  • 2. What did 498a brought?
      • Court conviction rates of ONLY 2% - 4% in the last 15+ yrs of 498a history [ resource – video2]
      • In JUST 2005 (National Crime Records Bureau-NCRB)
      • - 134,757 arrests (FIRs)
      • - Only 5,739 Convictions
      • - i.e., 4.26% conviction rate (95% misuse) [ Resource ]
      • Huge smoke-show of “crime rate against married women raising” news by many radical women groups
      • In lakhs of implicit (at home) 498a-terror and explicit “legal-terrorism” in society
      • Large Scale elder abuse – Almost 1 out of 2 misuse (45000/yr) cases, elders are arrested. Depression, Disease, cursing at courts
  • 3. What did 498a brought?
      • Millions of families broke down; single parenting; Creator of 498a go scot-free!!!
      • Supreme Court in 2005 declared misuse unleashing legal-terrorism in society in a judgment [ source ]
      • Also informed parliament to amend 498a law to close loopholes soon [ source ]
      • With statistics around 6 million people affected by the misuse of 498a in last 20 yrs
      • - with >1 lakh FIRs an yr misuse;
      • - 4 family members on an avg in a case
      • And estimated at least another 8 million people in implicit 498a fear at home

  • 5. Provisions New DV act (PWDVA)
      • Ex-wife/Ex-live-in partner (with current wife/live-in partner) can file DV after n no. of yrs as per provisions and all DV provisions applicable equally to all these women (wife has to share all)[pg:68]
      • Economic/Verbal/Emotional clauses in complete clumsy drafting (Case should reach court to decide clauses). [ source ]
      • If a man commits any kind of above violence, he can land in jail (up to 1 yr) with a fine up to Rs 20,000.
      • Complete overthrow of a gender in the society (NO provisions to include DV against men)
      • Not paying rent/providing money to WIFE (not spouse) is Domestic violence [ source pg:66-72]
      • Economic/Verbal/Emotional Violence also be considered for automatic case registration or PO/Inspector can be penalized [ source1 , source2 ]
      • Obvious risk provisions for unleashing legal-terrorism far higher than 498a [ source ]
  • 6. Provisions New DV act (PWDVA)
      • Supreme Court judge (Dec 16 th , 06) stated poor/clumsy drafting on “right of residence” to wife [ source ]
      • If incidents reported applicable to any other IPC criminal procedures , women can lodge/initiate further FIRs with police support
      • DV is non-bailable and cognizable and magistrate only can issue bail
      • DV provision says, Not to operate the joint bank accounts or lockers; Not to give up rights on property/dispose off (or loan on) where she stays without permission of the court[pg:72]
      • She can stop DV complaint anytime (this causes hen-peck/handcuff/implicit terror) [pg: 73]
      • Magistrate regular orders are protection orders, residence orders, monetary relief and child custody from the man
      • All clauses drafted purely considering male and female gender based (obvious foreign feminism influence involved) and not family
      • People should very much apply common sense rather blindly misusing DV act for saving Indian family system
  • 7. Realities
      • The ratio of Male : Female victims of suicide was 63 : 37 [ NCRB , 2003 ]
      • USA/Canadian Govt issued warning on their embassy websites to their citizens about possible 498a [dowry extraction] arrests in India [ source ]
      • Mediaradar.org discovered corrections against fake statistics rumor mill in international media that “70% Indian women are battered” [ source1 , source2 ]
      • Suicide stats: The rates do not vary much between the sexes for the never married. Among those currently married, while the rate for males is about 17 per 100,000 persons, the rate for females is 11.4 per 100,000. Among those widowed, while the rate for males is 21 per 100,000 persons, the rate for females is also significantly lower, at 6.6 per 100,000. However, among divorced males the suicide rate is 164 per 100,000 persons, but even in this class, among females the rate is only 63 per 100,000. While the suicide rate for separated men is about 167, for females it is only 41 per 100,000 persons [ Nagaraj , MIDS, paper to Congress , 1999]

      • Last 20+ yrs, articles/news portrayed in most media about huge “crime against women” or “dowry abuse” by radical groups is based on MAINLY police FIRs
      • Child welfare, poverty, foeticide issues are usually largely molded to represent as “Women Issues” (women rights issue) by several radical groups
      • There is NO law in Indian society for domestic violence against men; Therefore no record of Crime against married men or convictions
      • Conviction rates (4%) on crime against married women is incredibly lower than police FIRs reported
      • Just a search on google for “498a”, “legal terrorism”, husband harassment” reveals thousands of victims
