  4. 4. A.Equal Opportunity forEmployment/ Compensation/Benefits/ and Privileges No disabled person shall be deniedaccess to opportunities for suitableemployment. A qualified disabled employeeshall be subject to the same terms andconditions of employment and the samecompensation, privileges, benefits, fringebenefits, incentives or allowances as aqualified able-bodied person. (1st par. OfSEC. 5, RA No. 7277)

Employment Reservation toPWDs Five percent (5%) of all casual,emergency and contractualpositions in the Department ofSocial Welfare and Development;Health Education, Culture andSports; and other governmentagencies, offices or corporationsengaged in social development shallbe reserved for disabled persons.(2nd par. Of SEC. 5, ibid.)

Providing ShelteredEmployment for PWDs If suitable employment for disabledpersons cannot be found through openemployment as provided in theimmediately preceding Section, the Stateshall endeavor to provide it by means ofsheltered employment. In the placementof disabled persons in shelteredemployment, it shall accord due regard tothe individual qualities, vocational goalsand inclinations to ensure a goodworking atmosphere and efficientproduction. (SEC. 6, ibid.)
  7. 7. D. Giving Incentives forEmployers who employPWDs(SEC. 8, ibid.) (a) To encourage the activeparticipation of the private sector inpromoting the welfare of disabledpersons and to ensure gainfulemployment for qualified disabledpersons, adequate incentives shallbe provided to private entitieswhich employ disabled persons

(b) Private entities that employdisabled persons who meet therequired skills or qualifications,either as regular employee,apprentice or learner, shall beentitled to an additional deduction,from their gross income, equivalentto twenty-five percent (25%) of thetotal amount paid as salaries andwages to disabled persons:Provided, however, that suchentities present proof as certified bythe Department of Labor andEmployment that disabled personsare under their employ
  9. 9. . Provided, further, that thedisabled employee isaccredited with theDepartment of Labor andEmployment and theDepartment of Health as to hisdisability, skills andqualifications.
  10. 10. E. Establishing Vocational Rehabilitation for PWDsthe state shall take appropriatevocational rehabilitationmeasures that shall serve todevelop the skills and potentialsof disabled persons and enablethem to compete favorably foravailable productive andremunerative employmentopportunities in the labormarket.
  11. 11. The State shall also takemeasures to ensure the provisionof vocational rehabilitation andlivelihood services for disabledpersons in the rural areas. Inaddition, it shall promotecooperation and coordinationbetween the government andnongovernmental organizationsand other private entitiesengaged in vocationalrehabilitation activities.
  12. 12. The Department of Social Welfareand Development shall design andimplement training programs thatwill provide disabled persons withvocational skills to enable them toengage in livelihood activities orobtain gainful employment shalllikewise design and conduct trainingprograms geared towards providingdisabled persons with skills forlivelihood.
  13. 13. EducationAccess to Quality EducationThe State shall ensure thatdisabled persons areprovided with adequateaccess to quality educationand ample opportunities todevelop their skills.
  14. 14. The State shall take intoconsideration the specialrequirements of disabled persons inthe formulation of educationalpolicies and programs. It shallencourage learning institutions totake into account the special needsof disabled persons with respect tothe use of school facilities, classschedules, physical educationrequirements, and other pertinentconsideration.
  15. 15. The State shall alsopromote the provision bylearning institutions,especially higher learninginstitutions, of auxiliaryservices that will facilitatethe learning process fordisabled persons.
  16. 16. B. Assistance to Disabled Students(SEC. 13, ibid.)-financial assistance to economicallymarginalized but deserving disabledstudents pursuing post secondary ortertiary education.-five percent (5%) of the allocationfor the Private Education StudentFinancial Assistance Programcreated by virtue of R.A. 6725 shallbe set-aside for disabled studentspursuing vocational or technical anddegree courses.

Special Education- a complete, adequate andintegrated system of specialeducation for the visually impaired,hearing impaired, mentally retardedpersons and other types ofexceptional children in all regions ofthe country.- establish special education classesin public schools in cities, ormunicipalities.- Braille and Record Libraries inprovinces, cities or municipalities.
  18. 18. -The National Governmentshall allocate fundsnecessary for the effectiveimplementation of thespecial education programnationwide. - Local Government unitsmay likewise appropriatecounterpart funds tosupplement national funds.
  19. 19. D. Vocational or Technical andOther Training Programs (SECTION 15, ibid.) The State shall provide disabledpersons with training in civics, vocationalefficiency, sports and physical fitness, andother skills.-establish in at least one government-owned vocational and technical school inevery province ; a special vocational andtechnical training program for disabledpersons.
  20. 20. A. Providing Rehabilitation Centers for PWDs (SEC. 19, ibid.)The Department of Health shallestablish medical rehabilitationcenters in government provincialhospitals, and shall include in itsannual appropriation the necessaryfunds for the operation of suchcenters.
  21. 21. -formulate and implement aprogram to enablemarginalized disabledpersons to avail of freerehabilitation services ingovernment hospitals.
  22. 22. B. Rendering Health Services forPWDs(SEC. 20, ibid.) The State shall protect andpromote the right to health ofdisabled persons and shall adoptan integrated andcomprehensive approach totheir health development, whichshall make essential healthservices available to them ataffordable cost.
  23. 23. AN INTEGRATED HEALTHSERVICE FOR PWDS:A.PREVENTION, DETECTION AND EARLY INTERVENTION;B.MEDICAL TREATMENT AND REHABILITATION
  24. 24. A.Auxiliary Social Services (SEC. 21, ibid.)marginalized PWDS areprovided with necessaryauxiliary services that willrestore their functioning andparticipation in communityaffairs.
  25. 25. DSWD shall develop andimplement programs onauxiliary social servicesthat respond to theneeds of marginalizeddisabled persons.
  26. 26. a) Assistance in the acquisition of prosthetic devices and medical intervention of specialty services;(b) Provision of specialized training activities designed to improve functional limitations of disabled persons related to communication skills;
  27. 27. (c) Development among disabledpersons a positive-self-imagethrough the provision of counseling,orientation and mobility andstrengthening daily livingcapability;(d) Provision of family care servicesgeared towards developing thecapability of families to respond tothe needs of the disabled membersof the family;
  28. 28. (e)Provision of substitute family care services and the facilities therefore for abandoned, neglected, abused and unattached disabled persons who need custodial care;(f)Provision of after care and follow- up services for the continued rehabilitation in a community- based setting of disabled persons who were released from residential care or rehabilitation centers; and
  29. 29. ( g) Provision of day care services for disabled children of pre-school age.
  30. 30. A.Broadcast Media (SEC. 22, ibid.) Television stations shall beencourage to provide a signlanguage inset or subtitles in atleast one (1) newscast program aday and special programs coveringevents of national significance
  31. 31. B. Telephone Services(SEC. 23, ibid.) All telephone companies shall beencouraged to install specialtelephone devices or units for thehearing-impaired and ensure thatthey are commercially available toenable them to communicatethrough the telephone system.
  32. 32. C. Free Postal Charges for theDisabled (SEC. 24, ibid.)Postal charges shall be free onthe following:(a)Articles and literatures likebooks and periodicals, orthopedicand other devices, and teachingaids for the use of the disabledsent by mail within thePhilippines and abroad; and
  33. 33. (b) Aids and orthopedic devices forthe disabled sent abroad by mailfor repair,
  34. 34. A. Barrier-Free Environment (SEC. 25, ibid.)- attainment of a barrier-free environment ;- access in public and private buildings andestablishments and such other placesmentioned in Batas Pambansa Bilang 344,otherwise known as the “Accessibility Law;- Gov’t to allocate funds for accessprovision in all government buildings;

Mobility/PWDs Privilege toDrive Motor Vehicles ( SEC. 26, ibid.)Disabled persons shall be allowed todrive motor vehicles, subject to therules and regulations issued by theland Transportation Office pertinentto the nature of their disability andthe appropriate adaptations ormodifications made on suchvehicles.
  36. 36. A.System of Voting (SEC. 29, ibid.)Disabled persons shall be allowed tobe assisted by a person of his choicein voting in the national or localelections.
  37. 37. Polling places shouldbe made accessible todisabled personsduring national or localelections.
  38. 38. B. Right to Assemble (SEC. 30, ibid.)the right of disabled persons toparticipate in processions,rallies, parades, demonstr-ation, public meetings, andassemblages or other forms ofmass concerned action held inpublic.
  39. 39. Organizations OF PWDsshall be encouraged toparticipate in the planning,organization andmanagement ofgovernment programs andprojects for disabledpersons.
  40. 40. participate in theidentification and preparationof programs that shall serveto develop employmentopportunities for the disabledpersons.
  41. 41. PROHIBITION ON DISCRIMINATION AGAINST DISABLED PERSONSDiscrimination on EmploymentDiscrimination on TransportationDiscrimination on the Use of PublicAccommodations and Services
  42. 42. SECTION 37. Use of GovernmentRecreational or Sports CentersFree of Charge. – Recreational orsports centers owned oroperated by the Governmentshall be used, free charge, bymarginalized disabled personsduring their social, sports orrecreation activities. (Ibid.)
  43. 43. SECTION 39. HousingProgram. – The NationalGovernments shall take intoconsideration in its nationalshelter program the specialhousing requirements ofdisabled persons

  45. 45. DELIVERANCE FROM RIDICULE- an act of making fun orcontemptuous imitating ormaking mockery of personswith disability whether inwriting, or in words, or inaction due to theirimpairment/s.
  46. 46. Deliverance from Vilification(a)The utterance of slanderous and abusive statements against a person with disability; and/or(a)An activity in public which incites hatred towards, serious contempt for, or severe ridicule of persons with disability."
