  • Staying legal – assumes you want to stay legal. So much of what happens on line is very close to the edges or what’s legal What’s illegal in Ireland may be legal in the US – the server may be in Asia – who or where do you sue to vindicate your/your client’s interests or entitlements? Blogging may be unlawful – tracing bloggers may be impossible.
  • Is consent required to use cookies? Information gathered for marketing purposes. Use of third party information – make sure that in obtaining direct marketing lists you do so from reputable companies that can warrant that data provided has been collected and can be used in accordance with principles

    • Blogs and posts can be defamatory – tracing bloggers and
    • those responsible for postings can often be impossible. Liability of website/
    • social media page holder for posting?
    • Irish based business/corporate body – can be traced; can be sued for damages.
    • E mails, web-postings, Facebook messages, tweets all = publications,
    • defamation law applies
    • Re-posting material from other websites = publication, defamation law applies
