Harry Pelham Heslop failed to create enough jobs for his EB-5 investment (only 2) so he failed to have conditions lifted under INA 216A. Instead of departing the U.S., he married a citizen and then became a conditional resident as a spouse. He did not file an I-751 to lift conditions under INA 216.
