China, India, Japan, Australia, and Europe all are striving to harmonize laws, procedures, and practices regarding IP. Issue #2: International Patent Filings Surpassing Records with Significant Growth from Northeast Asia The World Intellectual Property Organization (WIPO) administers the Patent Cooperation Treaty (PCT), the cornerstone of the international patent system. Since it began in 1978, PCT use has seen continuous growth with a record 145,300 applications being filed in 2006, and 156,100 applications in 2007. <ul><li>2007 International Patent (PCT) Filings </li></ul><ul><li>4.7% rate of growth over 2006 filings. </li></ul><ul><li>Republic of Korea experienced 18.6% growth in 2007 filings over those in 2006 to overtake the United Kingdom and France, becoming the 4th biggest country of origin of PCT filings. </li></ul><ul><li>China achieved double-digit growth (7th highest filer, with a growth rate of 38.1%) in 2007 </li></ul><ul><li>52,000 PCT applications from the U.S. represented 34.1% (a 2.6% increase over 2006) of all applications in 2007 maintaining the 1st position </li></ul><ul><li>Applicants from Japan maintained their 2nd place position with (17.8% of the total number of applications, representing a 2.6% increase over 2006 </li></ul>Response: Consider the PCT filing system & expect to deal with Asian Patents even when only selling your products and services in the U.S. 10 Intellectual Property Issues Affecting Your 2008 Bottom Line Intellectual Property Management & Strategies

Issue #5: IP Valuations Becoming More Analytical, Reliable, and Bankable The link between IP valuation and the financial results companies that achieve and report brings these legal and accounting mandates into the realm of corporate governance and compliance. So, reviewing IP creation & protection, and commercialization management should be a top priority . U.S. Laws Forcing IP Valuations & Reporting Sarbanes-Oxley: Public companies must provide enhanced disclosure in filings SEC of matters that materially affect, or are likely to have a material impact on, its business and financial performance. SFAS 141: All business combinations must now be accounted for using the purchase method, based on the values of the assets exchanged. SFAS 142: Goodwill and indefinite-lived intangibles are no longer amortized. Additionally, goodwill and other intangibles (including, IP) must now be tested annually for asset impairment, at the reporting unit level, and on an interim basis, if an adverse triggering event takes place.
