Policeorganizations everywhere have been handling large amounts of information and huge volume ofrecords pertaining to crime and criminals. Information Technology (IT) can play a very vital rolein improving outcomes in the areas of Crime Investigation and Criminals Detection and otherfunctioning of the Police organizations, by facilitating easy recording, retrieval, analysis andsharing of the pile of Information. Quick and timely information availability about differentfacets of Police functions to the right functionaries can bring in a sea change both in Crime &Criminals handling and related Operations, as well as administrative processes.Creation and maintenance of databases on Crime & Criminals in digital form for sharing by allthe stakeholders in the system is therefore very essential in order to effectively meet thechallenges of Crime Control and maintenance of public order. In order to achieve this, all theStates should meet a common minimum threshold in the use of IT, especially for crime &criminals related functions.This is the Volume II of the SI RFP template that comprises bidding guidelines, instructions tothe bidders, evaluation criteria, formats for bid response etc.2.0 RFP StructureThe content of this model RFP has been documented as a set of two volumes explained below:Volume I: Technical and Functional RequirementsVolume I of RFP intends to bring out all the details with respect to functional and technicalrequirements along with details on scope of work, implementation model, and non-functionalrequirements that KCoPS or its constituted committees or representatives deems necessary toshare with the potential bidders. Thedate, time and venue of the conference will be available at https://eproc.karnataka.gov.in or fromthe Karnataka State Police Department website www.ksp.gov.in . The representatives of theinterested organizations may attend the pre-bid conference at their own cost. The purpose of theconference is to provide bidders with information regarding the RFP and the proposed solutionrequirements in reference to the particular RFP. KCoPS or its constituted committees or representatives make no commitments, explicitor implicit, that this process will result in a business transaction with anyone.b. The green checked status will indicate the completion of activity. The bidder shallensure green check status for all the activities in the bidding screen prior to submission ofbid.e. KCoPS or its constituted committees or representatives may, in exceptionalcircumstances and at its discretion, extend the deadline for submission of proposals byissuing an addendum or by intimating all bidders who have been provided the RFP, inwhich case all rights and obligations of KCoPS or its constituted committees orrepresentatives and the bidders previously subject to the original deadline willthereafter be subject to the deadline as extended3.2.13 Late BidsThe tender gets automatically locked after the last date and time for receipts of bids. Thee-procurement system will not allow late bids.3.3 Bid Submission InstructionsProposals must be direct, concise, and complete. KCoPS or its constituted committees orrepresentatives will evaluate bidder‟s proposal based on its clarity and the directness ofits response to the requirements of the project as outlined in this RFP.Bidders shall furnish the required information on their pre-qualification, technical andcommercial proposals and uploaded the same in E-proc e-tender portal of GOK. Anydeviations in format the tender will be liable for rejection.

Submission of bids shall be in accordance to the instructions given in the in E-procurement portal of GOK (https://eproc.karnataka.gov.in)ii. KCoPS or its constituted committees or representatives will not accept delivery ofproposal in any manner other than that specified in this volume. Proposal delivered inany other manner shall be treated as defective, invalid and rejected.iii. Technical proposal should not contain any commercial information.iv. The technical and commercial proposals should be uploaded along with a certifiedtrue copy of the corporate sanctions/approvals authorizing its authorizedrepresentative to sign/act/execute documents forming part of this proposal includingvarious RFP documents and binding contract, at the address and time as specified inthis RFP.v. If any bidder does not qualify in technical evaluation, the Commercial Proposal willnot be opened.vi. The proposals shall be valid for a period of Six (6) months from the date of opening ofthe proposals. A proposal valid for a shorter period may be rejected as non-responsive. On completion of the validity period, unless the bidder withdraws hisproposal in writing, it will be deemed to be valid until such time that the bidderformally (in writing) withdraws his proposal.vii. In exceptional circumstances, at its discretion, KCoPS or its constituted committeesor representatives may solicit the bidders consent for an extension of the validityperiod. The request and the responses thereto shall be made in writing or by fax oremail.viii. The commercial proposal (Price) shall be entered by the bidder in the final section ofthe tender as appearing in the e-procurement portal. Also the bidder shall scan andupload the copies of financial bid formats as specified in the RFP against eachfinancial bid slot provided in “Upload Bid Documents” section of the tender.Note:-The final consolidated commercial value shall be entered by bidder in thefinancial bid section. Bidders shall upload the scanned copy of the relevantAnnexure F – Pricing Summary as provided in the Volume-II of RFP document.3.3.2 Commercial Proposali. The Bidder is expected to price all the items and services proposed in the TechnicalProposal. KCoPS or its constituted committees or representatives may seekclarifications from the Bidder on the Technical Proposal. Any of the clarifications bythe Bidder on the technical proposal should not have any commercial implications.The Commercial Proposal uploaded by the Bidder should be inclusive of all the itemsin the technical proposal and should incorporate all the clarifications provided by theBidder on the technical proposal during the evaluation of the technical offer.ii. Unless expressly indicated in this RFP, bidder shall not include any technicalinformation regarding the services in the commercial proposal. Additional informationdirectly relevant to the scope of services provided in Volume I may be uploaded to

In case of discrepancy between the price mentioned in the e-procurement portal vis-à-vis price mentioned in annexure attached, KCoPS or itsconstituted committee shall consider the price beneficial to Government.iv. Correction of Errora. Bidders are advised to exercise adequate care in quoting the prices. No excusefor corrections in the quoted figures will be entertained after the commercialproposals are uploaded at E-procurement portal of GOK. All corrections, if any,should be initialled by the person uploading the proposal form before submission,failing which the figures for such items may not be considered.b. Arithmetic errors in proposals will be corrected as follows: In case of discrepancybetween the amounts mentioned in figures and in words, the amount in wordsshall govern. The amount stated in the proposal form, adjusted in accordancewith the above procedure, shall be considered as binding, unless it causes theoverall proposal price to rise, in which case the proposal price shall govern.v. Prices and Price Informationa. The Bidder shall quote a price for all the components, the services of the solutionto meet the requirements of KCoPS or its constituted committees orrepresentatives as listed in the Volume I of this RFP. All the prices will bein Indian Rupeesb. No adjustment of the price quoted in the Commercial Proposal shall be made onaccount of any variations in costs of labour and materials, currency exchangefluctuations with international currency or any other cost component affecting thetotal cost in fulfilling the obligations under the contractc. The price quoted in the Commercial Proposal shall be the only payment, payableby KCoPS or its constituted committees or representatives to the successfulBidder for completion of the contractual obligations by the successful Bidderunder the Contract, subject to the terms of payment specified as in the proposedcommercial bid or the one agreed between KCoPS or its constituted committeesor representatives and the Bidder after negotiations. The price would be inclusiveof all taxes, duties, charges and levies as applicable.d. The prices, once offered, must remain fixed and must not be subject toescalation for any reason whatsoever within the period of the validity of theproposal and the contract. A proposal uploaded with an adjustable pricequotation or conditional proposal may be rejected as non-responsive.e. Bidder should provide all prices, quantities as per the prescribed format given inAnnexure-F (Form 1 – Pricing Summary). Bidder should not leave any fieldblank. In case the field is not applicable, Bidder must indicate “0” (zero) in allsuch fields.f. The BOM suggested for the project shall be provided as part of the technicalproposal without mentioning the financial costs in the format provided inAnnexure B - Bill of Material. The costing shall be in the financial proposal. It is

If any mismatch is found then thefollowing scenario would be applied –i. If BOM provided as part of the Technical Proposal is found to be morethan or equal to the BOM provided as part of the Financial Proposal,then the SI has to supply the BOM suggested as part of the TechnicalProposal at the total cost provided under the Financial Proposal.ii. If BOM provided as part of the Financial Proposal is found to be morethan the BOM provided as part of the Technical Proposal, then the SIhas to supply the BOM suggested as part of the Financial Proposal.g. All the tools and technologies proposed for the project should be provided as aseparate sheet in the format specified within Annexure J: Tools &Technologies Proposed for the Project.h. It is mandatory to provide break-up of all taxes, duties and levies whereverapplicable and/or payable. All the taxes of any nature whatsoever shall be borneby the Bidder including any additional taxes/levies due to change in tax rates.i. The bid amount shall be inclusive of packing, forwarding, transportation,insurance till Go Live, delivery charges and any other charges as applicable.j. All costs incurred due to delay of any sort, shall be borne by the Bidder.k. KCoPS or its constituted committees or representatives reserves the right to askthe Bidder to submit proof of payment against any of the taxes, duties, leviesindicated within specified time frames.3.3.3 Language of ProposalsThe proposal and all correspondence and documents shall be written and upload inEnglish. All proposals and accompanying documentation will become the property ofKCoPS or its constituted committees or representatives and will not be returned.3.3.4 Conditions Under which this RFP is issueda. This RFP is not an offer and is issued with no commitment. KCoPS or its constitutedcommittees or representatives reserve the right to withdraw the RFP and change orvary any part thereof at any stage. KCoPS or its constituted committees orrepresentatives also reserve the right to disqualify any bidder should it be sonecessary at any stage.b. Timing and sequence of events resulting from this RFP shall ultimately bedetermined by KSP/ KCoPS.c. No oral conversations or agreements with any official, agent, or employee of KCoPSor its constituted committees or representatives shall affect or modify any terms ofthis RFP and any alleged oral agreement or arrangement made by a bidder with anydepartment, agency, official or employee of KCoPS or its constituted committees orrepresentatives shall be superseded by the definitive agreement that results from thisRFP process. Oral communications by KCoPS or its constituted committees or

Neither the bidder nor any of the bidder‟s representatives shall have any claimswhatsoever against KCoPS or its constituted committees or representatives or any oftheir respective officials, agents, or employees arising out of or relating to this RFP orthese procedures (other than those arising under a definitive service agreement withthe bidder in accordance with the terms thereof).e. Until the contract is awarded and during the currency of the contract, bidders shallnot, directly or indirectly, solicit any employee of KCoPS or its constituted committeesor representatives to leave KCoPS or its constituted committees or representatives orany other officials involved in this RFP process in order to accept employment withthe bidder, or any person acting in concert with the bidder, without prior writtenapproval of KSP/ KCoPS.3.3.5 Rights to the Content of the Proposala. All proposals and accompanying documentation of the Technical proposal willbecome the property of KCoPS or its constituted committees or representatives andwill not be returned after opening of the technical proposals. The commercialproposals that are not opened will be returned to the bidders. KCoPS or itsconstituted committees or representatives is not restricted in its rights to use ordisclose any or all of the information contained in the proposal and can do so withoutcompensation to the bidders. KCoPS or its constituted committees or representativesshall not be bound by any language in the proposal indicating the confidentiality ofthe proposal or any other restriction on its use or disclosure.3.3.6 Modification and Withdrawal of Proposalsa. No proposal may be withdrawn in the interval between the deadline for submission ofproposals and the expiration of the validity period specified by the bidder on theproposal form. Entire bid security may be forfeited if any of the bidders withdraw theirbid during the validity period.3.3.7 Non-Conforming ProposalsA proposal may be construed as a non-conforming proposal and ineligible for consideration:a. If it does not comply with the requirements of this RFP. Failure to comply with thetechnical requirements, and acknowledgment of receipt of amendments, are commoncauses for holding proposals non-conformingb. If a proposal appears to be “canned” presentations of promotional materials that donot follow the format requested in this RFP or do not appear to address the particularrequirements of the proposed solution, and any such bidders may also bedisqualified3.3.8 DisqualificationThe proposal is liable to be disqualified in the following cases or in case bidder fails tomeet the bidding requirements as indicated in this RFP:

Proposal not submitted/uploaded in accordance with the procedure and formatsprescribed in this document or treated as non-conforming proposal. Proposals in“Draft” status as appearing in e-procurement portal.b. During validity of the proposal, or its extended period, if any, the bidder increases hisquoted pricesc. The bidder qualifies the proposal with his own conditionsd. Proposal is received in incomplete forme. Proposal is not accompanied by all the requisite documentsf. If bidder provides quotation only for a part of the projectg. Information submitted in technical proposal is found to be misrepresented, incorrector false, accidentally, unwittingly or otherwise, at any time during the processingof the contract (no matter at what stage) or during the tenure of the contractincluding the extension period if anyh. Bidder tries to influence the proposal evaluation process byunlawful/corrupt/fraudulent means at any point of time during the bid processi. In case any one bidder submits multiple proposals or if common interests are foundin two or more bidders, the bidders are likely to be disqualified, unless additionalproposals/bidders are withdrawn upon notice immediatelyj. Bidder fails to deposit the Performance Bank Guarantee (PBG) or fails to enter into acontract within 15 working days of the date of notice of award of contract or withinsuch extended period, as may be specified by KSP/ KCoPSk. Total transparency will be observed while opening the proposals/bids.b. KCoPS or its constituted committees or representatives reserves the rights at alltimes to postpone or cancel a scheduled bid opening.c. The bids will be opened, in three stages namely Pre-qualification, Technical andCommercial.d. KCoPS or its constituted committees or representatives will review the technical bidsof the short-listed bidders to determine whether the technical bids are substantiallyresponsive. Bids that are not substantially responsive will be disqualified. KCoPS orits constituted committees or representatives may seek inputs from their professional,external experts in the technical and commercial evaluation process.d. The KCoPS or its constituted committees or representatives shall assign technicalscore to the bidders based on the technical evaluation criteria. Detailed modalities for applying DCF technique are as below: Net Present Value (NPV) method will be used for evaluation of the CommercialOffer. The Net Present Value of a contract is equal to the sum of the presentvalues of all the cash flows associated with it. The formula for calculating NPV ofa Commercial Offer is illustrated in Para (6) below. Discounting rate to be used under the method is to be the Government of India‟slending rate on loans given to KSP/ KCoPS Governments. These rates arenotified by Budget Division of Ministry of Finance annually. The latest one isMinistry of Finance OM No F5(3) PD/2008 dated 30 October 2008 (as per whichthe borrowing rate is 9%). The KSP/ KCoPS will evaluate the offers received byadopting Discounted Cash Flow (NPV) method with a discounting rate of 9%. NPV will be calculated on the annual cash outflows. Standard software for example „Excel‟, „Lotus 1-2-3‟ or any other spread sheet,which comes preloaded as part of a personal computer will be used for NPVanalysis. The blended person month cost for 300 person months will be considered in thecash flows in the first year The NPV will be calculated using the formula below:NPV = C0 + C1/(1+r)1+ C2/(1+r)2Where,i. Here it should be noted that any deviation orexclusion unacceptable to the department would lead to the disqualification of the bidder from thetendering process.3.6 OEM certification and commitmentThe SI has to ensure that it has a back to back arrangement with the Original EquipmentManufacturer (OEM) of the software and hardware suggested by it as part of the technicalsolution. This support should be provided in a form of a letter from the OEMs stating therelationship with the SI and the guarantee that the OEM will provide support in case the SI isunable to do so. OEMs should also certify the adequacy of the hardware and the software to therequirements mentioned in this RFP. Please refer to, Annexure-H: Letters from OEMs on theletterhead of the OEM, for the draft letter which needs to be signed by each OEM whose productis being suggested by the SI.4. Award of Contract4.1 Award CriteriaKCoPS or its constituted committees or representatives will award the Contract to thesuccessful bidder whose proposal has been determined to be substantially responsiveand has been determined as the best value proposal.4.2 KSP/ KCoPS’s Right to Accept Any Proposal and To Reject Any or AllProposalsKSP/ KCoPS reserves the right to accept or reject any proposal, and to annul thetendering process and reject all proposals at any time prior to award of contract, withoutthereby incurring any liability to the affected bidder or bidders or any obligation to informthe affected bidder or bidders of the grounds for KSP/ KCoPSs action.4.3 Notification of AwardPrior to the expiration of the validity period, KCoPS or its constituted committees orrepresentatives will notify the successful bidder in writing or by fax or email, to beconfirmed in writing by letter, that its proposal has been accepted. The notification ofaward will constitute the formation of the contract. Upon the successful biddersfurnishing of performance bank guarantee, KCoPS or its constituted committees orrepresentatives will promptly notify each unsuccessful bidder and return their BidSecurity.

If it is unable to finalizethe contract with the bidder ranked first due to any reason, the KCoPS or its constitutedcommittees or representatives may proceed to and negotiate with the next ranked bidder,and so on as per General Financial Rules (GFR) until a contract is awarded. KCoPS orits constituted committees or representatives reserves the right to present a contract tothe bidder selected for negotiations. A contract will be awarded to the responsible,responsive bidder whose proposal conforms to the RFP and is, in the opinion of the KSP/KCoPS, the most advantageous and represents the best value to the proposed project,price and other factors considered. Evaluations will be based on the proposals, and anyadditional information requested by the KSP/ KCoPS. Proposed project will involve thepayment for the contract based on not only successful delivery of the solution but also onthe success of the project after “Go-live”.4.5 Signing of ContractAt the same time as KCoPS or its constituted committees or representatives notifies thesuccessful bidder that its proposal has been accepted, KCoPS or its constitutedcommittees or representatives shall enter into a separate contract, incorporating allagreements (to be discussed and agreed upon separately) between KCoPS or itsconstituted committees or representatives and the successful bidder.KCoPS or its constituted committees or representatives shall have the right to annul theaward in case there is a delay of more than 30 days in signing of contract, for reasonsattributable to the successful bidder.4.6 Failure to agree with the Terms and Conditions of the RFPFailure of the successful bidder to agree with the Terms & Conditions of the RFP shallconstitute sufficient grounds for the annulment of the award, in which event KSP/ KCoPSmay award the contract to the next best value bidder as per section 6.1.4 in this RFP orcall for new proposals or invoke the PBG.4.7 Purchaser’s right to Vary Quantities at Time of AwardThe Purchaser reserves the right at the time of Contract award to increase or decrease, by thepercentage(s) indicated in the Scope of Work, any of the following:i. the quantity of substantially identical Subsystems; orii. the quantity of individual hardware, software, related equipment, networking equipments,materials, products, and other goods components of the Information System; oriii. The quantity of Installation or other Services to be performed, from that originallyspecified in the Technical Requirements, without any change in unit prices or other termsand conditions.

Karnataka State Police RFP for Selection of State System Integrator Volume-II 34E-Governance Mission Mode Project: Crime & Criminals Tracking Network and Systems 20114.8 Warranty & MaintenanceBidder shall also provide complete maintenance support for all the proposed Police IT-CCTNS Solution components as outlined in this RFP for a minimum of Thirty Six monthsfrom the date of go-live i.e. “Go-Live” + ‟24 months‟ .The successful bidder shall provide a comprehensive warranty for duration of „36‟months, commencing from the date when the system goes “live” i.e. („Go-Live‟ + „24‟months).During the warranty period, the bidder shall warrant that the goods supplied under thecontract are new, unused, of the latest release version/ models at the time of delivery andincorporate all recent improvements in design and materials, unless provided otherwisein the contract. The bidder further warrants that the goods supplied under this contractshall have no defects arising from design, materials or workmanship.KCoPs shall promptly notify the successful bidder in writing of any claims arising underthis warranty. Upon receipt of such notice, the bidder shall, within the warranty period andwith all reasonable speed, repair or replace the defective systems, without costs to theIGP and within the time specified and acceptable to the KCoPS.If the successful bidder, having been notified, fails to remedy the defect(s) within theperiod specified in the contract, KCoPSmay proceed to take such reasonable remedialaction as may be necessary, at the successful bidder‟s risk and expense and withoutprejudice to any other rights, which KCoPSmay have against the bidder under thecontract.During the comprehensive warranty period, the successful bidder will provide allproduct(s) and documentation updates, patches/ fixes, and version upgrades within 15days of their availability and should carry out installation and make operational the sameat no additional cost to KCoPS.The successful bidder hereby warrants IGP that:The proposed Police IT Solution represents a complete, integrated solution meeting allthe requirements as outlined in the RFP and further amendments if any, and provides thefunctionality and performance, as per the terms and conditions specified in the contract.The proposed Police IT Solution will achieve parameters delineated in the technicalspecification/ requirement and shall be appropriately integrated to meet the proposedPolice IT Project requirements.The successful bidder will be responsible for warranty services from subcontracted thirdparty producers or licensers of products included in the systems.The successful bidder undertakes to ensure the maintenance of the acceptancecriterion/standards in respect of the systems during the warranty period.

Payment Terms and Schedule5.1 Performance Bank Guarantee A PBG of 10% of value of the contract would be furnished by the bidder in the form ofa Bank Guarantee as per the format provided in this RFP from Indian Public SectorBanks or Private Sector Banks authorized by the Government to conductGovernment transaction. At present HDFC Bank, ICICI Bank and AXIS Bank are theonly three private sector banks authorized by the Government. Details of the bankare to be furnished in the commercial offer. The PBG should be furnished within 15 calendar days from the signing of thecontract and should be valid for entire term of the contract. KSP/ KCoPS may forfeit the Performance Guarantee for any failure on part of Bidderto complete its obligations under the Agreement. The Performance Guarantee shall be returned to the Bidder within 30 days of thedate of successful discharge of all contractual obligations at the end of the period ofthe Agreement by the KSP/ KCoPS In the event of any amendments to Agreement, the Bidder shall within 15 days ofreceipt of such amendment furnish the amendment to the Performance Guarantee asrequired. An unconditional and irrevocable Performance Bank Guarantee (PBG) from ascheduled commercial bank, acceptable to Inspector General of Police, ComputerWing, in the format prescribed in Annexure-I: Performance Bank Guarantee(PBG), payable on demand, for the due performance and fulfilment of the contract bythe bidder5.2 Liquidated DamagesIn the event of the Bidders failure to submit the Bonds, Guarantees and Documents andsupply the solution / equipment as per schedule specified in this RFP, KSP/ KCoPS mayat its discretion withhold any payment until the completion of the contract. KSP/ KCoPSmay also deduct from the Bidder as agreed, liquidated damages to the sum of 0.5% ofthe contract price of the delayed/undelivered services (as detailed in Volume I of thisRFP) for every week of delay or part of a week, subject to the maximum value of theLiquidated Damages being not more than 10% of the value of delayed services. This right
