ($29.95 per month and 100MB data allowance) if disconnection is prior to 10 September 2007; (B) the Optus MyHome Starter plan ($34.99 per month and 200MB data allowance) if Optus Fusion Offer – Appendix I - Part E (SFOA) 25 April 2010

(l) If you as a new customer signed up to the Optus Fusion offer on a minimum term of 24 months and you cancel one or more of the relevant services before the end of the minimum term, you must pay us a cancellation fee calculated as follows: (i)If one of the Home Phone Services is cancelled, a tiered cancellation fee of $199 pro-rated according to the proportion of days remaining in the 24 month minimum term at the cancellation date; and if the Optus Broadband Service (excluding $149 ‘yes’ Fusion plan) is cancelled a cancellation fee of $300, pro-rated according to the proportion of months remaining in the 24 month minimum term at the cancellation date; and (ii)For $149 ‘yes’ Fusion plan, if one of the Home Phone Services is cancelled, a tiered cancellation fee of $199 pro-rated according to the proportion of days remaining in the 24 month minimum term at the cancellation date; and if the Optus Broadband Service is cancelled a cancellation fee of $800, pro-rated according to the proportion of months remaining in the 24 month minimum term at the cancellation date; and (iii)If the ‘yes’ Fusion Plus Optus Post-Paid GSM Mobile Service is cancelled a tiered cancellation fee will be calculated based on when during your 24 month minimum term the Optus GSM Service is cancelled, as follows: (A) For Optus ‘yes’ Fusion Plus 20 (mobile) Plan When Cancelled During the first 12 months – Initial Cancellation Fee Months 13 – 15 (80% of Initial Cancellation Fee) Months 16 – 18 (60% of Initial Cancellation Fee) Months 19 – 21 (40% of Initial Cancellation Fee) Months 22 – 24 Optus Fusion Offer – Appendix I - Part E (SFOA) 25 April 2010
