I am confused by this N-470 Denial (Appeal Dismissal). He became an LPR on September 15, 2010. He crossed into Canada and returned On June 1, 2011. As there are no other departures listed, he completed a new one-year of physical presence on May 31, 2012. The statute and precedent don't demand a continuous period IMMEDIATELY after becoming an LPR. He then was transferred overseas in June 2012 (exact date is not specified). His exact departure date is not given but if it was on or after May 31, 2012, he was safe to depart and still qualify especially since he applied (filed his N-470) on July 11, 2012. That was prior to the passage of one year as required. Why exactly was this denied? And why was the Appeal Dismissed? I remain confused. How about you?
