EAP&LB AND DGP’s management, with its extensive international construction contracting background, understands the many problems encountered by international contractors when utilizing Third Country National workforces.   9. 9. <ul><li>Terms & Conditions </li></ul><ul><li>PAYMENT TERMS </li></ul><ul><li>ALL INTRODUCTION FEES ARE PAYABLE WITHIN 14 DAYS OF DATE OF INVOICE., or as agreed to by both parties. </li></ul><ul><li>REPLACEMENT OF CANDIDATES UNDER GUARANTEE </li></ul><ul><li>a) If the successful candidate resigns or their employment is terminated for any reason within the probation period, the Client must advise EAP&LB AND DGP of the full details, in writing within 7 days of the event. </li></ul><ul><li>b) EAP&LB AND DGP will endeavour to provide a replacement candidate at no additional cost, subject to our invoice having been paid within 7 days of issue. </li></ul><ul><li>C) Should the “temp Contract” or “Fixed Term Contract” duration date expires, and the client would like to renew such with the candidate, this is seen as a new contract entered into between the client and the candidate, the client will then be liable for a placement fee, irrespective of whether the client or the agency is paying the candidate. </li></ul><ul><li>RESPECTIVE RESPONSIBILITIES </li></ul><ul><li>EAP&LB AND DGP endeavours to ensure the suitability of any candidate introduced to the Client. The Client shall verify any references and/or qualifications provided by any candidate and/or by EAP&LB AND DGP before engaging such candidate. </li></ul><ul><li>LIABILITY </li></ul><ul><li>EAP&LB AND DGP shall not be liable under any circumstances for any loss, damage or expense suffered or incurred by the Client arising from or in any way connected with EAP&LB AND DGP’s seeking a candidate for the Client or the introduction by EAP&LB AND DGP to the Client of any candidate or the engagement of any candidate by the Client. </li></ul>
