Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law The Qur’an and Women • Surah 2:228 – “Women shall have rights similar to the rights against them, according to what is equitable; but men shall have a degree over them.” • Surah 4:11 – “To the male a portion equal to that of two females.” • Surah 2:282 – “Get two witnesses out of your own men, and if there are not two men, then a man and two women such as you choose, for witnesses.” • Surah 4:3 – Men may marry two, three or four wives. Muhammad had special dispensation to marry as many women as he wished. – Muhammad married Aisha at age six, consummated marriage age nine. Gave his own daughter Fatima in marriage to Ali at age twelve. 5

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law The Hadith and Women • Hadith 1268 – “The prophet used to visit all his wives in an hour round, during the day and night and they were eleven in number… the prophet was given the strength of thirty men.” • Hadith (three occasions) – Muhammad said “I was shown the Hell-fire and that the majority of its dwellers are women.” – “Bad omen is in the women, the house and the horse… after me I have not left any affliction more harmful to men than women.” • Hadith 3826 – “Muhammad asked some women, ‘Isn’t the witness of a woman equal to half that of a man?’ The woman said ‘Yes.’ He said, ‘That is because of the deficiency of the woman’s mind.’” 6

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Muhammad’s Special Marriages • From the Hadith (recited by Abu Umama) – Muhammad had super-normal marriages – After his flight to heaven, Muhammad told Khadija at her death bed “Oh, Khadija, know that God has wedded me to Mary, Christ’s mother in paradise.” • Muhammad repeated this to Aisha – “Oh, Aisha, didn’t you know that God Almighty in heaven wedded me to Mary the daughter of Imran, to Kulthum, Moses’ sister, and to Assiya, wife of the Pharaoh.” 7

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Role of the Wife in Islam • Surah 3:14 – “Fair in the eyes of men is the love of things they covet: women and sons; heaped up hoards of gold and silver.” • Surah 66:5 – “It may be, if he divorced you that Allah will give him in exchange consorts better than you.” – A man can threaten divorce if his wife is not meeting his sexual needs. • Hadith, attributed to al Hakem – “Wives are playthings, so take your pick.” • A man may marry a woman who is not Muslim – But Muslim woman may not marry outside Islam. See Surah 5:5 8

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Sex and Marriage • Surah 2:223 – “Your wives are as a tilth (field to be plowed) unto you, so approach your tilth when and how you will.” • Surah 4:43 and Surah 5:6: Women are by nature unclean – A man may not touch a woman before prayer (some say this reference is to sexual contact, not skin contact) • Comment by Ali (Qur’an commentary) – “Sex is not a thing to be ashamed of, or to be treated lightly, or to be indulged in to excess…. We must never forget our souls, and that we are responsible to Allah.” “It was the carnal-minded men who invented the doctrine of original sin. (See Psalm 51:5) This is entirely repudiated by Islam, in which the office of the father and mother is held in the highest veneration. Every child of pure love is born pure. Celibacy is not necessarily a virtue, and may be a vice.” 9

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Marriage and the Hadith • Temporary marriages – While “on expedition” (jihad) with provision of a dower • “We were on expedition with Allah’s messenger and we had no women with us. We said: ‘Should we then have ourselves castrated?’ The Holy Prophet forbade us to do so. He then granted us permission that we should contract for a temporary marriage for a stipulated period giving her a garment for dowry.” (Hadith 3243) – Sunni regard this temporary marriage as unlawful. Shi’a still practice this in Iran. Has been justification for what we would call prostitution. • Prohibitions – Do not marry an unbeliever (female). Prohibition relaxed for men – Parties of unequal social rank or status – Trading daughters or sisters in marriage – Remarrying divorced wife until she has been remarried, had sexual intercourse with new husband, and then been divorced 10

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Divorce • A man may divorce a woman by simply declaring his intent • A woman may only divorce a man with a strong reason in court – Must give up her dowry as a result 11 • Divorce according to Surah 2 – 2:228: Waiting 3 menstrual periods – woman may be pregnant – 2:229: Divorcing a woman twice – 2:230: Remarrying after divorce – 2:231: Do not mistreat women as you divorce them – 2:236: Divorce before consummating a marriage

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Talaq! • Talaq! = male-initiated divorce – Pronounce the word three times and first phase of divorce begins – Sexual relations must cease for three menstrual periods – Man may not force woman out of house in this time, or abuse her – If couple has sexual relations, the divorce decree is null and void – Can only do the talaq process three times. Then man must wait until woman remarries, and subsequently divorces, in order to remarry her 12 The Qur’an condemns divorce but provides many rules for how and when.

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Personal Law Issues • Child custody – Traditionally, children belong to the father, but the mother has the right to care for them as young infants – Age of loss of custody differs by nation. Many set it at 7 years for boys, and at puberty for girls – Some Islamic nations are extending rights for mother in cases where deemed in the child’s interest 13 • Inheritance – Mothers, daughters, and wives are guaranteed an inheritance – Man’s inheritance is to be twice that of the woman’s

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Beating of Women • Qur’an allows marital punishment • Husband is commanded to train his wife – Surah 4:34: “Husbands are the protectors and maintainers of their wives” • Husbands may beat wife or withhold sexual favors – Surah 4:34: “As to those women on whose part ye fear disloyalty and ill- conduct admonish them first, next refuse to share their beds, and last spank them lightly.” – Hadith 7.62.77: “’What rights does the woman have with the man?’ He (Muhammad) replied, ‘He should feed her if he eats, clothe her when he dresses, avoid disfiguring her or beating her excessively or abandoning her except at home.’” 14

Arranged marriages are good. – Woman can file suit in court and provide sole testimony – Women can initiate divorce – Women get automatic custody of young children after divorce (suckling children) – Spousal abuse is a punishable offense – Women receive equal pay for equal work – Women can vote and stand for civil office 15

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Female Genital Mutilation • Female Genital Mutilation (FGM) – Medical term: Clitorectomy • Partial or complete removal of genitalia • Women sew girl’s skin together with thorns or thread, then bind the girl’s legs together for 2-12 weeks – 130M women affected worldwide – 2M women affected per year – Openly practiced in Africa – Secretly practiced in Middle East • Egypt, Somalia, Guinea • Mali, Sudan, Ethiopia, Sierra Leone • Saudi Arabia, Oman, Jordan, UE • Parts of Iraq (up to 60% of girls) 16

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Honor Killing: Violating the Namus • The namus of a man is violated if: – His daughter is not dressed "appropriately" – If he tolerates an offense by his daughter without reaction. – Daughter failing to serve meal on time, or refusing arranged marriage – Daughter seeking a divorce, or narrating a dream of infidelity – A song being dedicated to a female family member on the radio – Being raped • In the most conservative interpretations, if a woman is raped, she is not seen as a victim. Instead, it is considered that the namus of the whole family was violated, and to restore it, an honor killing of the raped woman may happen (estimated 5,000 victims yearly) • In other cases, the raped woman may, under social duress to restore namus, commit forced suicide. • In Pakistan acid is thrown on the victim's face to disfigure them rather than being murdered. 18

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Homosexuality and Sharia Law • Seven countries worldwide authorize capital punishment for homosexuality on the grounds of Sharia law • Saudi Arabia – 2,600 lashes and 6 years in prison • Iran – Up to 4,000 homosexuals executed since 1979, including beheadings – 100 lashes for first act of lesbianism. Three acts of lesbianism results in a death sentence. • Afghanistan – Regularly executed homosexuals under Taliban rule • Under Muhammad – Throw them off a building – If a tall building cannot be found, use a cliff 20

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Branches of Sharia • Ritual worship – Purifications, prayers, fasts, charities and pilgrimage • Transactions and contracts • Morals and manners • Beliefs • Punishments • Human interactions – Financial transactions as applied to Sharia-compliant Islamic finance – Endowments – Laws of inheritance – Marriage, divorce, and child care – Foods and drinks (including ritual slaughtering and hunting) – Penal punishments – Warfare and peace – Judicial matters (including witnesses and forms of evidence) 23

Considered blasphemy. – "The Qur'an says that Allah curses the one who harms the Prophet in this world and He connected harm of Himself to harm of the Prophet. There is no dispute that anyone who curses Allah is killed and that his curse demands that he be categorized as an unbeliever. The Judgment of the unbeliever is that he is killed.” (TV interview, Sharia law proponent) • Homosexuality – Illicit under Islamic law. Punishable by death in many countries • Women – Divorce, number of wives, property, beating, et al – Honor killings. Example: Beheading of wife by US Islamic TV executive. 24

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Hadd Offenses • Five offenses that are an affront to Allah – Wine-drinking and, by extension, alcohol-drinking, punishable by flogging – Unlawful sexual intercourse, punishable by flogging for unmarried offenders and stoning to death for adulterers – False accusation of unlawful sexual intercourse, punishable by flogging – Theft, punishable by the amputation of a hand – Highway robbery, punishable by amputation, or execution if the crime results in a homicide. • Leaving Islam (apostasy) is punishable by death 25

Understanding Islam: For Such A Time As This Women, Marriage, Sexuality, and Sharia Law Majority of Muslims Want Sharia Law • 2015 Poll by the Center for Security Policy • 51% of surveyed US Muslims want sharia as the in the USA • 20% of US Muslims surveyed support the use of violence to enforce acceptance of sharia in the USA 26 Pew Research poll of 2015: 39,000 Muslims surveyed in 38 nations. Majority of Muslims in every Muslim nation want sharia as the law of their land.
