NSW DUI PENALTIES• Drink Driving Offences are EXTREMELY SERIOUS & carryvery harsh penalties.• The penalties for a DUI Offence will largely depend on afew factors relating to the charge including:• Level of Blood Alcohol Concentration (BAC);• Prior DUI Offences & generally traffic history;• Whether there were any aggravating features involved;• Case Preparation.
  • 3. TYPES OF PENALTIESThere are many different type of penalties andsentences at the Courts disposal. Some of theseinclude:• Fine• License Disqualification• MERIT or intensive sober driver programs• Community Service Order• Home Detention• Suspended Sentence• Full time imprisonment• Criminal Conviction
  • 4. SERIOUS DUI OFFENCESIf your DUI incident involved features such as:• Property damage,• Injury,• Death,• Driving with children,• Reckless or dangerous driving,• Extremely excessive blood alcohol level• or other serious aggravating features.Then the court may seek to deal with you matter withpenalties & sentences more serious than a fine and licensedisqualification. (We will discuss this in a further video).
  • 5. 1st or 2nd OffenceGenerally speaking if it is your 1st or 2nd drink drivingoffence then Court Courts will usually deal with youby way of:• Monetary fine,• License disqualification, and• Criminal conviction.Lets take a look at the general types of penaltiesissued for the different levels of drink drivingoffences.

NOVICE RANGE PCAPENALTIESBAC (0.00 to 0.019)1ST OFFENCE:Maximum fine - $1,100Maximum jail - NILAutomatic disqualification – 6 months.Minimum disqualification – 3 months.2nd OFFENCE (within the past 5 years):Maximum fine - $2,200Maximum jail – NilAutomatic disqualification – 12 months.Minimum disqualification – 6 months.

SPECIAL RANGE PCAPENALTIES BAC (0.02 TO0.049)1ST OFFENCE:Maximum fine - $1,100Maximum jail - NILAutomatic disqualification – 6 months.Minimum disqualification – 3 months.2nd OFFENCE (within the past 5 years):Maximum fine - $2,200Maximum jail – NilAutomatic disqualification – 12 months.Minimum disqualification – 6 months.

LOW RANGE PCA PENALTIESBAC (0.050 to 0.079)1ST OFFENCE:Maximum fine - $1,100Maximum jail - NILAutomatic disqualification – 6 months.Minimum disqualification – 3 months.2nd OFFENCE (within the past 5 years):Maximum fine - $2,200Maximum jail – NilAutomatic disqualification – 12 months.Minimum disqualification – 6 months.

MIDDLE RANGE PCAPENALTIES BAC (0.080 to0.149)1ST OFFENCE:Maximum fine - $2,200Maximum jail – 9 monthsAutomatic disqualification – 12 months.Minimum disqualification – 6 months.2nd OFFENCE (within the past 5 years):Maximum fine - $3,300Maximum jail – 12 monthsAutomatic disqualification – 3 years.Minimum disqualification – 12 months.

HIGH RANGE PCAPENALTIES BAC (0.150 +)1ST OFFENCE:Maximum fine - $3,300.Maximum jail – 18 months.Automatic disqualification – 3 years.Minimum disqualification – 12 months.2nd OFFENCE (within the past 5 years):Maximum fine - $5,500.Maximum jail – 2 years.Automatic disqualification – 5 years.Minimum disqualification – 2 years.
