Cease and Desist Letter (English)

In this presentation, you will learn how to use a “cease and desist letter” to prevent creditors from harassing you.

What are my rights to stop a debt collector from contacting me?
Debt collectors must stop routine collection efforts upon receiving either:
A written request from you to stop contact (a “cease and desist letter”); or
A written refusal from you to pay the debt.

What’s the catch?
The debt collector can still file a collection lawsuit against you or take any other appropriate legal action to collect the debt.

What is a “cease and desist” letter?
A letter that is sent to the debt collector demanding that they permanently stop
(“cease”) and not contact you in the future ("desist") about the debt.

I already sent a cease and desist letter.Can they still contact me?
If you sent a “cease and desist” letter, a debt collector may only contact you to:
Advise you that collection efforts are being terminated; or
Advise you of the debt collector’s intent to invoke specific remedies.
The debt collector may not request payment during this time!

Important note
If you have multiple debts with the same creditor, you must send a “cease and desist” letter for each debt separately. One letter will not do.

Get from post office
Get from account statement
Date of letter
Insert name of person you’ve been dealing with, if desired
Make any necessary changes
Remove brackets and insert your name here
